[b]Before she was sacked from office as the Managing Director of Oceanic Bank Plc by the Central Bank of Nigeria (CBN), Mrs. Cecilia Ibru was referred to as the First Lady of Banking in Nigeria and regarded as one of the most influential and powerful businesswomen in Africa. But only very few would agree that she had assets and shares worth over N400billion.

Everything changed immediately she was arraigned by Economic and Financial Crimes Commission (EFCC) in August 2009 on the allegation that she was involved in a multi-billion Naira banking scandal after her bank was found to have low cash reserves due to bad loans. She is facing charges bordering on fraudulent conversion of depositors’ funds and money laundering.



To compound her woe a Federal High Court in Lagos presided over by Justice Akinjide Ajakaiye ordered the freezing of all assets, bank accounts and shares held directly or indirectly for her benefit or on her behalf, which the EFCC has traced to and are deemed to be proceeds of economic and financial crimes. The value of the assets and bank accounts is put at over N400 billion.



While the anti-graft agency had already confiscated her choice houses and shares in various companies in Nigeria with a special team being raised to consider actions on the foreign assets, she has recruited a prominent lawyer to appeal against the court’s decision.



Barrister Taiwo Osipitan, Cecilia Ibru’s lawyer is not only a Senior Advocate of Nigeria; he is a Law Professor and one of the celebrated PDP’s lawyers in Nigeria . The legal luminary would ask the appellate court on behalf of his client to bar the anti-corruption agency from enforcing the order for the confiscation of the assets on the ground that she was not given an opportunity to be heard. He would further argue that the existing order was not secured in an open court but in a chamber which could be disregarded as illegal and unconstitutional.



Pending the hearing of the appeal, the EFCC has warned Mrs. Cecilia Ibru and her agents from giving instructions or directive for the withdrawal, transfer, disposing or diminishing the value of the assets in the form of money kept in all bank accounts in Nigeria and worldwide or giving instructions or directions for the sale, transfer or disposal of the assets comprising shares, stocks and other forms of securities held or kept by any custodian, depository, stockbroker, registrar, company secretary, nominee, trustee or director in Nigeria or anywhere in the world.
