An Appeal Court in Enugu has dismissed a suit against Ebonyi State Governor, Dave Umahi and his Deputy Dr. Kelechi Igwe, seeking their removal from office for defecting to the All Progressives Congress, APC from the Peoples Democratic Party, PDP.

The suit was filed by Senator Soni Ogbuoji and his Deputy, Justin Mbam, candidates of the APC in the 2019 Guber Elections.

POLITICS NIGERIA earlier reported that an Abuja High Court presided over by Justice Inyang Ekwo had sacked Umahi, Igwe and 17 lawmakers in the state for defecting from PDP to the APC.

However, on Tuesday, February 28, 2022, a High Court sitting in Abakaliki struck out the same suit

On Friday, Justice A.O Belgore dismissed the suit for being inconsistent with the constitution and extant laws of the country.

Don’t deceive yourself. Umahi isn’t going anywhere until May 29, 2023. This is Nigeria for you. And by the way, if PDP is serious, let them make Igariwey their candidate for 2023 just as he was nominated to replace umahi.

You are not getting the point.

They are two different cases:

PDP v Umahi, Igwe, APC & INEC (Federal High Court, Abuja)
Sonny Ogbuoji & Ogodo v Umahi, Igwe (Ebonyi High Court)

The second one is what the judge is ruling on. Sonny Ogbuoji was the 2019 APC Guber candidate, Ogodo was his Deputy. If you look carefully, neither the PDP nor INEC was in their suit.

Even if they are given judgement, INEC won't act because they aren't parties to the suit.

The first one is still before the Appeal Court in Abuja.




I still believe that of Abuja will still keep him. It's straightforward.

The Appeal Court sitting in Enugu, Friday dismissed the suit filed by the candidate of the All Progressives Congress, APC, Ebonyi State, in the 2019 Governorship election, Senator Sonni Ogbuoji and his Deputy, Chief Justin Ogbodo Mbam, which demanded the Court to declare the seats of Governor David Nweze Umahi and his Deputy, Dr Kelechi Igwe vacant on account of their defection from the Peoples Democratic Party, PDP to the APC.

Recall that on Tuesday, February 28, 2022, the Ebonyi State High Court sitting in Abakaliki, struck out the same suit and awarded N500, 000 as damages against the plaintiff.

In a 37 minutes ruling, the Judge, Justice A.O Belgore dismissed the suit for being inconsistent with the constitution and extant laws of the country.

This case is between Umahi and his fellow APC member, who contested against him in the last election . The one delivered by Justice Ekwo in favour of PDP is still pending at Appeal Court.
