The former governors of Imo and Adamawa States, Ikedi Ohakim and Murtala Nyako, and Mr. Nyako’s son, Abdul-aziz, have been arrested by officials of the Economic Financial Crimes Commission. The former governors, and Abdul-aziz Nyako, who is a senator now, are to be arraigned at a Federal High Court in Abuja on Wednesday on different cases of alleged corruption. A source at the EFCC had in June told PREMIUM TIMES that Mr. Ohakim had questions to answer concerning a number of properties allegedly traced to him. The commission said in a statement that the two Nyakos were wanted on allegations of stealing, abuse of office and money laundering. Mr. Nyako’s son had been interrogated by the EFCC over alleged illicit funds traced to companies in which he had interest. Specifically, he was asked to explain how over N15 billion belonging to Adamawa State was allegedly laundered into the accounts of five companies said to owned by him. The companies are Blue Opal Nigeria Limited, Crust Energy Nigeria Limited, Blue Ribbon Multilinks Limited, Tower Assets Management Limited and Blue Ribbon Bureau De Change. The funds were allegedly funnelled into the accounts of the five companies, from Adamawa state government bank accounts. The transfer was done by the account officer who incidentally is the manager of the bank and an in-law to former governor, Mr. Nyako. The EFCC said the manager claimed he transferred the funds based on verbal instructions from the former governor for purposes that were not stated. The commission said its investigations revealed that from 2007 to 2011, the then Governor Nyako directed that all state-owned accounts domiciled in various banks be transferred to the account supervised by his in-law. Commissioners of Finance and Accountants General of the 36 states of the federation on Tuesday distanced themselves from claims by the former Minister of Finance, Ngozi Okonjo- Iweala, that they were part of the decision to withdraw and spend $2bn from Nigeria’s excess crude oil revenue account last December. Edo State governor, Adams Oshiomhole, and his Kaduna State counterpart, Nasir El Rufai, had, after the National Economic Council (NEC) meeting in Abuja on Tuesday last week, accused Mrs. Okonjo-Iweala of unilaterally approving the withdrawal of about $2.1 bn from the $4.1 bn left in the Excess Crude Account (ECA) last November “without authorization”. But in a swift reaction, the former Minister had vehemently rejected the accusation, describing allegations linking her to the allegations as “false, malicious and totally without foundation”. Mrs. Okonjo-Iweala’s reaction, conveyed through a statement by her Media Adviser, Paul Nwabuikwu, said all expenditures from the ECA “were discussed at meetings of the Federation Accounts Allocation Committee (FAAC) attended by finance commissioners from the 36 states”. “It is curious that in their desperation to use the esteemed National Economic Council for political and personal vendetta, the persons behind these allegations acted as if the constitutionally recognized FAAC, a potent expression of Nigeria’s fiscal federalism, does not exist,” she said. But in a stern reaction on Tuesday in Abuja, members of the FAAC, under the aegis of the Forum of Commissioners of Finance, disowned the former minister, describing her claim as “misleading and far from the fact”. “It has come to our notice the statement credited to the former Coordinating Minister of the Economy and Honorable Minister of Finance, Dr. Ngozi Okonjo-Iweala, that the Federation Account Allocation Committee (FAAC) approved the withdrawal from Excess Crude (Foreign) Account the sum of Two Billion U.S. Dollar ($2,000,000,000.00),” the commissioner said. “This statement is far from the fact and is misleading,” the statement said. The FAAC meeting for November 2014 ended in confusion when the then Minister of State for Finance, Bashir Yuguda, could not explain how the balance in the ECA had dropped from $4.1 bn at the end of October to $3.1 bn. Prior to the October FAAC meeting, Mrs. Okonjo-Iweala had told reporters that the balance of the ECA stood at $4.11bn, while the country’s external reserves rose from $ 36.6bn in June to $39.48billion as at October 16. Regardless, the then Chairman of the Forum of State Commissioners of Finance and former Ebonyi State Commissioner of Finance, Timothy Odaah, had denied knowledge of any decision to withdraw from the account, insisting that none of its members was aware of the withdrawal. “No state knew how the $1 bn difference reported in the Excess Crude Account balance, between October and November, came about,” Mr. Odaah told reporters then. “The discrepancy has been noted for discussion at the next FAAC meeting. It calls to question how transparent the management of the excess crude revenues has been.” Till the end of his tenure, Mr. Odaah, who later claimed reconciliation was ongoing with the Finance Minister, did not reveal his findings. However, several months later, Mr. Oshiomhole stirred the controversy afresh last week with the allegation that the former minister was economical with the truth about the country’s finances. Mr. Oshiomhole had lambasted Mrs. Okonjo- Iweala over her claims that Nigerians knew what the three tiers of government usually collect through the State Finance Commissioners who usually attend the monthly FAAC meetings. The power to take money from the ECA, Mr. Oshiomhole argued, is vested in the NEC, an institution created by the constitution, and not State Finance Commissioners, who are not known by the constitution. In disowning Mrs. Okonjo-Iweala, the Commissioners’ Forum pointed out that the law setting up FAAC, which predates the ECA, “cannot approve withdrawal and has not done so in the past.” If anything, the Commissioners said, records of FAAC meetings show that members have always queried the activities on the ECA, and therefore did not decide any withdrawal. Although the Commissioners said they observed the withdrawal of $2bn from the ECA in December 2014, the then Minister of State Finance and Chairman of FAAC, Mr. Yuguda, had explained during plenary that approval came from former President Goodluck Jonathan. Lines of investigation suggested by the PwC audit need to be pursued, writes Lamido Sanusi Just over a year ago President Goodluck Jonathan suspended me from my position as governor of the Central Bank of Nigeria after I questioned an estimated $20bn shortfall in oil revenues due to the treasury from the state oil company. As I said then, you can suspend a man, but you cannot suspend the truth. The publication last month of a PwC audit into the “missing billions” brings us a step closer to it. When I was central bank governor I raised three broad questions. First, did the Nigerian National Petroleum Corporation remit to the government the entire proceeds of its crude oil sales? Second, if it did not, is there proof of the purpose to which the unremitted amounts were applied? And third, did NNPC have the legal authority to withhold these funds? Contrary to the claims of petroleum minister Diezani Alison-Madueke, the audit report does not exonerate the NNPC. It establishes that the gap between the company’s oil revenues between January 2012 and July 2013 and cash remitted to the government for the same period was $18.5bn. And it goes into detail about the NNPC’s account of how it used that money, which raises serious questions about the legality of the state oil company’s conduct. The auditors say a significant part of the unremitted funds is supposed to have gone towards a kerosene subsidy that had been stopped two and a half years earlier by the late President Umaru Yar’Adua. His decree never appeared in the official gazette, leading some to question whether it ever had legal force. Evidence disclosed in the report suggests this is a sideshow. The executive secretary of the agency charged with administering subsidies confirmed that, acting on Yar’Adua’s orders, it had ceased granting subsidies on kerosene. There was no appropriation for such a subsidy in the 2012 or 2013 budgets. Throughout all this, Nigerians paid 120-140 naira a litre of kerosene, far more than the supposed subsidised price of 50 naira. Yet the state oil company withheld $3.4bn to pay for a subsidy that in effect did not exist. I have consistently held that this was a scam that violated the constitution and siphoned off money from the treasury. The second major item raised in the report relates to the transfer of oil assets belonging to the federation to the Nigerian Petroleum Development Company, a subsidiary of the NNPC. NPDC has paid $100m for these assets, from which it extracted crude valued at $6.8bn but paid tax and royalties worth $1.7bn in the period scrutinised by the auditors. PwC was unable to establish how much of the remaining $5.1bn should have been remitted to the government. But the report showed that, along with the private companies NPDC partnered with, it was extracting crude worth billions of dollars but yielding very little revenue for the treasury. I was investigating related transactions when I was suspended. The third major item is a claim of $2.8bn by NNPC for expenses not directly attributable to crude oil operations; PwC said “clarity is required” on whether such upfront deductions from remittances to the federation accounts are allowed, or whether the money should have been remitted to the government. Finally, there are duplicated expenses, “unsubstantiate d” costs, computation “errors” and tax shortfalls; a total of $1.48bn has to be refunded. Of the $18.5bn in revenues that the state oil company did not send to the government, about $12.5bn appears by my calculations to have been diverted. And this relates only to a random 19-month period, not the five-year term of Mr Jonathan, the outgoing president. Nigerians did not vote for an amnesty for anyone. The lines of investigation suggested by this audit need to be pursued. Any officials found responsible for involvement in this apparent breach of trust must be charged. President Elect, Gen. Muhammadu Buhari has inaugurated a 19-member transition committee with a charge to members not to engage in a witch hunt or fault finding. He also announced that his administration would not witch-hunt anybody because he was aware that government is a continuum. Buhari said this while inaugurating the Ahmed Joda-led transition committee in Abuja, on Wednesday. While expressing gratitude to members of the committee for accepting to serve at very short notice, he explained that the change from one government to another always involves complicated operational challenges. According to him, the incoming government needs to know where the previous government stopped so that it can know where to continue. He noted that Nigeria was blessed with outstanding men and women of competence and experience in different fields out of which his team has picked the nineteen to ensure a smooth process. Buhari told committee members, “this assignment though onerous, it is well within your ability to accomplish, you are required to assess the information provided to you and advise me on its quality and accuracy.”He also said, “It is a simple matter but you must have the right information if you are to shape appropriate policy decisions. Needless to repeat; that your committee and our government are not to witch-hunt or engage in fault finding. “We want the facts and nothing but the facts, what has been done cannot be undone, our job is to learn from the mistakes of the past in an attempt to avoid similar errors.“The time given for you to complete your assignment, two weeks, is short but because of the postponement of the election for six weeks from February 14 to March 28, the transition period has been truncated, we are obliged therefore to fast track steps to May 29.”The President elect also charged the committee to ensure that it does not overlook “essentials.”Buhari who spoke glowingly about Mallam Ahmed Joda the committee chairman, described him as one of the few surviving links of the first republic civil service to the present day. He enjoined members of the committee to be prepared to work hard because Joda is an exerting task master adding that very few young men of his age can keep up with him. Chairman of the Committee, Mallam Ahmed Joda who spoke on behalf of other members expressed appreciation to the President elect for considering them to be worthy to help prepare the ground for the incoming administration to take over smoothly on May 29, 2015.He said, “We as a committee are determined to do the best we can within the time that is allowed to accomplish your wishes and to make it possible for you to achieve your vision and all that you wish for our country.“When I met you and you briefed me about this assignment, about the composition of the committee, I did observe that I’ve never served on a committee so weighty like this. “I have people who are distinguished in their professions, who have their own enterprises and have their own businesses to look after and even serving governors and people in active service to the service of your incoming government and to the service of our motherland.”He explained to the gathering that members of the committee met for the first time on Wednesday to get to meet and know one another and plan the committee’s schedule of activities over the next two weeks. Joda also noted that members of the committee were committed and willing to work long hours even on weekends to deliver on their tasks.“I promise you that we’ll do our best because we are not only serving you, we are serving our people. We are going to try to begin to lay the foundation for a strong country where justice and peace prevail.” He said.
