Have taken my time to go through the thread since last night and I will make my submissions.

Disclaimer: I am not a lawyer neither have I ever practiced law before.

1. Nobody is accusing Mr bah or trying to prove anything against him. In law and I beleive also in the US, a person is presumed innocent until convicted and in this case Mr bah has been convicted.

So the jd woman and the journalist aren't trying to prove anything against him I believe.

It is Mr. Bah that must prove his innocence in his appeal.

2. In my opinion, the jd woman has really been the most helpful to his case here as believe me if she is asking these questions and punching the holes imagine what the attorneys would do in court.

This should help Mr bah know how to strengthen his case and know which of his evidences are weak and how exactly they can be countered in court.

3. Mr. Bah has placed his invoice majorly on 2 pieces of evidence - the 6 mins phone call he had and the dna testimony of his expert and I will tackle them both.

Like I said earlier I am not a lawyer, but these could help Mr bah build up his evidences.

4. Mr bah claims he made a 6 mins phone and has asked several times if he can be making a phone call and raping the girl at the same time. Well, here are counter questions:

4a. What was the duration of the assault? Did the assault happen for exactly 6 mins or shorten?

Cos if the assault lasted longer eg for at least 30 mins then the 6 mins call becomes baseless. As I can have a phone call for 6 mins and then proceed to do other things.

4b. Was the exact time of the assault recorded. Not an assumed time but the exact time.

Why? Because 6 mins is extremely short and it has to be proved that the assault happened at exactly the same time Mr bah made the call and that the assault lasted for 6 mins.

So I believe the call is a weak piece of evidence (again I am not a lawyer and Mr bah should seek appropriate legal counsel)

5a. Did they victim identify Mr bah at any time.

I believe most parents would ask that their children not testify in an open court cos of the trauma it could cause but that shouldn't stop the victim from talking privately to police I believe.

So did the victim positively identify Mr bah at any time during the investigations?

If she did not, then his defence should be built around this.

5b. There was reportedly a cctv footage and online media reports say the footage shows Mr. Bah chasing the victim into the Woods.

Was this cctv footage shown in court?

If so, what was Mr. Bah reason for chasing the victim?

If the victim did not positively identify Mr bah as the attacker at any point, then that should be argued in court, could be given as I believe this is negligence on thier part (again Mr bah should consult with an attorney)

5c. According to Mr. bah there exists a second cctv footage that shows a man putting a shorts described to the police during a 911 call.

Now this a tricky one?

According to Mr bah, this particular footage wasn't shown in court.

Mr. Bah have you seen this footage and did you identify the man on shorts?

If not, did those who saw the footage identify the man as you?

If his face wasn't captured, did they identify any obvious difference in both your appearance? Significant height and weight difference, hair, tattoo or body piercing, skin color etc.

If yes, then this should be the center piece of your defence.

If you aren't sure, then your attorney should request to study the tape if possible.

6a. Was there any other dna collected at the crime scene?

This could prove that there are more than 1 suspect.

6b. Wad the results of dna analysis disputed in court or was it just the method used in getting the results?

6c. Did they dna expert Mr. Bah claims didn't testify conduct a fresh and different test to disprove that which was presented at not.

If not, how did he arrive at the analysis?

6d. Was the tests presented in court carried out by just one lab or did multiple labs present they same result.

6e. Did Mr. Bah ask for the dna analysis to be redone at any time during the hearings.

If not, is that still possible?

6f. Did the lab or labs that conducted have any history of dna swaps, fraudulent activities or any other incriminating records?

Yes they were VERY sure. That was THE ONLY REASON HE WAS STOPPED. The Be On The Lookout was issued for the vehicle that the rape suspect was recorded leaving the scene in. The officer stopped that specific vehicle and the person driving it matched the suspect’s description.

In the other thread, he started off accessing Georgia of being a very racist state but never stated or claimed anywhere that he was racially abused by anyone or treated differently or unfair because he was black.

So why play the Georgia is a racist state card if you never suffered racial abuse?

Just to draw public sympathy which all this is all about.

Mr. Bah's only route of escape isn't to overturn the guilty verdict or even reduce the sentence.

No, in his mind his route of escape is if he was set back to Nigeria which he in fact requested for during the trials.

That's the whole point of all these.

He hopes to draw enough public sympathy, create some sort of media circus and see if he's request to be sent to Nigeria can be considered.

He knows he isn't overturning the verdict else he would have uploaded the full full court transcripts for the whole world to see the injustice he claims was melted against him.

I mean he has nothing else to lose right?

But no, he posted only those he felt would back up his story and mislead the public.

The Nigerian embassy in US were involved in his trial at the early stages but withdrew completely at the a latter stage.

My guess was that evidence was overwhelming and they didn't want to soil their reputation or thrown away their conscience.

Most people here have already concluded that Mr. Bah is innocent based solely on only the so called evidence he posted.

Sadly same people have never asked for the evidence presented against him by the persecutor.

If Osama bin laden was captured alive and pleaded not guilty when charged to court in the US, you wouldn't simply believe him just cause he claims he is innocent would you?

Fact is thousands of criminals plead not guilty and fight the charges against them with the hope that they could find a loophole and win in court.

A not guilty plea is not a prove of innocence. You need to back it up with sufficient pieces of evidence to convince the court and in this case Mr bah had 3 years to gather those pieces of evidence, collaborated with an attorney and prepare his case which he did.

But unfortunately he failed to convince a 12 man jury of his innocence.

So before one can say the jury made a mistake or not, one has to see all the pieces of evidence that was presented in court especially the ones that were used to nail Mr. Bah to the crime not just the 4 cropped out documents he posted.

That is very important, cause some people are stating how judges make mistake and the US legal system isn't perfect.

But to accurately determine if the court made a mistake you would yo review all the pieces of evidence presented to it.

Yes mistakes do happen but I strongly belive that's the not case here.

Mr. Bah has already established a record of lies even on this thread when he stated he spent $150,000 on legal fees which has been debunked by 2 persons based in Georgia that he spent $0 on legal fees which he didn't deny or challenge them.

So why lie?

I guess just to draw public sympathy and ride on the emotions of soft-hearted individuals.

If he lied about 1 thing, he could have as well lied about everything else.

Judges are not perfect but they aren't stupid.

No judge anywhere on earth even here in Nigeria would convict you in a case like this where dna tests where carried out and the results were in your favour.

And unlike his claims, the dns results were neither in his favour nor inconclusive.

Mr. Bah never challenged the dna results but rather challenged the process that was used and asked the court not to administer the results of the test as evidence.

Why would someone not want evidence that could prove his innocence not administered in court?

CCTV footage shows Mr. Bah chasing the girl and Mr. Bah or anyone else hasn't come out to explain this even though its been days I have asked.

From one of the documents Mr. Bah posted himself, it clearly stated the attacker kissed the victim.

This clearly implied the girl saw the face of her attacker and therefore must have been asked to identify him during investigations.

Mr. Bah's only prove of innocence is that she wasn't allowed to identify him in court.

We all know minors are protected in cases like this.

Who would allow his 13 year old raped and sodomized daughter go through the emotional trauma of a court trail?

And I believe this are just a fraction of all that was presented in court.

Remember the jury made its decision in less than 1 hour which clearly shows that there wasn't much to think about and the case was pretty straightforward.

If just 1 member of the jury had thought that Mr. Bah was innocent, then that would have been another conversation but all 12 returned a guilty verdict.

Mr. Bah was arrested sometime in 2017 and sentenced in 2019 and he is just doing this now and here on nairaland?

Why?

Probably because all those who could have legitimately helped him turned away after reviewing the case and all the pieces of evidence against him.

Yea, the sentence was harsh but his total lack of remorse even till this point is frightening.

He comes off to me as someone who's done shit in the past and gotten away with it and expects the same to follow here.

May be you should read about Gov.of Kano Ganduje. We all saw videos of him taking bribe from a contractor. The governor is still claiming he's not the one and that he's innocent. That should tell you how some people will claim to be innocent regardless of the overwhelming evidence showing them culpable.

Even the other evidence, the statement of the police officer who watched the footage of the guy in shorts, only a portion of the full statements was posted.

The question shouldn't be on whether the guy was wearing shorts or not but his identity.

The document posted here only said the officer saw a guy wearing shorts and then Mr bah posted another image of him wearing pants and asked if he could be at 2 places at the same time.

Whereas the main question should be was the officer able to identify the man in shorts.

COs from the facts of the case, the attacker had access to the building and could have easily changed before or after the attack.

Most people even shorts underneath their trousers.

So the question remains was the officer able to identify the man in shorts in the footage?

And if couldn't (maybe a face was not captured)

Did the man bear the same physical attributes as Mr. bah? (the same height, weight, hair style, skin tone etc).

These are the critical and logical questions that should be discussed here to prove anything cos they will be definitely be discussed in court when the appeal comes up.

LOL don’t you just love the way you’ve been repeatedly ordered to provide evidence, work the case, etc as if you owe him something.

As was embarrassingly evident tens of pages ago, logical reasoning and reading/comprehension skills are not the forte of many of the posters here. They just “know” he’s innocent and a victim of racial bias because the US justice system only condemns black people.

Their “client “ has done and continues to do all the no-nos, part of which led to the maximum sentence. Heck, somebody on Nairaland probably told him worst case scenario would be his deportation to Nigeria and not to worry, go ahead and school judge, jury and prosecution that they are no match for his superior, inexperienced, unlicensed, imperfect litigation skills. The same people that have refused to do even the most basic of legwork to help him. Transcripts are a matter of public records and can be obtained with or without a fee so I don’t know why it’s been a week yet none of them has produced the transcripts or asked him to post everything when he has them. As far as I know, they are public record and I would order them myself but frankly, I have no interest in using my time that way. Especially as the rapist-apologist-in-chief, Temblor1 has captured my interest.

If I read correctly, the convict is planning to appeal. PSA to supporters: All it would take is pissing someone off enough to call his correctional facility (not that hard to find contact details) and forward his posts to show this online activity. Unless correctional facilities now allow inmates to do this kind of thing (I strongly doubt that) his activity here could further complicate his already wobbly appeal. He’s obviously not thinking about that because he’s desperate, reason why he would come to Nairaland to “prove “ his innocence to people who can do nothing for him other than make wild statements on the internet.

His uncommon sentence is as a result of his uncommon conduct in the presence of the courts. It’s not everyday a judge rewards you with the maximum sentence, especially in non murder proceedings. His sentence is a testimony (pun intended) to his actions and utterances. If you want to help him, start with demanding the convict provide ALL pages of the transcript. He was not tried by a secret court and this is not Naija where there are no transcripts or they go missing.

Most Nigerians do not read or have very low comprehension abilities.

From one of the documents he posted, it stated that the victim was kissed by the attacker which implies the girl got a good look at her attacker.

That was why I asked if the girl positively identified Mr. bah as the attacker at any time which only 1stGenAmerican affirmed she did before police officials and a guardian.

Which neither Mr. bah nor chatinet or anyone else has come out confirm or refute.

Mr. bah's earlier "proof of innocence" was that she wasn't allowed to identify him in court which was very misleading as the girl wasn't involved in the case. Her identity was completely hidden not given her name was mentioned in the documents I have accessed online.

Plus other questions I asked which anyone should have asked even before drawing any conclusions have been left unanswered.

Finally! I’ve been waiting on pins and needles for someone to come along and examine the documents and realize that key information was being purposely omitted. And I think we know why an important factor such as the DNA from the mouth swab was basically cropped from the photo.
The questions posed above are basic questions that should’ve been posed pages and pages ago by those actively claiming that Bah is innocent. This lets us know that the majority proclaiming that he is innocent did not examine any of the documents provided. How can people proclaim his innocence without even asking him why he refuses to post the entire document OR critically thinking about the information that is actually visible?


It is good that the number of us recognizing Bah’s lack of integrity and habit of withholding information is increasing.

An important question to ponder: the most sensitive information, the victim’s identity, was released via the photo Bah provided so WHY would he post only a few inches rather than the full pages? What pieces of information could be so important to this case that Bah decided to conceal them?

"Jumping to conclusions" means blindly believing the accounts of one person and determining his innocence without hearing from the victim and other parties in the case or having access to amd reviewing all the evidence used to determine the case.

You can clearly see from the second picture in your post that the DNA recovered from the victim is approximately one octillion times more probable to come from Mr Bah than from a random person. That is 1 x 1027 match. Go figure.
The guy is asking for the full reports not just snippets of it.

Even the police office that watched the 2nd video is just a snippet of this testimony that was uploaded not the full testimony.

That's why I have asked chatinent to mail me the full documents he has

Second if a suspect has been reported for a violent crime of such magnitude, the police don't invite him to the station, they look for him wherever he is and arrest him, they don't give him possible clue rather they take him unaware.

Thirdly. Despite the conviction, sentence and condemnations he still did not lie down. A guilty personal would know that he stand no a chance to trick a formidable US jury into pronouncing his case as miscarriage of justice after judgement has been passed.
