The constitution is very clear. The candidate with the highest votes without spread and the second highest votes will go into runoff.

Not second highest votes but highest amount of states won.

That's a runoff.

There's no winner.

Another date is set for all polling units that couldn't vote or votes were cancelled in the first round. The runoff can be repeated until one of the 2 satisfies the criteria for a win.

No brother, it's the candidates with 1st and 2nd highest that will go for runoff, the is no mention of how many state you win in our Constitution. You can even win the election by not winning the highest number of vote sef, that's rare though, you only need to perform well in the States you lose and that's all.

It will be a rerun between the two highest candidates. A critical part to even look at is if the 25% in 24 states doesn't include FCT, what will happen? That may involve going to court for an interpretation.

You guys don't read the constitution, you just assume.

Go and read section 134 of the constitution thoroughly.

The runoff is between the candidate with the highest votes and of the other candidates, the won who won the highest number of votes.

The runoff is between the candidate with the highest votes and of the other candidates, the won who most amount of states.

Below is the section 134 in its entirety.


Section 134 of the Constitution of the Federal Republic of Nigeria
(1) A candidate for an election to the office of President shall be deemed to have be been duly elected, where, there being only two candidates for the election -

(a) he has the majority of votes cast at the election; and

(b) he has not less than one-quarter of the votes cast at the election in each of at least two-thirds of all the States in the Federation and the Federal Capital Territory, Abuja.

(2) A candidate for an election to the office of President shall be deemed to have been duly elected where, there being more than two candidates for the election-

(a) he has the highest number of votes cast at the election;

and

(b) he has not less than one-quarter of the votes cast at the election each of at least two-thirds of all the States in the Federation and the Federal Capital Territory, Abuja.

(3) In a default of a candidate duly elected in accordance with subsection (2) of this section their shall be a second election in accordance with subsection (4) of this section at which the only candidate shall be -

(a) the candidate who scored the highest number of votes at any election held in accordance with the said subsection (2) of this section; and

(b) one among the remaining candidates who has a majority of votes in the highest number of States, so however that where there are more than one candidate with majority of votes in the highest number of States, the candidate among them with the highest total of votes cast at the election shall be the second candidate for the election.

(4) In default of a candidate duly elected under the foregoing subsections, the Independent National Electoral Commission shall within seven days of the result of the election held under the said subsections, arrange for an election between the two candidates and a candidate at such election shall be deemed elected to the office of President if -

(a) he has a majority of votes cast at the election; and

(b) he has not less than one-quarter of the votes cast at the election in each of at least two-thirds of all the States in the Federation and the Federal Capital Territory, Abuja

(5) In default of a candidate duly elected under subsection (4) of this section, the Independent National Electoral Commission shall, within seven days of the result of the election held under the aforesaid subsection (4), arrange for another election between the two candidates to which the subsection relates and a candidate at such election shall be deemed to have been duly elected to the office of President, if he has a majority of the votes cast at the election.

In this instance the one with the popular votes get into the runoff, while the next person for the second election is that person with the highest votes in spreads

Not the two highest candidates. The potential rerun is between the candidate with the highest amount of votes and among the others, the one who won the most number of States.

Also, the 24 States does not have to include the FCT. Shagari had 12 out of 19 and was considered to have met the conditions. You only need 24. If you have 23 States, then you can use 25% in FCT to meet it up.

What if, non of the candidates were able to meet with the 25% requirement in the 24 states, but there is a candidate with majority of the votes, what will happen in this situation?
I think they will have to reduce the number of contestants by removing half of the least scorers and doing a rerun for the other half of the higher scorers. Although this is most likely not going to happen.

If a region is more populated than another and one wins the highly populated region losing 3 or 4 other region. It will be unjust to declare such person winner. President of all not one.

So if a person gets 28 million votes in10 state another 22 million by having 25% across 24 States and FCT. The 22 million guy wins.

Obidients have started to loose hope ... Politics is not the same thing as protest.

Protest votes can not work in politics either.

Protest and elections are controlled by different things and may not be merged together to determined who wins.

So you all should get this straight and clear.

In a nutshell this is what Atiku Abubakar the best candidate in the presidential election tomorrow because Atiku has the best plan to accommodate TT he demands of both the North and Southern people ...

What if the candidate with majority votes is followed by a candidate who couldn't meet the 25% requirement in 24 states and FCT, then the third candidate in terms of majority votes meets the 25% requirement?


I am asking this because there are many possibilities in this election with Obi, Atiku, Tinubu and Kwankwaso are in the race.

IOde, i know you wont read, have not seen where it is written that to win the presidential election in nigeria, candidate must have the highest number of votes cast, and must have 25% of votes cast per state, in at least 2/3 of the total number of states in nigeria. ie 24 states.
if you dont meet the two conditions, you cant win, if no candidate meets the two conditions, then the first and second will then go for a run-off election that only a simple majority , highest number of votes won in totality wins/
