It should have been, to be declared winner the candidate must score at least 25% in “two – thirds of abia, adamawa, akwa ibom, anambra, bauchi............, and federal capital Territory..

Fine, the constitution stated clearly that you must get at least 25% of votes in 24 states including the FCT, that's very clear. And equally you must have the highest number of votes. To be pronounced winner. By INEC's results we don't have a winner yet, even as BAT has the highest vote he hasn't fulfill the other criterion.

Now add FCT to it and your answer will be 37 abi?

Now the constitution says 36 states AND the FCT which makes the total 37 abi?

There are ONLY two correct answers to the question and one of them is not a whole number.
Thus the ONLY correct answer is:

Section 299 of the Constitution of the Federal Republic of Nigeria

The provisions of this Constitution shall apply to the Federal Capital Territory, Abuja as if it were one of the States of the Federation; and accordingly -

(a) all the legislative powers, the executive powers and the judicial powers vested in the House of Assembly, the Governor of a State and in the courts of a State shall, respectively, vest in the National Assembly, the President of the Federation and in the courts which by virtue of the foregoing provisions are courts established for the Federal Capital Territory, Abuja;

(b) all the powers referred to in paragraph (a) of this section shall be exercised in accordance with the provisions of this Constitution; and

(c) the provisions of this Constitution pertaining to the matters aforesaid shall be read with such modifications and adaptations as may be reasonably necessary to bring them into conformity with the provisions of this section.


- NOTE: "this Constitution shall apply to the Federal Capital Territory, Abuja as if it were one of the States of the Federation"

- So the Governor is - The president who administer it through his/her Minister for FCT

- Abuja lawmakers are the National Assembly members.

- Also Abuja is not big enough to have 3 Senators, reason it has only one.

Wawwwww... This is really insightful and helpful. With all these, don't you see that Abuja is special. The president even acts as the governor

My problem with our law makers is that 4years will come and go and they will still not deem it fit to re-write that part in a simple, clear and unambiguous manner.

The clarity came from a Supreme Court ruling in a case involving Muhammadu Buhari of the then All Nigeria Peoples Party (ANPP) and Olusegun Obasanjo of the then Peoples Democratic Party (PDP) on Friday, July 15, 2005.



In its ruling, the apex court had upheld that presidential candidates must win 25 per cent of all votes cast in 24 states, and the Federal Capital Territory, Abuja.

I read you correctly. INEC is trying to change the goal post in the midst of the game, FCT is not a state, it's called federal capital territory an appointed administrator runs it and not an elected official (the FCT minister), so we can't say 37 states, that's incorrect by the constitution and public narrative. Except you can show me better.

If one can prove that FCT is a state then by all means Tinubu meets the criteria according to INEC's results, which I believe is highly questionable.

Oga is the Chief executive officer of FCT an elected or appointed person? Abuja is not a state in the context of the constitution under election. Haba
