Only an illietrate talks like this!

If you make an assertion or accusation (Army killed or abducted Kanu), you have to prove it in court otherwise, it is called false accusation.

Saying the Army invaded kanus house (which we all knwo is not even true) is NOT PROOF that the Army abducted or killed him.

Army has nothing t prove.
They were doing their normal "exercise" on the streets when the Kanu and his IPOB supporters attacked the Army.
The PROOF of this is in many recorded video of the attack

Now, show us a Video of the Army "handling, beating, abducting or killing Kanu", then you would have proved you rpoint.

Law is not about Emotions or Sentiments, it is about HARD FACTS.

You dont seem to understand the position on the ground. The videos of Soldiers next to Kanu's house are on youtube, Kanu's bullet riddled cars and house are on youtube. To prove that the military invaded his his house will not be difficult. The real issue here is that the Army still to this day denies invading Kanu's home

See your reasoning and you're calling somebody dumbass! So you think if the army killed kanu they will leave his body there and later issue issue a death certificate right? grin grin grin Chai, people dey for this nairaland o

If the army kills Shekau, they will say they did and be proud of it.

You seem to have the opinion government arrested him and kept him secretly for the motive of dousing the tension Kanu created. It sounds like a good motive but no government would contemplate that since its illegal. If Kanu was arrested and government didnt say they did, its a big fundamental right issue. So the government cannot arrest him and keep him in secret because the day he is realeased, the allegations against them will be grievous that the international community will have to sanction Nigeria.

On the other hand, for FG to avoid the 1st case scenerio, they should have killed him. This will be equally a bad choice as an illegal killing and taking away of the remains by the army will be a serious problem for the Army if discovered. This doesnt even happen in Nigeria. Army kill people, yes i agree, but they never take away dead bodies without giving records of it. It doesnt make sense for the army to go to Kanu's house with the mission to kill him using amoured tanks, APC's and machine guns.

Both arrest and killing of Kanu couldn't have happened.

What i know happened is the fact that Kanu knows very well to disappear using the army as an alibi, this will help him to;

1. Avoid arrest and returning to prison
2. Stop his treason trial that can send him to prison for life
3. Set up the government for backlash
4. Bring the international community into the matter
5. Become a martyred hero while being alive.

Kanu gains more by disappearing than the government does.

And I more shocked that people like you are plenty in this useless country. So after reading what Abaribe said your mind didn't tell you he was cashing in the confusion of Kanu's whereabouts as caused by the military. Read what he said again, but slowly and carefully you will see he has indicted the federal govt and shifting the responsibility of producing Kanu to them. The Army invaded his house, there was a shootout, people were killed and the govt consequently labelled Ipob a terrorist organisation and you still want him to produce somebody that may have been killed or in the custody of the security agencies? His responsibility of producing Nnmadi Kanu was forfeited immediately the army invaded his house and shot people indiscriminately and the federal govt labelling Ipob a terrorist organisation or do you want an ordinary senator that doesn't have any army or police to go and catch a leader of a terrorist organisation? The law is not emotional as most of you are wont to be, it works on logic.

How would an individual indict the FG? Is he a court of law?

When Abaribe signed the bail conditions, there was no place it would ever say if the army attacks his house, then he is free of his obligation to produce Kanu in court.

If the army arrested Kanu, yes he has a case. But they said they didnt, what can a court work with? Set all sureties free when the accused is missing. LOL. Keep dreaming, that will never happen.

You are the one saying trash here!

That someone was granted bail did not exclude him from arrest if he broke another law. Did the FG ask him to set up Biafra Security Service? Was he asked to mobilize members to terrorize traders? Did you expect the FG to fold its arms and watch him continue with unconstitutional acts?

Nobody cares!

I hope you are not a lawyer because it will be a big shame to our law school
to have matriculated you.

Even Abaribe's lawyer know within themselves that their application is nonsensical
because being on bail does not immune a suspect from the actions of law enforcement agents.
An armed robber on bail can be arrested for attempted murder, if he escapes while being
arrested, it is not the fault of the police, it is the suspects fault because if he had behaved
like a responsible citizen, he won't have been disturbed.

Bail is not Immunity!

Using the Army invasion as an excuse for Kanu's disappearance cannot be valid in the law court.
Kanu Was granted bail with stringent conditions which he carefully, systematically and knowingly flouted.
As if that was not enough, he still went on with his hate speeches on air and the worst was to go ahead and form a BSS (secret service' in a sovereign nation while still under bail.
There are a lot of video evidences with valid and recent dates showing Kanu inspecting guard of honor, giving charge to the secret service agents in a sovereign country.
The military of a sovereign nation had no option than to act fast in dismantling this secret service, which other nations would have done same. And to butteress the event, the federal went further and got a competent approval from the law court in proscribing IPOB and her BSS activities as terrorist organization with terrorist activities.
So the case of army invading his house and kanu not being found will not absolve Abaribe. Abaribe will forfeit his 100 million naira and must produce kanu or risk sentence

It is up to the courts to determine and assign punishment to Kanu for flouting his bail

The Nigerian Army by their action have crashed this case without even knowing it

This case will collapse

Oga when it comes to issue of urgent national security, all legal procedures are suspended to protect the integrity of the land and the lives of those living in the land.
Formation of Biafran secret Services was the height of it all, the military needs not wait for the court before taking the next line of action.
It is just like military waiting for court's decision before acting on boko haram in the year 2010/11.
Nnamdi was seen inspecting guard of honor and also seen making statement that their BSS is ready to tackle the federal government. No government will tolerate that.

Mr man, Abaribe was not a party to the original case, he is only a surety. When Justice Nyarko asked the defense counsel about his client he simply said that he didn't know of his whereabouts hence the court now asked the sureties to appear before it to explain his absence (which is the right procedure), that is why Abaribe is praying to the court to cancel his surety because he doesn't know if he is still alive or under detention. Moreover, if you read the article without bias, you will see he even asked subtly how can he produce a leader of a terrorist organisation. The army invasion of Kanu's house and the consequent shooting has given Abaribe all he needs to cancel the surety.

Its a known fact that Nigerian military instituded, lunched and carried out operation pyton dance against IPOB and the said operation was played and carried out at AFARAUKWU being the country home of the defendant and leader of IPOB.Who happened to be on bail by a fed high court,nd during the course of the operation the house of mazi N KANU was raided with video and picture evidences of bullets and dead casualties. Its important to note that after this operation by the military MR N KANU has remained incommunicado to his Lawyers and family members.I submit that NIGERIAN MILITARY are in the best position to tell the honourable court the whereabout of the defendant.Mr N KANU

Have you see where the plaintiff is responsible for disappearance of the defendant except in Nigeria? Nigeria government is a plaintiff in this case and raided the house of defendant hence the defendant's disappearance. If Nigeria is not a zoo, judge would have ordered the government to produce the defendant. If the Nigerian government did not raid the house of Kanu, he should have been in court as required by his bail agreement.
