I don't think this argument will suffice. At any point in time inec has a discretion to determine how to transmit results depending on the prevailing circumstance. They have already told you that they had technical issues so resorted to manual transmission.

Yes, it is absolutely correct that INEC has the discretion to determine how results are transmitted, and INEC had in it's guideline mandated that in confirming with the provisions of the 2022 Electoral Act, results must be transmitted. Having determined so, INEC can no longer change the mode after election has commenced as it will be similar to allowing the referee to change the rules of the game in the middle of the game. So that decision is right to the extent that INEC can only decide how to transmit result before the election, not after the election.

I think a clarification is needed on subject of electronic transmission of result & I would want those with the knowledge & operation of the election procedures & the law told. My Question therefore is the upload of photograghed form EC08 of INEC the same as Electronic transmission of results?

This judgment is a clue of what the outcome of the petition at the Presidential election tribunal will look like. I just pray Nigerians remain calm after the pronouncement, because that is what everybody is waiting for.

For people that are tired of this world, and want to meet their makers with violent death of hot lead from the police and military, they can cause riot after the tribunal judgement

Maybe you should read the judgement again. This case was in march after the presidential election. What the judge is saying is that INEC has the powers to amend it's guidelines at any point in time.

Ref has written guidelines that guide them which they must follow. There is no where it’s written that INEC must transmit result electronically. INEC had the intention of using the same platform that worked for them during Osun election which was was just 24 LGAs compare to general election which is 774 LGAs. They already apologized cos they didn’t prepare well. So many glitches during the election which we saw.

Bro evidence was tendered at the tribunal where INEC vowed to do so both documentary and in broadcast. It became the least expectation of every party including the citizenry. No one coerced INEC into doing so. They chose it. They insisted on it. They didn't even deny this fact at the tribunal. It is curious and a fatal anomaly that they failed to adhere to their own guidelines in one aspect the Presidential while employing it to another, the National Assembly for elections held on the same day.
Don't fall on a sword for another. Is it a norm to just apologize for breaking your own rules? Where is the justice for those that are adversely affected? Why can't they do it again next time and simply just apologize. We must hold our institutions to task in this country to progress. My opinion.

This case and one at PEPT are not the same
This one is telling INEC to use a particular means or way to collate result, the one at PEPT is asking the court look into the fact that INEC did not follow its own regulation.
It's just like going to the swimming pool for a contest, one of the contestants told the ref that, it's best to jump in with both legs, court now said no, ref can decide how one can jump in, now ref now said, you will jump in with your stomach, then during the competition a contestant now crawled in and INEC is said the person that crawled in is right. Was that their regulation?

Lagos LP's FHC case dismissed by Appeal court was a pre-election matter.

While the PO and LP's case currently at the PEPT is a post-election matter.



so what is the difference between pre and Post election in this case and the judgement? Sometimes I tend to believe some of you obideints are under a spell.
