THE Federal high court 2, Enugu presided over by Justice D.V. Agishi of the Federal high court Enugu, yesterday disqualified itself from the continued trial of the eleven members of pro-Biafra group, Biafra Zionists Federation (BZF) facing treason trial before the court.

When the case was called up yesterday, Justice Agishi said that "in view of the fact the accused have accused me of bias, the case file has been transferred to the Chief judge of the Federal high court to assign the case to another judge".

The accused persons led a legal practitioner, Mr. Benjamin Onwuka had earlier before yesterday's sitting, addressed a letter to the Chief Judge of the Federal High court Abuja, seeking for transfer of the case from the court.

In that letter dated 23th of June 2015, reference number OAO/1/6/15, whcih was signed by a lawyer from Omotayo & Associates chambers in Enugu, Mr. B.N. Chukwu gave a vivid account of what led to the demand for the transfer of the case.

The eight-paragraph letter reads:

*Our clients were arraigned before the Honourable Court on the 19th day of November 2014 and charged for conspiracy and treason.

*That on the 19th day of May 2015, after the cross examination of PW3, the prosecuting counsel made application to the court pursuant to Section 203 of the Criminal Procedure Act to bar the members of the public from subsequent hearing in the matter in order to bring in some witnesses.

The defence counsel opposed the application on the ground that the said section is subject section 204 and 223 of the Criminal Procedure Act and section 36 of the 1999 Constitution of the Federal Republic of Nigeria as amended.

On the 10th day of June 2015, the court delivered its ruling and granted the application excluding the members of the public and the press from subsequent hearing of the case.

Our clients in the open court raised up their hands and when granted leave to speak by the court observed that the Judge was biased against them since the trial started as the Lordship had granted all applications made by the prosecution including the last one barring the public from the trial without legal authority or basis

Our clients maintained that they no longer have confidence in the Judge and would not like their trial to continue before the court because the court with his disposition has already made up his mind to convict them before hearing their testimony.

Our clients have even instructed us to withdraw our appearance from the trial because they believe that they cannot get justice under such secret trial procedure as that would infringe on their legal and constituted right to fair hearing.

We do not have personal grievances with the Learned Judge but where the accused persons alleged bias or lack of confidence on the trial Judge, it is in the interest of justice that the judge disqualifies himself from the trial and transfer the case to the registry for re-assignment to another judge.

In view of the forgoing, we humbly urge your Lordship in your wisdom to in the interest of justice urgently transfer this case to another judge

FG appoints Ladan to oversee DPR

The Federal Government has appointed Mallam Mordecai Danteni Ladan, to oversee the activities of the Department of Petroleum Resources, a statement posted on the website of the DPR on Monday stated.


According to the statement, Ladan is to take over from the former DPR Director, Mr George Osahon, whose tenure elapsed on June 19.


It said that a memorandum dated June 19, stated that the appointment was with immediate effect.


Ladan, according to the statement, is a Petrochemist by profession, who joined DPR in Nov. 23, 1987 as a Senior Analytical Chemist.


The statement said that Ladan was deployed to the Safety and Environment Branch under the then Technical Services Division.


It said that Ladan rose through the ranks to occupy various key positions within the organisation, including Zonal Operations Controller, DPR Kaduna.


According to the statement, Ladan, having attained the rank of Deputy Director, was appointed Head, Downstream Monitoring and Regulation Division in Oct. 2005 to June 2013.


He was appointed Head, Gas Monitoring and Regulation Division in June 2013 to May 2014.


He later became the Head, Safety, Health and Environment Division in May 2014 until his recent appointment.


“Mr Ladan is highly accomplished both professionally and academically; he is Fulbright Scholar (Hubert H. Humphrey, North-South Fellow) where he bagged a Certificate in Environmental and Regulatory Policy / Public Affairs June 1991.


“He bagged M.Sc. Petrochemicals & Hydrocarbon Chemistry from the University of Manchester Institute of Science & Technology, UK March 1986.


“He also has a B.Sc. (Hons) in Chemistry from the Ahmadu Bello University, Zaria July 1982; West African School Certificate from the Federal Government College, Kano June 1978.


“He was born on the June 24, 1957 and is married with children,” it stated.


However, Ms Dorothy Bassey, the Head Public Affairs Unit, DPR, in a telephone interview with the News Agency of Nigeria on Monday said Ladan appointment will take effect immediately

BORNO State governor Kashim Shettima has nominated the principal of the Government Girls Secondary School (GGSC) Chibok Hadjiya Asabe Kwambura as the new commissioner for education.
In a surprise development, Governor Shettima has forwarded Hadjiya Kwambura's name to the Borno State House of Assembly. She will now be screened by the house and if approved by its members, will assume office as the new Borno State education commissioner.

Hadjiya Kwambura was the GGSS principal when Boko Haram abducted 234 pupils from the school in April last year in the middle of the night. Although she was not on campus at the time of the abduction, having travelled to Maiduguri for a medical check-up, Hadjiya Kwambura was informed on the night and informed about the kidnapping.

She later went to see President Goodluck Jonathan in Abuja to brief him about the abduction, where she held a press briefing with his wife Patience. It was Hadjiya Kwambura who revealed that the kidnappers were disguised as soldiers and convinced the girls that they came to protect them from Boko Haram insurgents but by the time they discovered that they were not security men, it was too late.
