In Minnesota, if convicted of 3rd degree murder, you would only serve a maximum of 25 years in prison. Minnesota is one of 3 states that was a Murder 3 charge, and is the most lenient in terms of sentencing.

Murder 3 is called "depraved heart" murder. This means a person shows indifference to life, and knows their actions run the risk of potentially harming others, but you do not have to prove that Malice was a factor.

They chose this, because it will be easiest to prove a "depraved heart" murder, than a murder done with Malice.
