The last time I checked, Nigeria is still a common law country and the system of laissez-faire still applies as per how individuals chooses whom and how to contract. omonnakoda: Good that you want to learn. In a nutshell, the Common Law legal system has its origins in the UK. It dates back to when King Henry II initiated the idea of a similar and unified legal system throughout his kingdom. Hence, the birth of the phrase "Common law". Omonakooda, the system of "Common Law" is rooted in the doctrine of precedent, stare decisis and hierarchy. This means that the lower and inferior courts have to abide with the ruling of the superior courts. Excluding obiter dictum; obiter is a side statement. Nigeria and Engish cases are still cited in court rooms in both countries. Thus, Nigeria's legal system is chiefly grounded in this system in addition to Sharia and Customary laws. Coming back to the discussion, contracts are integral part of the Common Law system. And the principles of the law of contract still applies to individuals who chooses to enter into a contractual relationship. |

What has common law got to do with what we were discussing? In Nigeria Native law over land holding is the supreme title where proven. It cannot be revoked and land held under Native law can only be acquired in the public interest. |

Come on, I urge all Igbos and every other person buying land to: I) negotiate with the proper title holder/holders. 2) bargain which ever way you deem suitable. If agreed by the other party, draw the contract. If you offer more money for a freehold, and the other party agrees. Go for it! If the other party insists on a reversionary lease, accept it but don't agree to a "surrender" clause to your building/buildings. It is an abstract legal concept What is its statutory or constitutional underpinning in Nigeria If you "buy" land held under native law. You are merely leasing it from those who hold it in Trust for their bloodline They cannot sell what they don't own.They are merely caretakers of the land no matter what the conveyance deed says. You are just another caretaker for their descendants, omoonile or autochthons. If you convert your title to a Cof O you become a tenant of the state government for 99 years. omonnakoda: No. The Common Law underpins the main body of the Nigerian legal system, viz, the criminal law, law of evidence, tort law, commercial law, public law etc. These laws operate within the principles of the Common Law. Your favourite, the Customary law, is an indigenous system by its provisions, but however operates within the frame work of the main legal system of the country which is the CL. For example, the Nigerian constitution did not create any other superior court to entertain a highly disputed land case other than the usual High courts, Appeal courts and the Supreme court. Again, native law does not forbid the concept of freehold just as it does not forbid leasehold. Regardless of the Land Use Act 1978, show me anywhere such is forbidden in the statute books? I repeat, any land-owning family or their heirs has the legal right to do what pleases them with their land. If I have Shola as a friend and he wishes to settle in my village in Anambra and wants a land.And he requests that the land be made freehold. And the family agrees, there is no law that forbids my family not to honour his request in a contract. And once done, it is permanently his land, especially when a consideration is involved.
