This is not like in the UK where the law on revenge porn explicitly protects the "victim" using the intention of the "distributor" as a discriminant - in which case the initial distributor shared the article merely for entertainment while the perpetrator distributed same article to cause the victim distress. Can you see the difference? You really need to do a proper logic check on laws before trying to apply them.

Yes, that loophole exists. But keep in mind that judges, more often than not, also look to the spirit of the law and legislative intent when deciding a case.

Thus, it won't be a surprise if a judge convicts only the man who distributed the naked pictures without the woman's consent.

Indeed. But there is a reason nobody has yet been convicted under that law in Nigeria. Looking at the law itself, it is easy to see that it was created a long time ago before the Internet Age (fine of 400 Naira) so the idea behind it was far from revenge porn; rather it was to curb the distribution of any article deemed inappropriate. Therefore the originator of the material itself is already guilty. If you take it to court, it becomes easy for a defense lawyer to turn the case against the prosecution.

This is not America or Europe where there is public sympathy for anybody who shares explicit photos that become public; this is Nigeria where there is recrimination and disgust towards such an act - recall Chidinma and the Cucumber.

You are absolutely right about the utter disgust towards the act of the woman, and about the law being obsolete.

Perhaps it could be amended in a way to fully ensure that the victims are protected by the law. N400 fine should become N100,000.

But there is a high probability that a sympathetic judge, who is knowledgeable about the modern trends in revenge-porn laws, would only hold the man criminally liable for the act of 'distribution'.

This is horrible and the Nigerian law needs to be updated. I dated a Nigerian Lawyer for two years. Found out that he cheated on me and when I confronted him and informed the other girls of his infidelity his first response was "I have every right to post the video." The only reason he even had a video of me is he begged for it after he left for Lagos in the claims of missing me...2 months later he threatened to use it against me to hide his infidelity.

If he had still been in the US I could have taken him to court for the threat alone as an act of malice, breach of contract (because yes I did make him agree in writing to not sharing the video or allowing any others to see it) as well as the revenge porn. But due to Naija laws there was nothing I could do.
