And the woman cannot be sued for attempted murder, assault and and battery and emotional distress (by a guardian ad litem to the small defenceless and below age girl)...

Action can be brought against her and sustained both in criminal and civil courts. Meanwhile, a judge will look at the slap from the lens of action taken at the spur of the moment. Do not think judges are not humans. All they need do is attach the girl's picture as an exhibit in the process they are filing in defence and also lead evidence in support. Anyways, what do I know
