1. A landlord has no power to increase rent to the tenant without agreement by both of them.

2. A tenant can refuse to pay any increase in rent imposed by his landlord without discussion and agreement.

3. Where government prescribe standard rent for some particular areas, the landlord should not accept any rent from the tenant that is more than the amount of money prescribed by the government.

4. In those areas that have standard rent prescribed by the government, the landlord and the tenant cannot agree on any rent that is more than the prescribed rent.

5. But where there is no government prescribed standard rent, the landlord and tenant can agree on any amount as rent.

6. A tenant is empowered by law to recover unlawfully increased rent from the landlord.

7. Any rent paid to the landlord in advance is a mere loan to the landlord. And if the building is sold to a new landlord before the rent paid expires, the tenant should go to the former landlord to collect his balance.

8. In a situation where a tenant has paid rent in advance, the landlord cannot lawfully serve him with notices and eventually eject him before the expiration of the time he has paid. However, the landlord may succeed to eject him if he has breached the tenancy agreement or has converted the accommodation to brothel.

9. If a tenant has been paying rent to a landlord, he cannot later claim that he is not his landlord.

10. If a landlord wants to use thugs or police to force a tenant out of his lawful accommodation, the tenant should immediately brief a lawyer who should go to court to obtain an order to stop the landlord from implementing his plan, that is to use self-help or thugs to force the tenant out.

11. Usually an average court would grant such application to stop the landlord from using crude or unlawful system to eject a tenant from his lawful accommodation.

The Minister of Power, Works and Housing, Mr Mr Babatunde Fashola, has inaugurated 100 housing units in Ogbomosho, Oyo state, a project funded by the Federal Mortgage Bank of Nigeria (FMBN).

On Friday during the inauguration of the housing unit, Fashola said meeting the housing needs of Nigerians was a major priority of the Federal Government.


He commended the bank, the developer and other stakeholders, who contributed to the completion of the project.

He said, the Federal Government embark on the housing programme to meet the housing needs of Nigerians and create employment for Nigerians executing the project.

He said the FMBN had since the beginning of the current administration in the country contributed immensely to efforts being made to address the housing needs of Nigeria.

In his remarks, Mr Richard Esin, the Acting Managing Director of the FMBN, said a construction loan of N561.2 million was advanced to the developer, Viva Construction Ltd, to deliver the 100 housing units.

This is not a logical question, but one has to be logical about it. Apparently majority will prefer to live on the Island because it is
known for it's luxurious houses and it is also the home of Lagos big boys and girls not forgetting our celebrities to name but a few.

Perhaps you might reconsider your option after reading this article because I will outline some points you have not been paying attention to just because you crave for luxurious satisfaction.

Firstly it isn't new that more than 70% of the lands on the Island was as a result of land reclamation. This results to lack of proper drainage system causing flood in every nooks and crannies of the Island. Let's look at the new Atlantic City which was formerly Bar Beach. What do you think would be the fate of that location in years to come as it is an artificial land.

Also the new Atlantic City will definitely have an adverse effect on surrounding areas if the land was not properly reclaimed?



Secondly, the cost of getting a home on the Island is on the high side but yet most people prefer to pay too much for too little. You can find out how much it cost to get an apartment from your real estate agent then you can compare and contrast.

Thirdly, some people will say once they have an apartment on the Island the would have nothing to do with the Mainland. Please do not forget staying on the Island would not change the effect of the present situation of the country rather it will increase your standard of living.

Traffic on the Island is something you should consider also, certainly, traffic in Lagos is inevitable but the Mainland has lot of alternative routes.

Another point to consider is water, the Island is filled with water but it is not consumable because it is salty unlike water on the Mainland. Apparently, you know the reason behind that.

If you intend on living on the Island then you must have a good and steady source of income so you can meet the demand of your day to day life on the Island.

No doubt, living on the Mainland has its own inconveniences but the fact that 90% of the Mainland is dry land is enough reason to have a home on this part of the city. Moreover any structure that can be erected on the Island can also be erected on the Mainland location is the only distinguishing factor.

The Recovery of Premises or the Rent Control and Recovery of Residential Premises Laws all over Nigeria, is to ensure
that if a tenant should be ejected from the Landlord's property, it must be according to the law.

1. Any landlord or Agent who demolishes, alters or modifies a building in order to force a tenant out of his rented accommodation, without an order of court, can be punished with imprisonment or fine or both.

2. A tenant can claim damages against the landlord who throws away his belongings or goods, with false affidavit that the tenant has abandoned his flat or shop.

3. Abatement notice from government to landlord to repair or demolish his building is not enough to force a tenant out of his rented accommodation. Notwithstanding the government abatement notice, the landlord is required to serve the tenant with necessary notice and to obtain court order for the ejectment of the tenant.

4. Even where a tenant's rented accommodation is an illegal structure, the landlord should not use self-help or thugs to force the tenant out of his building, otherwise tenant can claim damages against him.

5. Whether you are president, governor, commissioner, local government chairman or any government official, you should not use thugs or area boys to throw away a lawful tenant and his properties out of government building or land, otherwise the tenant can claim a lot of money for damages suffered. Unfortunately, it is the government that pays the damages.

6. A landlord should not use police or soldiers to force a tenant to pay rent or pack out. Whether the tenants are in arrears of rent for 3years or is a "bad tenant" the landlord is required by law to serve the tenant with the required notices. If he proves stubborn or refuses to pack out, the landlord should take the matter to court and obtain an order to ejectment or pack out order against the tenant.

7. A landlord with his hired thugs breaking into tenant's rented accommodation in his absence or presence and throwing away his belongings or properties is wrong. It is trespass to the land and chattel.

8. It is not permitted by any of our laws in Nigeria, to remove tenant's door, window or roof because he refuses to pack out or because he fails to pay his rent.

9. Courts in Nigeria held that, one of the worst wrongs, a person can commit against another person is to deprive him a roof over his head by force, and not by law.
