A very close friend just got an apartment and moved in late December, the house was gotten through the sister (to the owner) who monitored the construction of the house. The house hasn't been registered with the electricity company and water isn't running as at the time he paid (190k + 40k (commission &agreement)) the water.

On Saturday, he said the owner came and the wife attended to them outside as they were discussing some other things about the house while he was praying inside. Before she left she even played with his children and gave them #200 also took their picture.

Fast forward to Monday, he got a call from the husband to the sister saying all sought of abusive words to him claiming the owner of the house wasn't attended to properly, they were supposed to let her in even without the consent of the husband since she's the owner of the house, therefore they should move out at month end. The wife called the owner of the house and she said the same thing then the another of their brother called again saying the same thing. They claimed that their remaining change will be refunded.

The question now is, should he stand on collecting all of the money or the balance as they said?

Firstly, which state ? Secondly don’t accuse me of been fetish but the case is spiritual. You are lucky the fought you instantly.. have rented a house that the landlord will be nice to you will even borrow you money to pay house rent or children school fees but your 5g is turning SOS

If the tenant had the above listed boxes checked, then he could've easily called their bluff, demand for at least 6 months quit notice before which they can legally eject him out of the premises.

As it stands let him collect his change and move out of the house..... He can take with him whatever improvement he must have done to the house like wallpaper, kitchen zinc, WC etc.


which change, they should refund him to the last Kobe he paid, he did not broke any agreement either written or oral,

they are the ones breaking their agreement with him, from the sum paid, it's for a year, just 3 months they are ejecting him on senseless ground,

he should get a good lawyer, sue them, and even ask for both 6months, and his full refund, including money spend on any amendable done on the house, or else it's two years before he move out

I actually don't get the fear for landlords by tenants that people usually talk about a lot. I almost locked up my landlord's wife this year over mere insults. She jumped into a conversation she did not understand and started cursing me. I almost locked her up and warned her sternly because she doesn't know who I am or what I work as. People carry unnecessary fear of their landlord around. Na house you rent and pay for. You're not being done a favour. They would want to intimidate you to hold your landlord in high regard and fear him and his wife join. God forbid!
why nearly You should have locked her up ad thrown away the keys. Just as she could have locked you up also.

How can you even say that you became a tenant and your landlord does not know what you do or where you work? this your story ehhhh

1. You've paid your rent and are entitled to quiet enjoyment. Allowing the landlord to show up whenever he likes to enter your apartment and stretch leg in your parlour while your tenancy is still running is not one of your obligations under a tenancy agreement. The landlord can only ask to come to the house to see if any repairs need to be done if he had given reasonable notice beforehand.

2. No landlord is entitled under law to kick you out of his property summarily, without giving you adequate notice. It is six months in the case of a yearly tenancy, and one month in the case of a monthly tenancy. Even then you are entitled to stay till the period of your rent expires. If he feels that you have breached the terms of your tenancy, then he should go to court. Someone cannot collect rent money from you and still be acting as if you are a guest in his house or that he is doing you a favour by letting you stay in his house. Their willingness to refund you is neither here nor there. The decision to ask a refund and leave the property is yours to make, nobody can force you to take it.

3. Ask an affordable lawyer to write a letter to the landlord formally so that he does not feel that you are a helpless person, or go to the Office of the Public Defender to help you. They can provide you with free legal services if you don't money. Go to the National Stadium Bus Stop in Surulere and ask anyone where it is. It is around there on a street called Iyun Road.

4. Start looking for another place to move to after your rent expires because the landlord is obviously sick in the head.

Many years ago, I had the same issue with my Landlady. She refunded every damn cent that I gave to her. So, I will advise you to stand your ground. As long as you have that tenancy agreement, stay there! Demand even the cash paid to the agent. If an agent got you the house, the information should come through them. Stop calling A and B.

In most cases, the court will ask you to stay for free until you find an alternative home. When you go to court carry all the (distress- the emotional trauma, the miscellaneous expenses) documents. Start now to gather all your court papers.

Should you agree to move, demand for the cost of transporting your goods to another location etc. A rich Landlord will easily refund your cash and additional costs if they truly need to live there.

To be honest, if you go to court, you will live rent free for a long time. Just get a good lawyer.

No court will ask you to live rent free in any commercial building.

To the OP, if the house is in Lagos or Ogun, go to the nearest Mediation Centre and make a complaint. They will invite your Landlord over then work out what's favourable to both parties under the tenancy laws applicable in that state.

This way you will avoid paying a lawyer but still get a favourable judgment

You will leave six months after receiving your balance inclusive of the agreement albeit prorated.

Don't move out of the house. Go to court or meet a lawyer.
Any time you want to rent a house, go through the proper channels, get your receipts.

But there is no issue here now, asking you to move out is not the case, let him put it in writing, then you can ask him to refund you your money, after refund, he will now give you minimum of six months to search for another accommodation.

The op did not state there was any agreement made between him and the Landlord. You are the one thinking that into his post.

Unpopular opinion but your friend's wife goofed by not letting the owner in. Everyone should learn this simple basic wisdom of welcoming people with courtesy and warmth, it can help you in the long run.

How can someone come to check out her new tenants and you stay outside with her to gist without offering her invitation into the home, haba. That wasn't very wise of his wife and he wasn't wise by allowing it because he was "praying",( not a good excuse) You can always continue your prayers from where you stopped after hosting a guest, God is not running away.

Second, tell your friend to go with his wife and apologize to the owners because this route you people want to take will be to his loss and his loss alone. Let him carry his children with him if he has one to soften their hearts grin. I'm saying this because, he has invested time and money in working on that house, he has settled down with his family. To start looking for another house will cost him more time and money even if they give him his rent back.

So take this advice: let him go and see them with a bottle of wine or a gift and apologize with all humilty for the misunderstanding, assure them that you are good people who meant no harm.

We stoop to conquer o. This matter is very easy to solve, he just has to be wise.

And tell wifey to be more welcoming next time. Na she mess up.

Either they refund all the money including agent fee or they let you complete the remaining months. It's as simple as that, anything less is a cheating

But humility goes both ways both landlord and Tennants,
If you see the cost of building material in the market you’ll know that its even fair enough to worship your landlord o, landlord came to have a word with the Tennant instead you didnt even let him have a sit at the verranda to wait, it’s annoying tho he took it too far, him for gv him seet then tell him his hubby is praying and will be wt him shortly, ppl no get courtsey forget and na those kind of tennants deh spoil house qucik

Is either you are a prayer warrior when the Landlord doesnt like it or may be you have started to developed interest for the Land lord pikin .whichever way could attribute to your sack.

can you see that, it's insulting even to the extend of right to the house, if that Op had enough sense he should call and record their conversation,

what arrant nonsense, sue them, recover your money in full, including commission paid, and any amendment made, then sue for breach of agreement, still they should give him a year or 6 months to pack out

Let me tell u a story.

I have know of a friend who came about some money, built an apartment and asked his mum to pack-in 2hile he was out of the country. His mum believed the location to be too far from town where things are happening so she allowed her cousin who had housing issue to stay there in the interim.

The interim turned years and when the needed the house the mum's cousin wasn't ready to vacate the premises. In fact they refused bluntly despite entreaties and the guy felt they were ready to go fetsih on him.

He instituted a case against them and they claimed they were occupying the premises as a rent-paying tenant.

The court held that since there was no tenancy agreement or receipt to show they paid rent at any time they were occupying the premises illegally.

The cousin cited some instances he helped the mother with cash but the judge was having none of that since it can't be proven the cash was for rent. Now this is where I want u to focus on. Having access to the property and having sent cash to the person within the period u occupy the premises does not equate to the fact that u paid rent ó.

Go to the office of the public defender in lagos. And no, contrary to what many people believe for some reason, no court will allow you live there rent-free. What the court may allow you do is have enough of a notice period to find another place and you pay the rent of the notice period.
