willjoe:I'm sure if you read it you will see that the whole bullshit about "you signed it" does not hold water. There is a rule based on "ex turpi causa non oritur actio" which means "no action/right can arise from an illegal act". It therefore follows that CU cannot claim any right of enforcement of their rules signed by the student because it amounts to an illegality in the first place. Put differently, you cannot base your case on nothing. After all, Lord Denning said "You cannot put something on nothing and expect it to stand. Nay! In this instance, CU has a right to make rules for the student but the rules on compulsory attendance at the Church programme is against the fundamental human right to freedom of religion, association, etc as prescribed by the constitution and is therefore null and void. claremont:cu is the educational arm of the ministry indirectly an extension of the ministry,the same law applies, they set their rules as they deemed fit in line with their vision how can you subject a private institution to public laws? Have you gone through their rules and regulations and their core values? These are the requirements the students are all aware of and penalties applicable upon violation, do you know cu rank above most federal universities? What's the difference.. Standard, they can't compromise on it. The rules governing private institutions are a bit extreme compared to public institutions that's why it's private and faith based at that 3 Likes |
