Would the loan company have sent messages if they had it defaulted for some time.

I have defaulted twice in loans from Branch. Both times we cane to an understanding and the loan was paid off with 3 days of the deadline

Let people take loans when they know they have the means to pay them back ready. It is that simple. If someone did not pay you back on time would you keep quiet and allow him or her to continue? Or won't you make noise?
If you weren't given the opportunity to explain why you were unable to meet up with repayment, wouldn't you have been tagged a criminal just as the person you are running down

I think before one access their loan he/she might have seen their terms and conditions which is defamation, but the oni gbese will ignore to read it because he/she is desperate to access the loan.

I understand that they have Ts and Cs. But imagine I have a business number stored on my phone for an enquiry I want to make from that business. The business doesn't know me and they get an SMS that some unknown person is blah blah blah...now imagine if several people have that same business number. Soko Loan and the likes will bombard that number with SMS messages of no value to them

Nitda is wrong on this, Soko takes loan from people(investors) and banks in millions with heavy collateral, they break it down and give people without collateral, they gave the terms of the loan, you accept, they credit you, once you fail to honor the agreement, they have the right to enforce what you agreed in the terms. If you contact your account officer at soko loan before time, they will restructure the loan and give you more time, however if you fail to contact, acknowledge the reminders then they go ahead to your contacts. Its not their fault, they have loans and obligations to meet as well. Its not their fault that you are unfortunate not to honor what you agreed, if you had refused any of the terms during registration process, you will not get the loan, you checked agreed on all the box and still defaulted and don't want anyone to know you are owing, its just like someone defrauding a bank, when u are caught you now say nobody should know because they were not there when you defrauded them, my guy u n huspuppy have things in common.

Oga or.madam... please dont tell us a debtor is a fraudster or thief . Dont equate them they are not the same. Its a loan and its carries some amount of risk.
It very stupid and unprofessional for you to call a debtor a fraudster and start sending messages to his or her contact. Do you know that bank loans are also defaulted but have you even seen on newspaper , tv or internet that mr A is owing a bank and as such he is now a thief.
Before you give out loans you much insure them because people will always defualt. Its a constant. Unforseen circumstances will happen, the loanee can even die.

Some idiots here are defending and excusing sokoloan. You are talking of T&C. Nowhere is it stated that they will message your contacts and tag you a criminal. Nobody or institution has the right to call someone a criminal. It is only the law court. To message a defaulter's contacts and call him a criminal on the run is a big low. As I said before, it is only a fool that will still go ahead and pay after such message have been sent.

How are we stealing people's contact?
But the customers read the terms and conditions before applying for loans.

Nigerians are always used to getting things free, they still want to ransack this one. Pls could we get our money back if we don't follow this due process.

Is it written in their terms and conditions that they have the Right to share customer personal data or directly invade customer privacy by Sharing info to their contacts?

Agreeing to terms doesn't mean they can invade your privacy and get away with it.
That's why big tech firms like Facebook can be sued for privacy invasion despite agreeing to terms and conditions

All the people shouting credit bureau loan recovery process etc when you where granting them access to contact your contacts, did you tell them to also contact credit bureau if you default

I saw a guy owing paylater #100,000 over 1yr. Same guy owing another app #20,000 over 3 months +.

You forget that on the other end of the loan, a young guy hustling to feed himself and family is your account officer, his job is under threat because of whatever reason you have for not paying, sometimes they deducts their salary for your negligence, sometimes they get fired, later you say that company hire and fire, its cos of defaulters.

Do you know you can actually add your card and send payment on paypal but can't receive payment?. If they don't trust you enough to receive payments then why would they allow you to send?

That some Nigerians are actually making a case for these useless loan shark shows how insensitive some people are. If not for Buhari that has made everything so hard, why would anyone even consider taking their short term, high interest loan? And while you will still have to pay default fees, your integrity is forever dented by blackmailing your contacts.
I believe Ncash should also be fined and some other ones in these category. Everyone that has ever been embarrassed need to make it a point of duty to report the particular loan apps to NITDA.
After all, not all of us are politicians who has some unrestricted wads of cash to throw around and yo think that you didn't even steal but chose to borrow...

Defaulting is no longer a crime, meaning I can borrow someone's life savings, sign contracts/agreements spend lavishly on beer and women travel round the world like hush, then comeback to a retiree and tell him I can't pay hope he insured... I swear u are mad.

Banks will take over your biz, properties and anything they can lay their hands on after disgracing your future.

Banks will not give you loan if you can't meet up, this soko loan took the loan from banks with all they had so you can get it without the hassle, only for you to buy your babe we a another guy de gbansh cream, then turn to soko say hope una insure the loan, my guy u are raving mad.

I am not supporting those who borrow with the intention of not paying

Those who borrow and purposely refuse to pay should also stop that

But when you batter someone's image because of a loan of #3000, when they later pay what happens to the image you have destroyed?

What steps do you take to remedy that?

There should be a better humane way of retrieving your funds too knowing that some people may default for genuine reasons.

The more reason you should honor your agreement and don't default, once you default you are no longer at vantage point to say what they should do or not do. I have only one question.
Does the contacts (I call them guarantors) on one's phone have any say in the loan process before it is disbursed, that is, do they have the right to say "that guy is a criminal, he won't pay back so don't give him loan. If you do, don't call me when he defaults"

Ask yourself why you gave than access to your contact, when they requested for it.

Becauae sadly , and I am.not saying that everyone does It, some customers are those kind of people. People who take loans without having any intentionof paying them back

Here on Nairaland we have seen guys and girls proudly boast of their strategies to beat payday loan apps. Including installing app on a phone with zero contacts.
You are not making sense. This nonsense can only happen in Nigeria where you, the loan company, will blatantly blackmail and disgrace your defaulter instead of using a legally acceptable and civilized option. Why send me an unsolicited text message concerning your defaulter when I was never aware of your business transaction? In a civilized country you guys would have faced serious litigations, and perhaps, would have gone bankrupt for this unethical business practice.

Best for them to do a collateral enabled loan option.

You default, you pay 1% daily for 2 weeks, after 14 days, your collateral is sold, they remove what you owe them and return the rest.

Simple.

if you think what they're doing is the right thing, then why didn't they win the case, the truth is there is government policy guiding every business sector in every country so ths loan companies cannot just formulate their terms N conditions without considering the guide lines given to them by the government.

The companies knows that what ever rules they give some must collect loan in Nigeria
Another reason is they know that there in little or no checks on business in nigeria, policies are made with little or no compliance.

The case has not gone to court, NITDA only slammed them with a fine, if soko goes to court, it will win, because the first person to default or renege on agreement is the customer, if the customer had not defaulted, we will not be here. So everything after the default is inexcusable.

While you have a point, its the defaulter that deposited your number, and people put other peoples number in cases of emergencies, such that call or contact this person if need be, or can someone go to hospital and ask why he was called because the injured person gave his contact, if you can't help, you go but if you can help them recover you help., they did not manufacture your number from somewhere, someone that knows you dropped your number...

People should clearly understand that the business climate of this country is awry and hostile to small business owners. Can any banks gives you a loan of ordinary N1000 without a collateral, so we should give this loan shark company a brake to use all resources available to them to claim their money back when their client defaulted in payment. Their ability to give ,evil loan, to dick and array is their only weapon of credibility and fame. Hence nobody should run them down by defaulting regardless of someone's circumstances of hard life. If problems surfaces that you can't meet your payment schedule, the right thing to do is to call the evil loan shark for possibility of loan rescheduling to avoid unnecessary embarrassment. They are evil but are doing magnificent jobs in providing financial cover or defence for those who need helps, emergency help at a critical time and save you embarrassment of going to your contact to explain the need why your friends and family should borrow you urgent 10k to solve personal issues.
