1. The Lekki-Ikoyi Link Bridge connects the Phase 1 area, of Lekki with the Ikoyi axis of Lagos.

2. The Bridge spans a length of 1.36 km (635m).

3. The Lekki-Ikoyi Link Bridge is a cable-stayed bridge. It is the first of its kind cable-stayed pylon bridge in Nigeria. A cable-stayed bridge is a bridge in which the weight of the deck is supported by a number of cables running directly to one or more towers.

4. The Bridge has a Height pylon of 50m; and has 37 piers.

5. Lagos State Governor, Raji Fashola awarded the contract for the construction of the Bridge to Messrs Julius Berger on March 13, 2009, while work started on the site on May 11, 2009.

6. The bridge was constructed by Julius Berger Nigeria, though the field service was contracted to PERI Frankfurt (Export Division Nigeria) and PERI Weissenhorn, Germany.

7. The then Governor of Lagos State, Babatunde Fashola commissioned the bridge on Democracy day (29th of May 2013) and the commemoration of his sixth year administration in Lagos.

8. The Bridge was officially opened to the public on June 1, 2013.

9. The bridge has a 9-metre headroom above water level in order to allow for the flow of maritime traffic.

10. The bridge is a toll bridge.

11. The tollgate is located at the Lekki end of the bridge.

12. At inception, the categories of toll paid at the bridge are: Class 1: Saloon cars (N250), Class 11: Mini-vans, SUVs and light pick-up trucks (N300), Class 111: Non-commercial buses with maximum seating capacity of 26 person and Class 1V: Motorcycles with 200CC capacity and above (N100).

13. On Thursday, February 1, 2018, the Lekki-Ikoyi Link Bridge commenced a new price regime. Class 1: Saloon cars (N N300), Class 11: Mini-vans, SUVs and light pick-up trucks (N400), heavy duty trucks/buses with two or more heavy axles will attract N1,000; Motorcycles with 200CC capacity and above (N200), etc.

14. Commercial vehicles (Okada, Keke Marwa, Danfo and vehicles with a total seating capacity exceeding 26) are restricted from using the bridge. Also restricted from using the bridge are heavy-duty trucks and articulated trucks.

15. The bridge also serves as a recreational facility. Fitness enthusiast who reside within the Lekki phase 1 and Ikoyi axis use the wide curbs of the bridge for jogging and running. Even Mack Zuckerberg jogged on this bridge when he visited Nigeria.

16. Tolling at the Bridge has been plagued with controversies. For instance, some Lagosians believe that since the bridge was built with public funds, its use should be available at no cost. However, the Lagos State government argues that the collection of tolls is not only required to maintain the bridge but also to generate funds for building other bridges to link parts of Lagos.

17. The Lekki-Ikoyi Link Bridge provides an alternative route in order to escape the Lekki and Ozumba Nbadiwe traffic gridlocks.

18. The waterway above which the bridge is built is owned and controlled by the Federal Government of Nigeria.

19. During the commissioning, Gov. Fashola paid glowing tributes to late President Musa Yar’Adua for making the project a reality. Fashola referred to the late President as “the first builder of the bridge”.


20. The Lekki-Ikoyi Link Bridge was built at a cost of N29Billion.

Continuing increase in population especially in the urban areas of Nigeria has lead to astronomical increase in the demand for affordable housing whilst the supply side remains for the most part underdeveloped and unable to meet growing demand. Attempts by the Nigerian government to increase investments in the real estate side of the Nigerian economy have remained unsuccessful as a result of the following factors:



a. Expensive, cumbersome and complicated land tenure and transfer of legal title in land procedures.



b. Expensive cost of funds with high interest rates for construction and mortgages in comparison to the long term rentals expected by an investor in the real estate market.



c. Rent control legalisation for the mass residential rental market.



d. High rate of Tenants default in paying their rentals on schedule due in some cases to diminishing purchasing power.



e. Technical, cumbersome and expensive recovery of possession of premises legislations.



The effort of the Federal Government of Nigeria to address this problem by proposing a Rent Control legalisation has met with criticism as a result of the failure of the supply side of the real estate market and also, the failure of prior and subsisting Rent Control legislations and home ownership schemes to address the problems of minimum housing in Nigeria.



This Alert would provide up-to-date legal information on the last two factors of rent control and recovery of possession of premises which have and continue to challenge and inhibit investments in the real estate market.



Rent Control Law



Rent Control is a residual matter under the 1999 Constitution. As a result, most of the States in Nigeria have their individual Rent Control Laws which for the most part have similar provisions as the Rent Control Law of Lagos State.



In Lagos State of Nigeria, the applicable Law is the Lagos State Rent Control & Recovery of Residential Premises Law, 1997 (\"Lagos Rent Control Law\"wink.



The Lagos Rent Control Law is intended to mandatorily regulate the rentals that can be charged for residential apartments in certain areas of Lagos State whose residences were at the time of the enactment of this Law not charging annual rental value in excess of N250,000 (Two Hundred and Fifty Thousand Naira).



This Law prescribes the standard rent for each type of residential accommodation in different locations of the State with the caveat that the standard rent shall only be subject to upward review of not more than 20% every three years or at such other duration as the Governor of Lagos State may prescribe.



The Lagos Rent Control Law makes it unlawful for the Landlord or his agent or the Tenant to demand or pay rent in excess of the standard rent. It is also unlawful for a Landlord to demand or receive the prescribed standard rent for a period in excess of six months from an incoming/new Tenant. Equally unlawful is the action of a sitting Tenant offering to and paying the standard rent in excess of a period of three months in respect of any type of residential accommodation to which the Lagos Rent Control Law applies.



Any person who receives or pays rent in excess of the standard rent that is prescribed by Law is guilty of an offence and liable on conviction to a fine of N50,000.00 (Fifty Thousand Naira) or to a term of six months imprisonment.



Agency & Legal Fees



The Lagos Rent Control Law requires that Solicitors and estate agents must not charge more than 5% as Solicitors fees for preparing Tenancy Agreements and 5% as agency fees respectively. Where a higher percentage of fees is charged and received, it shall be unlawful. The penalty on conviction for this unlawful charge is a term of imprisonment for two years.



Recovery of Possession of Premises



Cases of abuses by Landlords in unlawfully evicting their Tenants necessitated the Rent Control & Recovery of Residential Premises Law of Lagos State, like prior legislations before it, to seek to protect all tenancies to which this Law applies.



The protection afforded tenancies by this Law is not intended to deprive a land owner of the fruits of his or her or its investment in real estate.



The protection only requires that a Tenant should only loose his tenancy after due recovery procedure and processes are complied with by the Landlord.



Where there is a default by a Tenant in respect of any aspect of his Tenancy and the Landlord intends to terminate the Tenancy and have possession of his property revert to him the Landlord, a proper notice to quit must be personally served on the Tenant. This is the first and most technical of the procedures for recovering possession of premises.



The length of notice to be given to a Tenant to quit is usually determined by the tenure of the tenancy where no express unequivocal provision is made in a written Tenancy Agreement to such effect. Thus, where the Tenant pays his rent on a weekly basis, a week\'s notice to quit would be valid.



Similarly, where the rental is paid monthly, quarterly, half-yearly or yearly, a month, quarter or half yearly notice as appropriate would be valid to determine the Tenancy.



It is mandatory that the notice to quit must be issued and served personally on the Tenant. It is also mandatory that the notice to quit must be served to expire at the anniversary or expiration of the Tenancy.



Thus, a notice to quit in respect of a tenancy that begins in January of a particular year and expires in December of the same year must be served on the Tenant on or before the end of June of that year so that from 1st July to the end of December of the same year, the mandatory six months notice would have been properly served on the Tenant. This was the holding of the Supreme Court of Nigeria in the matter of African Petroleum v. Owodunni (1991) 11-12 SC 56 @ 71 lines 5-15.



The inability of most Landlords to comply with the technical requirement of serving the statutory notice to quit to expire at the same time with the tenancy drew the displeasure of the Supreme Court in the above cited case where for twelve (12) years, the Respondent Tenant could not be evicted because the notice of eviction was not properly served by the Landlord on the Tenant.



The view of some Solicitors that a tenancy for a fixed term does not require a notice to quit but only a notice of the owner\'s intention to recover possession of his premises is too risky a position to implement should the matter be placed before a court of law for adjudication.



Unlawful Eviction or Recovery of Premises



The frustration with applying the legal process to evict an unwilling Tenant has lead to many Landlords attempting other unlawful procedures to evict such an unwilling Tenant whose tenancy has been properly determined in accordance with the Rent Control & Recovery Premises Law.



The Lagos State Rent Control & Recovery of Residential Premises Law prohibits any form of demolition, alteration, modification, harassment or molestation of a Tenant where the principal objective is the forceful ejection of the Tenant. Contravention of this provision by the Landlord or his agents or privies is an offence which on conviction attracts a fine of N20,000.00 (Twenty Thousand Naira) to N50,000.00 (Fifty Thousand Naira) and a term of imprisonment of three months.



Business Premises



Up-market residences, that are not listed in the schedule of the Lagos Rent Control Law, with business premises are regulated by the Recovery of Premises Law No. 9 of 1976 (\"Recovery of Premises Law\"wink.



The provisions of the 1976 Recovery of Premises Law are very similar to those of the 1997 Rent Control Law with the distinct difference being that business premises do not have a mandatory chap on what the land owner can charge as periodic rentals. Up market residences and business premises also have a higher rental collection history as opposed to downtown residences. Investors would therefore do well to ensure that all the provisions in relation to recovery of possession of premises are adhered to whenever the situation arises.



Lagos Mediation Centre



The Lagos State Government has established a Citizens Mediation Centre where disputes including those of Landlord and Tenant disputes are resolved through mediation. Where mediation fails or any of the parties refuses to submit to mediation, the parties would be advised by the Centre to seek redress in Court.



Conclusion



The provisions of the rent control and recovery of premises laws in Nigeria have been held more in disobedience than in obedience for many years as a result of the scarcity of new apartments or the maintenance of existing apartments.



The attempt to regulate rental values for properties in Nigeria has reduced the interest to invest in real estate in Nigeria. Research also shows that rent control schemes in other parts of the world that are not indexed against market forces of demand and supply usually do not maintain the minimum acceptable human standards for good housing.



The Nigerian government must review the land tenure system in Nigeria such that the original owners of so-called communal land and private sector investors are able to collectively work towards meeting the developmental goals set for the people of Nigeria.

Fashola con artist commissioned schools, power plants, hospitals, roads, bridges, water works, skills centers, clinics, health centers, largest court building in Nigeria including the best bridge in Nigeria, housing estates and so on in his first 2 years, so why not just list ambode's competent achievements in his first 2 years.

I know a lot of people will cut my head for this.
Before you throw insults, I want you to care fully survey the Lagos terrain and make the comparisons.

Today people still respect Fathshola a lot for all that he did in lagos.
From the federal roads he took up and repaired, to the bridges and bypasses he built some of which include Lekki-Ikoyi link bridge, Okota-Ijesha bridge, Isheri oshun-Ijegun bridge, Opebi bridge, etc and several roads across the length and breadth of Lagos.

In the education sector, rebuilt and repaired countless schools; rebuilt almost all the General Hospitals, expanded the Ambulance services; consolidated on the BRT system and improved on services to the citizens.
His job was made easier because Bola Ahmed Tinubu had laid the foundation for development in most of the areas where he excelled. Today we still appreciate all he did.

Since Fashola has done a lot of worl so far, One will expect that Ambode's work should be even better and smoother to be able to concentrate on the outlying parts of Lagos since Fashola had done quite a lot on the Island and Ikeja axis of Lagos.

Alas he has chosen specific "cosmetic" projects to cover our faces. Oshodi transport interchange, Abule Egba Bridge, Ajah jubilee bridge and the road works in Epe and some other areas are all we have gotten from Ambode so far.
Considering that the state now generate more IGR per month than ever and still increasing, Ambode has not articulately affected the lives of LagosIan with important projects.
Areas in the Festac-Ojo-Shibiri axis up to Oko Afon and on to Badagry are in shambles. Little or no amenities to identify the presence of government.

Alimosho seem to have been abandoned. I carried out a tour from Igando through Akesan, Egan to Ayobo,Abule Egba and all those areas before Sango Ota, and I only came back angrier at the lack of adequate government presence considering the population and relevance of Alimosho LGA. Also areas behind Agege.

There are quite a number of important roads that link these major areas that he should look into to cut traffic along the major roads.
▪ Ago to Jakande Estate
▪ Ije Ododo to Aspamda/ Trade Fair
▪ Ijegun to Lasu-Ibadan Road
▪ Akesan/Igando to Ayobo... etc these are places I know well. I know there are other important areas all over Lagos.

Ambode need to go into these areas and begin serious works there before I can accept that he us really ready to work in Lagos State.

In terms of education lagos state just hired 1500 teachers constructed more buildings and funished such buildings for schools in Command-meiran. abule egba and a host of others, Is it because he does not upload photos like Fashola. As per housing the lagos homs built by Fashola were never handed over to people and Ambode came to clear the back log of houses not awarded.

The Otodo Gbame community in Nigeria’s financial capital, Lagos, celebrated a court ruling on Wednesday that said government demolitions of their homes were illegal.

Residents went to court in October 2016 to protest the Lagos state government’s plan to demolish their waterfront communities on the pretext of cutting crime in the megacity.

The government went ahead with the demolitions in a series of raids across the city that saw security agents bulldoze homes to the ground and in April shoot people with live ammunition.

Judge Adeniyi Onigbanjo, sitting at the Lagos State High Court, on Wednesday ruled that the demolitions were unconstitutional and violated the residents’ rights.

He ordered the state government to hold consultations with the communities before any further evictions and provide compensation for the destruction of their property.

“We are mostly relieved, finally we have a decision,” the residents’ lawyer Omotayo Enujiugha told AFP outside court, where over 100 community members had gathered for the verdict.

“We really appreciate the fact that at the end of the day the judge ruled that rights were violated,” he added.

The case has cast a spotlight on how Nigeria is wrestling with rapid urbanisation and population growth in its major cities such as Lagos, which is home to 20 million people.

It is also being seen as a test of Nigeria’s graft-plagued judiciary, which has a reputation for siding with the wealthy and famous.

The residents have been given legal support from the non-profit group Justice and Empowerment Initiatives.

Its co-director Megan Chapman said: “It (the court) found that any demolition or eviction without adequate notice and provision of adequate shelter or resettlement to another location is unconstitutional.

“They ordered that the government must enter into consultation with the residents if they intend on carrying out any further evictions.

“The court gave a clear court order that no further evictions are allowed until that consultation process continues.”

While the residents acknowledged the Lagos government may still try to go ahead with demolitions in the future, they said they were relieved the court had ruled in their favour.

“I’m very grateful. The fear of our people was that the whole community would be torn down,” said Oladipupo Aireomiye, a 38-year-old living in Ebute Ilaje, a community that was handed its eviction notice earlier this year.

“The judgment gives us hope. At least, for now, we can sleep with our eyes closed.”

A Lagos-based lawyer and multi-talented artiste, Daniella Madudu has accused award-winning Nollywood actress, Stephanie Okereke-Linus of adapting her manuscript into a movie, 'DRY' without authorisation and credit.

In a letter addressed to the actress by Madudu's solicitors, Rafiu Bello & Co, the writer stated that she had granted one Joy Ndidi who worked as Stephanie's assistant and associate, access to her manuscript for her editorial input some years back. She was however shocked to find overwhelming semblances between her manuscript and the plot of the award-winning movie, Dry, on seeing the movie.

A portion of the letter read:

"Our client is a prolific writer, lawyer, Nigerian citizen, domiciled and resident in Nigeria and is the author of the original literary work entitled “BEHIND HER VEIL”  Our client is the owner of the copyright in the inimitable fictional story in the said literary work. BEHIND HER VEIL is one of our client’s many literary works.  Our client had the inspiration to put together the literary work “BEHIND HER VEIL” as far back as 2011.  The quality control process of our client necessitated her having trusted editors and close friends to review the manuscript for suggestions. One of our client’s close friend and confidant who often spent some nights in her room at the Obafemi Awolowo University, Ile-Ife, Osun State, Nigeria, Joy Ndidi, who was chosen as one of the editors, had access to the said manuscript on our client’s HP laptop computer. Our client has known her said friend, Joy Ndidi to be your personal Assistant and Associate for many years.

"In September 2015, some of the editors of our client’s manuscript had drawn our client’s attention to the cinematography “DRY” credited to you and was then being advertised to be shown across cinemas in Nigeria.  The said editors were certain that the cinematography infringed our client’s literary work “BEHIND HER VEIL” which informed the drawing of our client’s attention to it.

"Following our client’s knowledge of the infringement, our client commissioned a team of foreign and Nigerian Information Technology (I.T.) and Intellectual Property experts to investigate and collate data.  The said experts have forensically examined our client’s said laptop and have further confirmed the evidence that Joy Ndidi copied our client’s manuscript.  The copy of the cinematography “DRY” was also made available to this team of experts and they have come up with a SCHEDULE showing substantial particulars of the main semblances between our client’s literary work and the infringing cinematography “DRY”.

"Clearly, there is a case of criminal breach of trust and stealing intended to be pressed against Joy Ndidi for dishonestly taking the intellectual property of our client and converting it to your use in the cinematography “DRY” for yet to be disclosed consideration. BEHIND HER VEIL is the original literary work for the cinematography “DRY” which you have purportedly claimed ownership of the story in the movie.  A substantial part was adapted by you in the said movie. We have our client’s instructions to therefore formally demand that her stolen intellectual received through Joy Ndidi be returned to her honourably by crediting original ownership of the story to our client, including our client as the script writer in subsequent copies of the movie and paying her suitable compensation in the sum of N60, 000,000.00k (Sixty Million Naira) Only  and royalties failing which both civil and criminal actions will be taken against you and Joy Ndidi jointly and severally."

On gaining access to the letter, LAWYARD contacted Mr Rafiu Bello, the principal counsel at Rafiu Bello & Co who confirmed that his firm had been retained to represent Ms Madudu and had contacted the popular actress. Mr Bello added that Mrs Okereke-Linus had failed to respond to the letter written to her.

Mr Bello equally stated that he had the firm instructions of his client to file appropriate court processes following the refusal of the actress to respond to the demand letter.
