Witness says ex-VP’s company received N100M out of N1bn allegedly stolen by Dariye

...A witness in the Economic and Financial Crimes Commission’s (EFCC) money laundering case against former Plateau State governor, Joshua Dariye has reportedly said that some of the funds involved were transferred to the account of Marine Float Nigeria Limited, a company allegedly owned by former Vice President, Atiku Abubakar.

The EFCC is accusing Dariye of diverting N1.126bn out of the state’s ecological funds.

The witness, an EFCC detective identified as Musa Sunday, made the disclosure at the opening of the case on Monday, January 25, 2016, before a High Court in Abuja, Punch reports.

The N100m paid to the PDP South-West was traced to Marine Float Limited. The mandate we received from the bank showed that Marine Float is owned by a former Vice President of Nigeria, Alhaji Atiku Abubakar. Efforts at recovering this money have been going on. We did not succeed in recovering it," Sunday said.

The case against Dariye was filed by the EFCC in 2007. The former governor is currently a senator representing the Plateau Central Senatorial District.

Foreign agencies are already furnishing Nigeria with information. Think about Mr '22 properties' spread across the US, the UK, and the UAE.


How will the information be used since an account balance does not necessarily mean taxable income?

True, not all the money held in a foreign account by a Nigerian resident is liable to tax in Nigeria. The information will however help the tax
authorities to ask important questions. For example if the FIRS receives information that the balance in your bank account in Singapore
grew from zero to $2million in a certain year, but $0.5million in Nigeria, they would want to know:
where the money in that account came from, if it is from income that should be taxed in Nigeria, and whether you have paid the tax that is due.
Ultimately, the information will help the tax authorities figure out if there might be taxable income that has not been declared in Nigeria.

Common Reporting Standard

The Common Reporting Standard (CRS) is an information standard for the automatic exchange of information (AEOI) regarding bank accounts on a global level, between tax authorities, which the Organisation for Economic Co-operation and Development (OECD) developed in 2014.

Its purpose is to combat tax evasion. The idea was based on the US Foreign Account Tax Compliance Act (FATCA) implementation agreements and its legal basis is the Convention on Mutual Administrative Assistance in Tax Matters. 97 countries had signed an agreement to implement it, with more countries intending to sign later. First reporting occurred in 2017, with many of the rest starting in 2018.

The European Union adopted the CRS on 1 January 2016 after amending the part on administrative cooperation re taxation. First reporting was planned for September 2017.

As of June 2017, the following countries committed to start reporting in 2017:

Now as someone who is directly affected by these new international laws in three different jurisdictions, I am somewhat troubled.
But even I know that the Nigerian Government has only consented to what is now regarded as a 'Common Reporting Standard' (CRS).

...49 jurisdictions began collecting data from 2016, making the first exchange in September 2017. Another 53, including Switzerland, Hong Kong, Singapore, United Arab Emirates, Australia, Canada, Panama and many Caribbean jurisdictions, began collecting data last year, ready to share it by the end of this September.

This automatic information exchange will be repeated every year going forward.

Albania, Maldives, Nigeria and Peru are undertaking first exchanges by 2019/20, and another 43 developing countries are in the pipeline.

Information being exchanged

The information being shared about the financial assets you own outside your country of residence includes your name and address, country of tax residence and tax identification number.

The information to be reported about your accounts includes the investment income you earned over the year (interest, dividends, income from certain insurance contracts, annuities etc.), account balances and gross proceeds from the sale of financial assets.

Reporting financial institutions include banks, custodians, certain investment entities, certain insurance companies, trusts and foundations.

The case of Alhaji Abubakar Atiku was among four other case studies cited under, 'Foreign Corruption and Money Laundering'. His portion gulped a total of 69 pages and is entitled, 'Abubakar Case Study: Using Offshore Companies to Bring Suspect Funds into the United States'.

The trust of the indictment is that the popular politician fondly referred to as 'Turaki' funnelled approximately $40million to the US through his wife, Jennifer.

The finding revealed that Jennifer Douglas Abubakar, a U.S. citizen, is the fourth wife of Atiku Abubakar. The Committee examined how, from 2000 to 2008, Ms. Douglas helped her husband bring over $40 million in suspect funds into the United States, including at least $1.7 million in bribe payments from Siemens AG, a German corporation, and over $38 million from little known offshore corporations, primarily LetsGo Limited Inc., Guernsey Trust Company Nigeria Limited, and Sima Holding Limited.

The report showed that over half of the suspect funds, nearly $25 million, were wire transferred by the offshore corporations into U.S. bank accounts opened by Ms. Douglas. For most of the time period examined, the U.S. banks with those accounts were unaware of Ms. Douglas' PEP status, and allowed multiple large wire transfers into her accounts from the offshore corporations. As, over time, each of the banks began to question the wire transfers into her accounts, Ms. Douglas indicated that all of the funds came from her husband and professed little familiarity with the offshore corporations actually sending her money.

Bank records indicated that Ms. Douglas used most of the funds placed into her accounts to support a lavish lifestyle in the United States, paying credit card bills and household expenses in the range of $10,000 to $90,000 per month, including substantial legal and accounting bills. She also transferred funds to accounts she opened for the Gede Foundation, a nonprofit corporation she established in 2002, and the American University of Nigeria (AUN), a university that Abubakar founded in 2003, and whose name reflects its association with American University in the United States.

An additional $14 million of the suspect funds were wire transferred by two of the offshore corporations, LetsGo and the Guernsey Trust Company, to American University to pay for consulting fees related to AUN. American University officials told the Subcommittee that they understood the funds came from Abubakar and never inquired why the wire transfers were sent by unfamiliar offshore corporations. At least another $2.1 million was wire transferred by the Guernsey Trust Corporation to accounts controlled by Edward Weidenfeld, a U.S. lawyer who provided legal services to Ms. Douglas, Abubakar, and AUN. Mr. Weidenfeld explained that the funds paid for the Abubakars' legal expenses and an account set up for AUN, and that he had assumed the funds came from Abubakar.

The report noted that over the years, questions have been raised about the source of Abubakar's wealth. He spent twenty years in the Nigerian Customs Service, and then worked in the private sector for ten years, before serving as Vice President of Nigeria from 1999 to 2007.

Corresponding facts
The report noted that while serving as Vice President, Abubakar was the subject of corruption allegations relating to the Nigerian Petroleum Technology Development Fund. In December 2008, the U.S. Securities and Exchange Commission alleged in a formal complaint against Siemens AG, a German company, that, among other actions, in 2001 and 2002, Siemens wire transferred $2.8 million in bribe payments to a U.S bank account belonging to Ms. Douglas as part of a scheme to bribe Nigerian officials. In response to this and other legal actions, Siemens admitted to engaging in widespread bribery payments, pled guilty to criminal violations and settled civil violations of the U.S. Foreign Corrupt Practices Act, and agreed to pay over $1.6 billion in civil and criminal fines. Ms. Douglas has denied any wrongdoing, but the Subcommittee has obtained financial records showing the transfer of over $2 million from Siemens AG to Ms. Douglas' account at Citibank.

According to him, in the event where an officer loses his or her original copy of records, the concerned officer must officially apply for copies from the army. He stated that the army responds to such requests in an expeditious manner.

Brigadier Olajide said as a former director of records at the Nigerian Army headquarters, he had seen records of older and retired generals. He added that he was in no doubt that General Buhari’s records were intact.

He alleged he submitted it when he was entering the army though by the defective "quota system" introduced by the northern oligarchy to stuff their unqualified boys into the army.
Meanwhile the only thing he joined the army with is a mere recommendations letter from his then school principal.
He spent just 6months in the then Nigerian Military Training College(NMTC but now NDA).When did he then submit the alleged certificate within that duration that even took him to Mons Officers Cadet School England which he cant reproduce today? We only issue replacement certificates for a limited time (see above). After this time, we issue certifying statements of results. These are an official copy of the final examination results held by OCR and can be used as proof of qualifications gained.

The University of Cambridge Local Examinations Syndicate, UCLES, now Cambridge Assessment, has provided further details on the West African School Certificate, WASC, results presented by Muhammadu Buhari, the candidate of the All Progressives Candidate in the February 14 presidential election.

In a new post on its website, the university confirmed result grades for the examination in 1961 were issued in numbers, not letters, as suggested by critics of Mr. Buhari who have dismissed the results he presented as fabricated.

According to Cambridge, “Examination results were classed in grades from 1 to 9”.

“1, 2,3,4,5 & 6 indicate a Pass with Credit; 7 & 8 indicate a Pass; 9 indicate a Failure,” the school said.

Results tendered by Mr. Buhari shows he had credits in English Language, Geography, Health Science, Hausa Language; failed in Mathematics and Woodwork, and had a pass in Literature in English.

In its post, Cambridge said for candidates to qualify for its certificate in 1961, they needed to pass English, and not necessarily Mathematics.

It is an insult to the armed forces — a terrible insult to the armed forces. If they are so embedded in the system and they have lost their souls, then they can go ahead and join everybody else in castigating a General of Buhari’s calibre. They are now talking about a school certificate. What is that? By the time he joined the army, in those days, there were no cutting corners. It is later when these same civilians took over from the army that admission into it became less transparent. I can give you an instance. There was Course Five around 1964: if one did not have a school certificate one couldn’t apply to join the army. And I know up to 1963 when the last General Officer Commanding left Nigeria, there were no corners to be cut. There was no such thing. Everything was on merit. And, that was how it was till Buhari’s time. Buhari attended the Mons (Officer Cadet School in Aldershot in England) and the Staff College; I don’t want to think they have an idea what they teach in those places. And the rest of us pretend as if we don’t know what they do there. You send a man to America for one and a half years in a military school. Do they think he just went there to learn how to fire a rifle? No.
