The Electoral guidelines for Osun elections is purely different from the electoral guidelines for the February elections. In the electoral act, INEC determines the mode of transmission. In the February elections, INEC chose the electronic mode of transmission in its guidelines and jettisoned it in the middle of the game.

I've learnt not to be too hard on the wailers most especially the Obiends as they need our help.

My observations stems from the fact that these people are inherently frustrated from serial defeat & misjudgements. This has caused them to be chasing shadows all the time & giving solidity to mere whirlwind.

INEC guidelines can't supersede the electoral act and the constitution below is the section 60 you mentioned and no where it says electronically transmitted.... in law you can't do anything outside the Act and constitution.

Do not be in a haste, there’s difference between transmitting of accredited votes to the server and transmitting of total votes cast at the polling unit.. accreditation comes before voting remember

INEC is bound by the Electoral law and it's election guidelines to transmit results electronically. The INEC chairman made that point clear severally at different foras that the results of the 2023 general election, i.e polling units results will be transmitted electronically to the IREV real time on the election day
It's a whole different thing if a chief executive intends to be meticulous with his tools and another if any law compels him too & where he differs wether there are applcable laws to punish such refusal and to quote you, due to emerging new facts, he may, at his discretion chose to not use his tools, moreover, according to the Supreme court, there aren't laws that compels him or his subordinate to use such tools.

The manner prescribed by INEC has been announced by INEC chairman after the election to be Manual Collation at the ward level, State Level and was transmitted to the screen for everyone to see at the Collation Centre (FCT).

Meanwhile there is no law that compel INEC to use IREV by fire by force.

So what you meant is that the INEC chairman deceived some people by publicly saying that result will b uploaded in real time and privately telling APC not to worry about that? Is that not deception and being biased? As INEC chairman, is he supposed to be biased?

Boss what you call emerging facts must be back by law. Is there any law that says INEC must upload results immediately on the server? Even if the INEC chairman said so it is not in the electoral act or constitution so it’s not going to fly at the tribunal.
This judgement will be a precedent and it will be mentioned in the presidential election tribunal.

Like I continue to say, Nigerians lack basic English comprehension. The Supreme Court has just told you there is nothing in the LAW that requires electronic transmission. A guideline is not a LAW! Inec guideline is not The same thing as electoral law.

Transmission of results and transmission of accredited voters are not the same.

It is not mandatory to transmit accredited voters but it is mandatory to transmit results (snapped with BVAS as INEC have adopted)
