It should also depend on the other facts of the case. A drunk man going after a random woman to rape her will not be absolved because he’s drunk. And vice versa.

But if it’s case of two lovers or two friends that are linked romantically prior to the encounter , they both got drunk and had sex, then I wouldn’t be quick to call it rape.
