A very close friend just got an apartment and moved in late December, the house was gotten through the sister (to the owner) who monitored the construction of the house. The house hasn't been registered with the electricity company and water isn't running as at the time he paid (190k + 40k (commission &agreement)) the water.

On Saturday, he said the owner came and the wife attended to them outside as they were discussing some other things about the house while he was praying inside. Before she left she even played with his children and gave them #200 also took their picture.

Fast forward to Monday, he got a call from the husband to the sister saying all sought of abusive words to him claiming the owner of the house wasn't attended to properly, they were supposed to let her in even without the consent of the husband since she's the owner of the house, therefore they should move out at month end. The wife called the owner of the house and she said the same thing then the another of their brother called again saying the same thing. They claimed that their remaining change will be refunded.

The question now is, should he stand on collecting all of the money or the balance as they said?

Or details have been concealed cos the OP's "friend" knows he was at fault. Thats if truly Op is not the friend.lol

Cos I was assuming they had made progress with the house condition and wanted to increase the rent.
But as this case is theres no progress.

I actually don't get the fear for landlords by tenants that people usually talk about a lot. I almost locked up my landlord's wife this year over mere insults. She jumped into a conversation she did not understand and started cursing me. I almost locked her up and warned her sternly because she doesn't know who I am or what I work as. People carry unnecessary fear of their landlord around. Na house you rent and pay for. You're not being done a favour. They would want to intimidate you to hold your landlord in high regard and fear him and his wife join. God forbid!

Go to the police station, there is a section called HUMAN RIGHTS. If they want you to pack out, they must pay back in full. If you are resident in Lagos, then you will get swift action from the law enforcement agents. You obligation with your landlord is to pay your rent when due and take proper care of the property. You are not suppose to worship them or turn to their slave.

I suspect the owner of the house and the tenant don't come from the same tribe. Let them refund the 40k and balance you paid. Your life is important; use the money and look for a house elsewhere.

Nigerians are fetish people. You were probably raised in a Christian home, you don't know where the next person was raised. In some parts of the country, you just need #100 to get a charm that will take the life of the next person.

A landlord used fetish means to kill a friend last month. The man asked her to leave her shop, she refused. The man increased the rent, she paid it. The man refunded her money and insisted she would leave. When the drama was on, the babe developed a strange ailment.

She went for series of tests and nothing was found. Days later, the lady died. She has finally let the shop. This life is mysterious and people are wicked. OP, don't let this be the story of your friend.

How is this a problem?,
If they insists on refunding him,he should be the one to determine the amount (his money have appreciated by now).
They're just bluffing, you don't give quit notice on phone.

You won’t understand it because it isn’t supposed to be understood. Landlords and landladies do come up with ridiculous accusations to get rid of flawless tenants. The real reason they’d want such tenants out is usually spiritual. But you know they won’t voice it out because eyebrows would be raised.

I have been there. Dude should just collect his change and move out. I will never stay in another person’s property against their will. There are repercussions.

Go to court. They'll refund in full and still give time before he can move out. And pls try and improve On ur writin OMG

Is the notice verbal or written?
If verbal, you can ignore if you have strength to entertain the continuous yelling everytime you meet.
If written, was the notice adequate, that is, according to your agreement or tenancy law in the state you are in?
If the notice is adequate, you are entitled to a refund if your contract would have existed beyond the notice, ie, paid a yr, 3months used, gave you 6months notice, you are entitled to a refund of 3months since you still have the 3months left on your contract.
If you can get a place immediately and not ready to wait out the notice period, you can request for a refund that covers for the period.
Kindly note that no law supports the idea of you getting free rent nor the landlord collecting rent without allowing to utilize it.
All contract can be terminated at any point in time a party is not willing to continue with it, however flimsy the excuse might be, you only have to fullfil the condition both agreed to on the termination of such contract
A contract cannot just be terminated without any form of compensation unless it is stipulated in the said contract.
You can sue for a breach of contract. The only way your landlord can move you out is if you go against any of the agreed terms and conditions on the tenancy agreement.

Nothing is cooked up here. Though he didn't collect any receipt or document because they are both of the same religion so the trust.

Should you agree to move, demand for the cost of transporting your goods to another location etc. A rich Landlord will easily refund your cash and additional costs if they truly need to live there.

To be honest, if you go to court, you will live rent free for a long time. Just get a good lawyer.

Tell him to collect half payment, after he has collected the balance, then take legal step.
You are entitled to stay for another 6months
Making 9months
Even if he gives yiu full payment still stand on taking legal steps and get free 6months

You are very ignorant of the law. No Court will order to live freely in another person's house with paying rent. For the fact that you are on Court over quit notice doesn't prevent the Landlord's right to collect on his property.
