“If the ECA had been properly managed, in accordance with the FRC act, the country will not have been embroiled in the liquidity crisis being presently experienced,” he said on Sunday in Abuja during an interactive session with the News Agency of Nigeria (NAN).

Omachi said that the FRC Act stated that savings from the ECA should not be accessed until oil price falls below the predetermined level for a period of three consecutive months.

He said that the sum accessed should be limited to the amount that would bring the revenue of government to the level contained in its budget estimates.

Omachi, supported by the commission’s management team, said also that the other acceptable withdrawal from the ECA was to fund capital projects.

He said that over the years, the commission had noticed withdrawal that was contrary to this and had raised alarm severally at the way the ECA was being brazenly depleted.

“In essence, the non-compliance with the relevant sections of the Fiscal Responsibility Act, 2007, is the cause of the financial management problem being experienced by the country in the light of the sliding oil price.

“If the account had been intact, the effect of declining oil price will have been accommodated with the ECA buffer to finance the budget,” he said.

Hajiya Maryam Mohammed, the Commission’s Head, Planning, Research and Statistics, said there was need for synergy between the Federal Ministry of Finance, Budget Office, Office of the Accountant-General of the Federation and FRC.

Mohammed said that this would enable efficient monitoring and control of all revenue generation and expenditure in the country.

She said that it was lack of synergy that has created loopholes where revenue generating agencies practice creative accounting in order to short-change the government.

Speaking, the Head, Monitoring and Evaluation, FRC, Mr Ola Tijanni, said the recommendation of the Orunsaya report and the White Paper approval to scrap FRC was hampering the work of the commission.

“The FRC has been monitoring schedule corporations in the area of preparation of MTEF, rendition of audited accounts and payment of 80 per cent of their operating surplus to the government consolidated revenue fund.

“In 2013, due to acceptance of government to scrap the FRC, remittances of operating surplus rather than increase, dropped drastically as most agencies are no longer disposed to cooperating with the FRC.

“In light of the foregoing, we make bold to suggest that rather than being scrapped, the FRC should be strengthened and empowered to diligently enforce the provision of the FRC Act,” he said.

It would be recalled that Governor Nasir El Rufai of Kaduna state also stated that the ECA was created by the government of Chief Olusegun Obasanjo for the ‘rainy days’.[/quote]

The FAAC was also informed in Early december when about $1billion was withdrawn and again informed in early January after another $1billion was withdrawn. Sometimes you people can be funny. Which laid down law was broken? Which Code of Conduct? No law was broken....If any, state the law! Were they aware of the withdrawal or not? Yar'adua in 2009 opted for out of court settlement. By end of 2009 it had dropped from $15billion to $6.5billion.

January 2010:
When Jonathan was made "overseer" during the vegetable state of Yar'adua in December 2010, the Governors insisted that the $6.5 billion ECA be shared. In January 2010, President Jonathan Goodluck acceded to the governors' and agreed to share $2 billion from the ECA.
May 2010:
Jonathan also approved additional deduction of N339.627 billion from the account to augment arrears due to the three tiers (Federal, State and Local Governments) in May 2010.
July 2010:

At the end of November 2014 the Accountant General of the Federation informed FAAC and Nigerians that the ECA was $3.11billion and in January 17 2015 the balance was announced to be $2.4billion. $1 billion was deducted in November and another in December 2014. The Governors were well aware including Mr. Adams Oshiomole.

When the GEJ's government made the said announcement in January this year nobody said a word. Yesterday Madam NOI said the Former President approved the withdrawal of the $2billion to as part of subsidy payment, is it not in line with the FG position in November 2014? I want to appeal to Nigerians to watch this APC administration very carefully. According to the law setting up the FAAC, which pre-dates the ECA, it cannot approve withdrawal and has not done so in the past. If anything the FAAC, as records of it meetings indicate, had often queried the activities on the ECA, and therefore did not decide any withdrawal,” the statement reads in part.

The commissioners stated that “indeed, the FAAC noted and observed accordingly the withdrawal from the ECA of a total sum of $2 billion in December.
“The then minister of finance and chairman of the FAAC when asked during the plenary of the FAAC meetings of the respective months explained that the former president gave approval for the withdrawals from the ECA to pay oil marketers subsidy claims as they had threaten to stop importing petroleum products. There is a much wider picture unfolding here which the Nigerian people have yet to see and which they find difficult to accept, understand or comprehend. There is a hideous and frightful hidden agenda which is slowly manifesting before our very eyes. Though we warned them, the Nigerian people wanted "change" so they must live with the consequences of their choice.

One of those consequences is the new-found audacity, courage, growing power and rising strength of Boko Haram. Another is the resurgence of a clearly ethnic agenda which is designed to leave no-one in doubt about who really owns Nigeria and who the slaves are.

Another is the destruction and demystification of Bola Tinubu and his yoruba loyalists by his erstwhile northern allies in the APC. Only a fool did not see that one coming and I am rather surprised that Tinubu's followers are now crying foul and alleging that there is a northern conspiracy. Didnt they know that before? Were they not warned over and over again?

There are many other grave consequences which the Nigerian people will witness, in a most harrowing and frightful manner, in the next few months and years. May God deliver our people and our nation and may we learn to make the right choices.
