Since the number of votes in the over-voting areas is more than the number of votes needed for declaring a clear winner. The tribunal should have rule for a rerun, not deducting the votes from Adeleke votes as there was no any forensic verification that all the votes deducted belong to Adeleke.
The justices failed woefully

Invariably, you know better than Adeleke's lawyers and the Judges. Abeggiii, shift let the judiciary do their job.

. Uneducated ilitrate CUPP! The body does understand how judiciary works. They should go back and learn government in secondary schools. If it is a sponsored judgement why having dissenting judgement? It is shocking that many voters don't know how Osun election was bedeviled by overvoting and irregularities. Cancellation of all the results in the contested local governments is justifiable. BEVAS don't guarantee free and fair elections. It is the masses that work towards fairness in our elections

The justices failed woefully
now this is a very reasonable criticism of that judgement. One would expect a rerun. It's left for his lawyer to do the needful in appeal. Truth is that they cheated with the BVAS. They should ask for a rerun in appeal instead of asking the higher court to overrule the judgement of the lower court. If they ask for the later, they would lose.

Electoral had been changed before Osun and Ekiti elections and signed into law, no more reruns. Na to remove overvoting and count the rest. Also, area wey dem no allow voting to take place on the day of election, that one don go be dat.

The simple rule is that where there is over-voting in any polling unit, all votes in the affected polling units are cancelled. So bolth Adeleke and Oyetola had votes deducted due to the cancelled votes.

I do not know what you mean by "the number of votes in the over-voting areas is more than the number of votes needed for declaring a clear winner." Our electoral system is based on winning with a simple majority even if it is just ten votes. After deducting the cancelled votes, it is clear that Oyetola has a majority of almost 100K votes. So there is no case for any re-run.
