The Nigerian Labour Congress (NLC) and the Trade Union Congress (TUC) have told the National Industrial Court of Nigeria in Abuja to revoke its interim order preventing workers from going on strike until the motion on notice filed by the federal government and the Office of the Attorney-General of the Federation is determined.
The NLC has filed a motion on notice, which was acquired by Newsmen, urging the court to reverse the interim order in the interest of justice for Nigerian workers.

Justice O Y Anuwe had earlier instructed Nigerian workers not to go on strike following the Federal Government’s removal of petroleum subsidies.

According to the court documents by the NLC and TUC, the orders sought by the NLC included

“AN ORDER of this Honourable Court setting aside, discharging and/or vacating the ex parte interim order of injunction restraining the Defendants/Respondents, their members, their agents, employees, workmen, servants, proxies or affiliates from embarking on the planned Industrial Action and/or strike of any nature pending the hearing and determination of the Claimants/Applicants motion on notice for interlocutory injunction made on the 5th June, 2023, Coram: Hon. Justice O.Y. Anuwe in Suit No: NICN/ABJ/158/2023 between federal government of Nigeria & anor. Vs Nigerian labour congress and anor. AND for such Order or other Orders as this Honourable Court may deem fit and proper to make in the circumstances.
Take Further Notice that the Grounds upon which the Preliminary Objection is brought are as follows: This Honorable Court on the 5th day of June, 2023 pursuant to an ex parte application brought by the Claimants/applicants, made an interim order of injunction restraining the Defendants/Respondents, their members, their agents, employees, workmen, servants, proxies or affiliates from embarking on the planned Industrial Action and/or strike of any nature pending the hearing and determination of the Claimants/Applicants motion on notice for interlocutory injunction.

“The claimants’/Applicants suit as presently constituted and the reliefs sought offends the lucid provisions of Section 254C (1) (f) of the 1999 Constitution and section 7(6) of the National Industrial Court Act 2006 and thus the ex-parte order liable to set aside.

“Alternative to (ii} above, this Honourable Court lacks the jurisdictional competence to hear and determine the case as it was filed in violation of Section 17 {2} of the Trade Disputes Act, which authorises the Minister of Labour and Employment to refer a trade dispute directly to the National Industrial Court.

“This court as presently constituted lacks the jurisdictional competence to hear and determine the matter and or make any orders as regards the trade Dispute {subject matter of this suit} for failure to first refer the trade dispute to the Industrial Arbitration Panel as mandated by part 1 of TDA.


“The Claimants/Applicants suit offends the lucid provisions of Order 3 Rules 1 and 6 of the National Industrial Court Civil Procedure Rules, 2017.

“The Defendants/Applicants and their members have a right to strike under the Trade Unions Act, the Trade Disputes Act, the ILO Convention and under several international treaties the 1st Claimant/Applicant is a signatory to.

“By virtue of Section 40 of the Constitution of the Federal Republic of Nigeria, 1999 as amended, Nigerian workers have the fundamental right to protest against policies of government considered inimical to their interests as reiterated in the cases of IGP VS ANPP {2008} 12 WRN 65, MUSA VS INEC,— The Claimants/Applicants Suit does not disclose a reasonable cause of action against the Defendants/Applicants.

“The Plaintiffs Suit is lacking in bona fide, as it was filed to harass, irritate and embarrass the Defendants/Applicants, which constitutes an abuse of judicial process.

“The Claimants/Applicants suppressed material facts before this Honourable Court thereby misleading the Court to grant the exparte reliefs sought and obtained.”

Review, not overturn. An election can only be overturned by the Tribunal. That's where the case is tricky.
After the returning officer has declared the winner of the election openly. With your assertion, you can be in your backyard and declare anybody president elect including yourself.

This case is very tricky and not as straightforward as it seems.

I am NOT a Lawyer, so perhaps the experts can advice better.

But sections 149 of the Electoral Act of 2022 as amended that any actions taken by any AGENT or OFFICIAL of the commission with regards to an election, can only be overturned by an Electoral Tribunal or any other competent court of jurisdiction.

The issues here which we can determine are:

1. The REC is an agent and official of the commission, so his action or inaction can only be challenged or overturned by the Tribunal (as derived from section 149).

2. The REC doesn't have any power to declare results as such powers ONLY rest with the Returning Officer. Hence, his action is in breach of the Electoral Act

3. The commission doesn't have the POWER to OVERTURN results. Only the Tribunal can do so.

Seems nah Tribunal go finally settle this matter.

Good morning, Nlder's. Pls, I need your advice. I created this account just now to hide my identity.

Without wasting time on this, I need your advice as I want to take a blind step because i don't know what else to do.

I graduated since 2018 and since then, I don't have a good job till now. Just surviving that's what I am doing.

Currently, I asked my mom to help me secure loan of 100k while I source for another 100k from friends and relatives and repay in 6 months time. I have planned with my wife to secure a room apartment with at least 60k for 1 year and use the balance to hold ourselves till we get something better doing. This is because I want to relocate to Uyo to hustle with my woman and our only daughter. I can't leave my woman aside and travel to Uyo alone. I want her to join me either in 2 weeks time or 3. She is a stylist and can work as Chef. She is also educated with O'level and I have been taken her through computer lesson's.

Now, I don't have any job assurance in Uyo but I have made some contacts. The 2 person's I contacted said once I relocate, I should let them know to help me get job. Also, I don't mind dropping my certificate just to do any job till I get my dream job. I am also working to get myself a driving license certificate and ID in case, I get a driving job in Uyo.

Pls, I want to know if it's wise to relocate to Uyo without any job at sight?

Also, my current state is one of the worst ever as firms here don't pay there staff good money. Like some pay Accountants here 25k/month to work from Monday to Saturday.

Your ideas will be great. My other areas of relocating is Enugu, Port Harcourt, or Anambra. Pls, help a brother.
