Your comment seem to be ambiguous but if i get it well, you really do not expect a surety to be free when he signed an undertaking to produce the accused.

Abaribe needs to bring Kanu and ask the court to free him. No judge will refuse that.

If Abaribe goes, who will be held to produce Kanu? I am shocked you can even think in that direction.

How could law maker asking for the refund when he knows the implications of his actions and some lawyers who knows will still asking for refunds on his behalf. Lawyers no dey get shame by practising what contradict what they learnt. Some lawyers need to be punished along with the accuse.

Even if they produce kanu today senator abaribe has lost that his 100 million naira he put up for bail, the court will sit on the money for a longtime and use the money to yield interest,it is probably senator abaribe's children that will collect the money after numerous court cases in future

Anyone that associates with that clown of a miscreant nnamdi kanu risks dragging their names into the mud, anyway whenever the court sets it's eyes on Kanu his bail will be revoked and he will be going back to Kuje prison Abuja from wherever the Department of State Security is holding him today

Senator Abaribe, bail is non-refundable. The whole purpose of bond/bail is to ensure that the defendant (in this case, Kanu) appears in court.

As Nnamdi Kanu has refused to honor a valid court summon, those who paid bond for him have to forfeit the money to the court.

As a lawyer you are, you do not know that exigent circumstances prevails as a precedence. The invasion of his house by armed men, absolves all bail sureties from any liability. Is for Nigeria army to explain the reason of the invasion, to destroy evidence, to carry out extra judicial killing or to manipulate justice process. First year law student will thrash that ruling in a higher court easily.
Till Nigeria army present Kanu, sureties can sleep fine, the judiciary does not listen to sentiments or news.

Fake Senator forming relevance! Did he officially inform the Police or the Court about Kanu's disappearance since 11th September after soldiers invasion? He must produce Kanu or face the music

you think the sureties care about the money? they just don't want to be held liable to produce Nnamdi kanu,100 million is nothing to our crooked politicians which abaribe is among, all am saying is if you look at this issue based on law, they can't be asked to produce Nnamdi Kanu because the federal government carried out an illegal raid

I thought the principle is that you produce the person and asked to be discharged as against coming to say, you cannot find the person, therefore discharge me!

Except otherwise that the court holds that by the army invasion, the duty of the Senator to provide him in court has been barred.

Story done enter, believe you me the money is gone do you know how long the process will take for The Federal High Court to write you a refund cheque of a 100 million Naira?Abaribe's children will collect the money in future.

Keep dreaming The Federal High Court is controlled by the Federal Government, the Military is controlled by the Federal Government, how in the world do you think senator abaribe, ipob and kanu can win in a Federal High Court?or are you that stupid to think the Federal Government will rule against itself?

Oga, backyard lawyer, the lady of justice is blindfolded because sentiments and emotion have no place in a law court. As long as the army invaded his house and he has not been seen since then, it is the prosecutor job to provide Kanu now.

Your common sense needs prayers.

Anyone who signs surety for the person he cannot produce has signed away his hard earned money and reputation. It is imaterial that the Army raided his house. As long as the army didnot officially say they have arrested Kanu, no court can free his sureties. If Kanu is dead, his death certificate will free Abaribe. If Kanu is with DSS, Army, Prison, Police or any lawemforcement withing Nigeria, Abaribe can get free.

But even if Kanu speaks on radio, appears on TV, grant interviews to news media without showing up in court, Abaribe cannot get away.

Its either the FG has Kanu or have Ababribe's 100m. That was what Abaribe signed, no going back.

When my mum signed surety for our neighbour to get roofing sheets on credit from an Igbo trader even after our warning, she was compeled by the court to pay for the roof over our neighbours head. There was no going back and the court agreed with that Igbo trader.

Its no different with Abaribe's case, dont ever sign surety for what you cannot guarantee. Let this episode teach you a vital lesson.

Modified

Let me add this definition of surety

a person who assumes legal responsibility for the fulfilment of another's debt or obligation and himself becomes liable if the other defaults

In other words, Abaribe is legally reponsible for Kanu's obligation to appear in court and becomes liable after Kanu did not oblidge his court summons. His liability is forfeiture of the bail bonds, 100milly.

In fact, Enyinnaya Abaribe is a disgrace to himself, family, community he represents and the house of assembly that he is a serving senator.

Is he now saying that he does not understand the gravity of the offence he has committed by standing as a guarantor to a criminal known as Nnamdi Kanu that nature has deformed, walking like a ghost with a walking stick at his age?

Abaribe should be arrested by the authorities and MUST produce Nnamdi Kanu whether dead or alive. He signed his bail bond and should produce him. He should have known the implication of his action before signing for him. I believe that the school he went to did not pass through him as he lacks knowledge.

Abaribe should be arrested. He should be arrested anywhere he is even when he is at the national assembly premises.

I'm quite worried that Nnamdi Kanu may have been killed, or is being detained by the Nigerian government.

REASON: It's quite uncharacteristic of Nnamdi Kanu to be quiet. For the noisy braggart that he is, it's surprising that he hasn't been heard of in the media, via a video rant recording, Radio Biafra rant, or otherwise. Nnamdi Kanu is incapable of being quiet; so the only apt reason for the silence is more probably that he's now a cadaver, or he's being held against his will by the Nigerian government.

Its quite sad un-informed peeps now straddle the cyberspace and say whatever they want...however we want to see it, Sen. Abaribe stood surety for a person who has flouted his bail conditions and not attended court.
Bail entails you standing trial for whatever you are charged for, however flimsy. Saying the army should produce him or that the operation carried out caused him to flee is an anomaly and same shouldn't be condoned by the courts.
The honourable Senator should produce him or forfeit his bond. Quote me and I won't respond, non-lawyers should not come here and cast aspersions on the legal profession.
