Being a medical doctor doesn't stop me from understanding simple logic applied to constitution. The op even sited previous cases that were judged based on his argument yet people still do not understand. A good case occurred against Chelsea fc few seasons ago when they were to play against athletico madrid at the champions league semi final. Courtoise(Chelsea's goal keeper) was playing for athletico on loan that season. Based on the written agreement (which was signed by both football clubs) courtoise shouldn't play against Chelsea (his parent club).. The written agreement was overruled by UEFA(the governing body) since such rule isn't in their own constitution.lo and behold courtoise played against his parent club neglecting the contract they signed 2 Likes |

Damn! So many "they signed up for it" comments. Even though the post clearly states the legal basis for the illegal actions of CU. It shows that many many Nigerians are stark functional illiterates! Including most that went to school. They can only speak and write English. They can't fvcking think! Same way they could only lament that banks were rejecting the country's legal tender just because it was slightly torn. No wonder the government violently fvcks us on a whim. Reading through the legal submission I am tempted to believe and to say that it is an error on the part of government to have approved establishment of religion-based institutions. The implication of this is the assumption that any student admitted to a faith-based institution belongs to that particular faith and the student has no choice than to obey the rules and regulations of the school. The failure of public schools has led the country to some illegalities we are witnessing in the private institutions. 2 Likes |

OP, are you one of the suspended students? If NO, why take a pill for another man's head ache? If yes, are you not aware if the core values of the institution before accepting the offer? If you are pained, please go to government owned university where you won't attend even classes and nobody will disturb you. Worst is that you won't write the exam. Have you heard about SIM CARD? Thats the core values of covenant university. Stop ranting. Is it the Nigerian constitution that pays their bill or equip their laboratories? Is it the Nigerian govt that brought to Nobel Laureate to come and teach in the school? If you cannot change it, change yourself for it. I'm a graduate from a federal university so don't think I'm support CU because I'm one of them. Let me remind some people of this Nigerian senator who married a 13 year old girl and people said it was child abuse. He said according to his religion Islam, it is acceptable to marry a girl of such age. And since Nigeria has accepted Islam as one of the religion, anything he does under the instruction of the religion is constitutional. Can you read that again? |

bezimo: Religion seems to operate only on our reptilian brain. It switches of critical thinking of the neo cortex and triggers aggression, fear and basic instincts. This is the only reason I can see for people defending barbaric acts of religious authorities and people are ready to commit suicide or murder and lie for their religious beliefs. CU is a conventional university and not a faith based university. It was given a license by NUC to offer conventional degrees and not faith based degrees. It collects fees from the public to offer services of providing university education to the public - both Nigerians and foreigners. It cannot and I repeat cannot impose its religious views on anybody. If a Muslim or even an atheist meet all criteria for admission, it cannot be refused admission based on religion alone. It would be violating both the Nigerian constitution and the international charter on freedom of religion which Nigeria is a signatory of.
You understand wrong. All universities give students an undertaking to adhere to all rules and regulations when they are admitted into universities, that does not give universities blank check to make rules and regulations that infringe on the liberty, rights and dignity of its students. Any rule and regulation that is inconsistent with our constitution is null and void. Maybe the students did not read the undertaking in the first place or maybe they read it but know that the contentious parts of it are null and void. I doubt covenant university will put compulsory attendance of all religious activities or compulsory conversion to a winners church member in their handout. If they did, they would be legally implicating the institution as violating the constitution and hence their condition of license. 2 Likes |

enairaprof:It is a nauseating habit that Nigerians always attempt to defend one illegally with another perceived illegally. Instead of presenting sound arguments, they justify one crime with another crime. The Nigerian senator was wise to exploit loopholes in our constitution, he did not technically break the constitution. The constitution and even the marriage act did not provide a marriage age in Nigeria, what it provided for is age of consent. So unless you can prove that Senator Yerimah slept with his new bride before the constitutional age of consent, you have no case. Furthermore the constitution muddled the legal pond further in Section 29 (4)(b) which specifies that “ any woman who is married shall be deemed to be of full age” So you cannot use the Senators marriage of an underage girl to justify CU's breach of the constitutional rights of its students. 2 Likes |

awoluyi:I doubt these universities applied for licences as faith based universities. They applied for and were given licences to operate standard universities giving out regular degrees. They only behave as they like after obtaining licences. 2 Likes |

willjoe: You're so wrong. All rules within any organization, even when people freely sign up to it, must be in alignment with the Constitution. If the rules are not challenged, there may be no problem. But they become null and void the moment they're challenged. This is what the issue is all about. So stop insulting the author. |

Akainzo: The right to religious freedom is being violated. You know there are different sects of Christianity right?? They are entitled to practise their religion in their own way again as long as they are not violating any laws, if they decide they don't want to pray at that time or the way the church/school practises Christianity is contrary to theirs they should not be punished for that. Remember, the constitution is against punishment for someone exercising their fundamental human right......there, case closed. |

This is a simple matter. The op cited cases with references but the problem with some Nigerians is over sabi... read through his cases. From his post, he made a sound argument but everyone is claiming to know the law more than lawyers. Thirdly CU has no right to enforce a one year suspension for such IT IS A BREACH OF THEIR BASIC FUNDAMENTAL HR. lemme explain. For those shouting they signed an agreement ab initio attesting to be Christians, do you know there are different sects even in Christianity?? meaning different beliefs. Forcing people to attend all your church programmes is tantamount to FORCEFUL conversion hence the breach. It is called extremism. CU is NOT a faith based institution, it is a conventional institution as it offers conventional degrees not otherwise... From the above point, note there is a difference between a rule and a law...CU has rules which is the equivalent of an agreement subject to our laws (constitution). Furthermore if it's truly about preaching, why collect offerings and collections from such students at such programmes?? Please don't argue the law with lawyers especially those that have given citations. Take time to read those cases he listed. If they go to court they will win. it might take time but they will win and the school will pay millions in damages individually if they win... 1 Like |
