He should try and go near his former office the Supreme Court on monday and you will see what will happen to him.

This is one of the best and drastic decision taken by this administration. My opinion is that the CJN suspended the NJC meeting today to avoid his possible suspension by the council. His presence as the Top Judicial officer in the country means that there would not be any fair dispensation of justice in any court because of his influence. He should have naturally step aside to pave way for smooth trial if at all he was clean of the allegations against himself.
This decision is therefore commendable and timely and all well meaning patriotic Nigerians should not view this a victimisation or oppression besides the CJN doesn't belong to any political party neither is he sympathetic to any party - Presumably...

Though I'm not in support of this but when Jonathan suspended Ayo Salami againt the wish of NJC, PDP and all of you celebrated it; and heaven didn't fall. GEJ sets the precedence.

The CJN holds office at the pleasure of the Nigerian constitution and can only be removed from office by death or on attainment of age 70 whichever occurs first or by impeachment by the Senate of the Federal Republic of Nigeria which requires a super majority of the members of the Nigerian Senate.

The CJN was not removed. HE WAS SUSPENDED. And the President has the constitutional right to suspend him

Immunity is a constitutional provision which says a person cannot be prosecuted while in office. The CJN does not have such protection and that is why he is bee prosecuted in the courts while in office.

The same constitution has also stipulated the ways by which a CJN can be suspended or removed from office and expressly forbids the executive to do so except on the recommendation of the NJC. This was expressly stated in the constitution. Just like with immunity of Govs there are no other interpretation.

The President, if this news is true , has commuted a grave misconduct to the constitution and this will not stand.

And yes this will certainly lead to this country try burning if true. If you think some forces will take this you are only dreaming.

By the way when did CCT give such an order. The CCT is not sitting and has even been restricted by a superior court- the Court of Appeal.

Chief Justice Walter Onnoghen,
who is challenging the jurisdiction
of the Code of Conduct Tribunal
(CCT) to try him for alleged non-
declaration of assets, had given
judgments affirming the Tribunal’s
powers.
In one of the judgments delivered
on July 12, 2013, he held that the
CCT had exclusive jurisdiction to
deal with all violations
contravening any of the
provisions of the Code of Conduct
Bureau.
He also held that the provisions
“expressly ousted the powers of
ordinary regular courts in respect
of such violations.”
Chief Justice Onnoghen’s lawyers
are arguing that the charges
against him should first be
decided by the National Judicial
Council (NJC). Can the NJC not be
considered an “ordinary regular
court” in the circumstance?
The judgment was in a suit
numbered SC.279/2012 before
Justices Onnoghen, Christopher
Mitchell, Chukwuma-Eneh,
Olabode Rhodes-Vivour, Clara
Bata Ogunbiyi and Kumai Bayang
Aka’ahs.
The case was between Ismaeel
Ahmed and Alhaji Nasiru Ahmed,
Congress for Progressive Change
(CPC), CPC Kano State Chapter
chairman and the Independent
National Electoral Commission
(INEC).
Interpreting Paragraph 12 of the
Fifth Schedule of the 1999
Constitution (as amended) as
regards CCT’s jurisdiction, Justice
Onnoghen held: “’…the said
paragraph 12 provides as follows:
‘Any allegation that a public
officer has committed a breach of
or has not complied with the
provisions of this Code shall be
made to the Code of Conduct
Bureau.’
“The foregoing provisions are
clearly unambiguous and so
construed literally mean that any
breaches of any provisions of the
said 5th schedule or matters of
noncompliance with any
provisions of the Code shall,
(meaning that it is mandatory i.e.
must) be made to the Code of
Conduct Bureau that has
established its Tribunal with the
exclusive jurisdiction to deal with
any violations of any provisions
under the Code.
“If I may emphasise, any
violations shall be made to Code
of Conduct Bureau. The provisions
have made it mandatory to take
any matters so covered by the 5th
schedule (supra) to the Code of
Conduct Bureau and not to any
ordinary regular Courts as has
been done in this instance.
“If I may repeat, the Code of
Conduct Tribunal has been
established with the exclusive
jurisdiction to deal with all
violations contravening any of the
provisions of the Code as per
paragraph 15(1). This provision
has expressly ousted the powers
of ordinary regular courts in
respect of such violations.
“The Tribunal to the exclusion of
other courts is also empowered to
impose any punishments as
specified under sub-paragraphs
(2) (a), (b) & (c) of paragraph 18
as provided in sub-paragraphs 3
and 4 of paragraph 18 while
appeals shall lie as of right from
such decisions to the Court of
Appeal.
“Simply put, to tackle any violation
of the Code starts before the Code
of Conduct Bureau Tribunal to the
Court below on appeal and on a
further appeal therefrom to this
Court.

He doesnt't except it is a recommendation of the NJC and two-third of the senate has to pass a vote for such removal.

Section 292 of the CFRN 1999. -
(1) A judicial officer shall not be removed from his office or appointment before his age of retirement except in the following circumstances:-
(a) in the case of:-
(i) Chief Justice of Nigeria, President of the Court of Appeal, Chief of Judge of the Federal High Court, Chief Judge of the High Court of the Federal Capital Territory, Abuja, Grand Kadi of the Sharia Abuja and President, Customary Court of Appeal of the Federal Capital Territory, Abuja, by the President acting on an address supported by two-thirds majority of the Senate.

The crooked judge should have resigned jejely and kept his dignity and his loot, but he thought this is going to be the same crooked moves they play with the courts and corrupt SANs.

They overplayed their hands with yesterday's court of appeals ruling, that was the last straw for PMB, the Boss of All Bosses.
