An estate is a not private property Mr sabinus and secondly, even if it's a private property provided there is reasonable grounds of suspicion that a crime is been committed,d police can still come in....The powers of d police are very enormous if u don't know...Go get d police act and see for ursef

If the estate isn't a private property, what is it? What was the crime committed that warranted the arrest of the security men and the resident and her children? Does the police act cover these arrests?

If he is actually there on a private capacity (owambe things) and not for a strategic security meeting like the police statement claimed, then he was wrong because he is not above the law. You cannot visit some estates without a confirmation message or even a call from the resident you are visiting by the security guys.

It is either the estate security guys were overzealous I'm the discharge of their duties, or the CP was just power drunk because I still can't place exactly why those guys were arrested, I mean, what would be their offense if they were to be charged to court

People get overly emotional and even hypocritical over this issue because a police officer is involved.

1. The Commissioner of Police Odumosu didn't need to give advance information of his coming to the Estate security men because it would be stupid to for him state his movement. Of course, giving such information would require the CP's security details to secure the Estate gate security until he arrives.

2. On arrival at the Estate gate and having PROPERLY identified himself as CP of Lagos State, he ought to have been allowed in immediately. Keeping him at the gate is unnecessarily exposing him to possible attack by criminals. Even a military formation would know better than keep a properly identified CP exposed to danger at its entry point.

3. CP Odumosu didn't need to tell the Estate security men the exact house he was going to before being allowed in. That's a classified information until his details secures the house for his safety.

4. Deliberately tagging the CP's visit as social to denigrate him is pure IGNORANCE because even a 'common' DPO is always listening to his radio equipment and giving directives anywhere he is. The fact is that when not on official leave, a CP is at work everywhere and every time.

5. I doubt if the police singled out that widow for arrest for nothing. She may have jumped into the matter and said unsavoury things. Being a resident in an Estate, I am familiar with some 'radical' busybody residents that would jump into issues without complete knowledge.

6. The truth is this incident was avoidable if only the Estate security was more professional and less power-conscious. Their unprofessional attitude activated power-tussle mode in the OFFICIAL state police force to show their constitutional superiority. The irony in this drama is that when armed criminals show up at the Estate, it is the official state police men that are called in to risk their lives.

7. By the way, is an estate which has individually-owned houses a private property or a community? If Magodo Brooks is NOT owned and rented out by one person as its private owner, is there any difference between this Estate and for example Ajegunle in the eyes of the law?

8. Yes, Nigeria police has many outright criminals as members but it is still the only one we have to enforce law and order and maintain security.

I like the fact that you try to be objective but still your points are very biased and obviously trying to justify the police.

Firstly, you should know that hotel and estate security don't joke with unauthorized entry. They get sacked and can enter jail due to a resulting crime. Hotel security once prevented DSS from arresting Suleiman till Fayose came to intervene. That is stupid bravery though considering the power these agencies have officially and unofficially.

Secondly estate is shared private property not public ground as the police is claiming. Any policeman without a warrant as well as military officer not on official assignment has no right to enter anyone's private property without informing the owners. That's why the estate is making it clear that he came for a social function.

Lastly I know the estate too is lying by saying that they were assisting him. That's a big lie because that wouldn't lead to any arrest. The security men were likely preventing him because he did not disclose his intentions to them. But legally they're right.

So whether you look at it emotionally or objectively. The Policeman is very wrong here. Estate is private property not public space
How can an estate which road is manage and control by local govt be a private property?

Only houses inside the estate are private property, not the estate. Nobody buy a house with any road.

You like defending injustice. angry

At this point, the executives, members of the estate security committee, the estate CSO and some residents had converged at the estate gate to plead with the commissioner on his way out with the hope that his anger would have subsided after enjoying the party.
To our amazement, the commissioner came down from the car on his way out, said he was insulted by our estate and further instructed that the remaining security operatives who replaced the arrested ones should also be arrested.

“This resulted in complete shutdown of the estate as no one could go in or come out as our estate gate is automated and the operatives with the access token were all arrested with the token. This further resulted in the traffic jam that occurred on CMD Road for over 4hrs.

“Pleas from different angles were made to the Commissioner with no yield until about 11 pm when he finally gave in. The estate was finally able to bail the security operatives who were already put in cell, the resident with her children who were put behind the counter at about 11:30pm.”
Did you ask what the widow said that warrant her arrest, sometimes we Nigerians are the reason police are brutal.

There are no Estate rules and regulations that supersede Nigeria constitution, private securities are not knowing to law only NPF, Nigeria civil defense, Nigeria correctional officers, Immigration Officers etc are to maintain laws and orders.

https://www.nairaland.com/6921305/lagos-police-confirm-arrest-magodo

"the 1999 Constitution of the Federal Republic of Nigeria provides for freedom of movement. The police in particular are statutorily permitted to enter any public place at any time. The Brooks Estate is a public place and the roads leading into it are highways and as such, no one has the power to prevent police officers in uniform from entering the Estate or any such public places.

The internal security arrangements of the estates and other public places nonetheless, the statutory powers of the police to have unfettered access to public places must be acknowledged and respected.

Therefore, managements or authorities of estates in the state are advised to constantly brief their private security guards in this regard. Any restriction deliberately put in the way of the police in any of the estates will not be tolerated. Offenders will be dealt with according to the law, just as the police will not condone any form of embarrassment and recklessness."

Only stupid people will believe what the estate management just said. The security guards where trying to assist him and he just turned around to arrest them. Does that make any sense.
If actually they were trying to assist him to locate the place, that means he asked for the direction because it make sense to say it wasn't everyone that drove into that estate that day that they direct to where they were going. in that case, does make sense to say the CP ask for direction and while they were helping him with that, he ordered his boys to arrest them?
My thought is this, the estate security didn't know the CP, and the estate security had watched the prank that Zfancy pulled on some estate security men in Lagos sometimes around May, 2020. On seeing the CP, they probably tried to dig deep to be sure they were not being pranked and this angered the CP thereby leading to the whole drama that followed.
So it is better to say that the security men were trying to be sure they were doing the right thing with the right person by allowing him access than this organized pieces of rubbish they put up there.
