The are not naive...if same judgement went the other way round u and ur gullible pdp will insult the judiciary ....there is no morality in politics ....that's why people support their parties irrespective of whether they are wrong or right . Pdp has visited several embassy with protest about imo election ....it was same supreme court that delivered that judgement

Wole (father of technicalities) and Ikpeazu would have won this case against Ustadz Usman or at least get something better than this, though they are likely to lose at the trial and lower courts because of our electoral act.

In SC everything is possible because they have the power to set and set aside precedents. All you have to do argue intelligently and use technicalities. While Onnoghen Supreme Court relies mostly on the merit of the matter and natural justice to arrive at their judgement, Tanko's Supreme court is just unpredictable.

They don't know when to use technicalities, precedents and equity.

I have never seen a court so useless.

Anyway, Bayelsa judgement is apt and their finest in recent times.

It's not like the case is extremely solid.

The judgment is based on the discretion of the judge but she chose to resolve the case again the defendant.

Forgery is a serious criminal case that needs to be proved beyond reasonable doubt.
how did he get admitted with a waec certificate bearing different name to the name he will be using in school without a change of name affidavit? why was those affidavit dated 2018?

this man bought those certificates from different people. when he began smelling trouble, he rushed to get a sworn affidavit in 2018

The problem we have in this country is that we have people in positions of power who are not intelligent. The requirement for office is a minimum school leaving certificate. He didnt have to tender all these certificates, all he had to do was tender one that complied with the minimum requirement and beared his proper name...end of story.

This is what Ogun state governor did, he knew he didnt have NYSC so he didnt tender his degree and just tendered his WASC. In this case all Degi had to do was tender his degree which bears the name he wants to use and forget the WASC. WASC is not required if you have a higher qualification.

There is nothing in the constitution that says you have to tender all your certificates. You have the choice of which certificate to tender as your qualification to contest, so long as what you tender meets the requirement.

You can only be judged on what you tender!!! Note the judgement did not say he did not meet the requirement to contest, it said he presented forged documents.

Stupidity of the highest order and IMHO shows the calibre of leadership he would have brought to Bayelsa state!!!

Long and short......He will go down in history as a man who forged/presented a document that was never required and thereby disqualified himself.

Stare decisis is Latin for “to stand by things decided.” In short, it is the doctrine of precedent. Courts cite to stare decisis when an issue has been previously brought to the court and a ruling already issued.


In Nigeria, things are always decided upside down, there's no standard, no defined judicial rulings and authority.

How do you explain the disparities between your decision and judgement yesterday and the one you rendered today as if you've never rendered any judgement based on the same court cases and findings.

This is why the Nigerian judiciary is a joke, also why their rulings are always questioned and ridiculed.

For all those who have poured all manner of invectives on a Senior Jurist, Justice Mary Ukaego Peter-Odili (JSC) CFR, and maligned the integrity of learned Jurists that chaired the panel on the ill-fated Lyon/Degi Mandate.

Ecclesiastes 10: 10 said something important “If the iron be blunt, and he does not whet the edge, then must he put to more strength: but wisdom is profitable to direct”..

Unbiased lawyers in the house can help us digest.



A lesson for all those bearing different names to consult widely before regularisation of their names, if you know at one time or the other you are using someone else's certificate be ready to face the music or drop that qualification.
