Most obidients sounds foolish. No court of law can cancel any election base on this. INEC is an independent body and can decide to say something and change it without taking any permission from anyone as long as it is not constituted. Nothing like immediate transmission of election results in our constitution. So, Yakubu can make a promise and renegade such as well. So, make nna buy sense if nna no get one.

So instead of providing proof of his votes that were giving to other candidates, we are focusing on someone saying the election results would be transmitted live.

Osamor was called in as a witness not to tender any sort of results but to prove that there was no time the INEC chairman said there will be no electronic transmission of results!
She made this claim by stating that she had participated in all of the INEC chairman's meetings and engagements where the commission boss stated explicitly that there will be electronic transmission of results from the PU contrary to a frivolous publication by Tribune newspaper!

The amended electoral act 2022 gave INEC the power to choose its mode of transmission which will be binding with equal authority that the act holds!

INEC made an extended law referred to as rules and guidelines which was publicly announced by the INEC chairman at different forums where the mode of transmission was made known and documented with procedures clearly spelt out during the conduct of the election!

In the rules and guidelines, INEC chose its primary mode of transmission which is electronic transmission of results from the polling unit to a database which will be viewed by citizens from the IREV!

Its that simple!

Now if INEC discovered that its primary choice won't materialize due to acclaimed or perceived external forces, they are not only supposed to inform the parties involved but also postpone the election to a date where it would be possible to conduct such election!

If INEC found out it was unable to proceed with their primary choice,they should inform parties involved and choose a different mode of transmission by rewriting a totally different rules and regulations!

This was the path INEC should have taken if they were truly independent and wanted transparency!


Some unschooled folks here have argued that INEC reserves the choice to change the laws as much as possible even during the conduct of the election but such arguments are not only hilarious but illogical!
The rules and regulations made by INEC are as powerful as the electoral act itself!
Those who opine that INEC can decide to alter a LAW at its own will is either ignorant or just being mischievous!

I suggest make una read the Electoral Act which gives alternatives to coalition of results when technological or unforeseen acts occur. It is up to LP to prove that technological glitch did not occur or that it was not beyond INEC's control......MISSION IMPOSSIBLE grin grin grin

olodo .. so because he refused to transmit results instantly at the polling units will now give the judges the reason to truncate a national ELection that their is a provision in the constitution that said inec has power to operate / conduct an ELection the way dey like as far that the election conducted is free and fair

Naija and wahala. Also it seems some people just look out to cause wahala. What is definition of live? IREV or whatever is not live, it's just a portal where results are uploaded. Whatever that's counted at the ward will be uploaded online. IREV doesn't validate the results. The agents at the polling units are what validate it provided the votes are not more than accredited people.

Jeez! These people are so clownish! So, if the INEC chair says that the results will be transmitted live & the server is down, an entire nation should be stood still, when there are alternatives to fullfil the transmission requirements.
Transmitting results electronically is DISCRETIONARY. Electronic transmission is only in the INEC guidelines and mot a condition mandated by law.
