Im not a Lawyer but I have read the electoral act. While it is not against the law to be in one party, and campaign for another party, it is morally wrong.

You are trying to be lawless here. And you and Obi are the ones saying that you want to rescue Nigeria from the old orders. Law doesn't just exist for you guys to play with but to follow and obey. Don't make Nigeria to be more Banana Republic than it is.

Just like INEC said above, irrespective of the eventualities, the party must obtain a court order. If it was death or incapacity, ill assume the court order would be much easier to get.
