Reports reaching News9naija indicates that the Former Governor of Kano State and Senator representing Kano Central Senatorial District, Mallam Ibrahim Shekarau is in fresh trouble over N950m Peoples Democratic Party (PDP) fund.

The Federal High Court sitting in Kano on Monday, struck out the no-case submission filed by the former governor of Kano State, Ibrahim Shekarau, challenging his alleged N950 million money laundering trial.

The EFCC, arraigned Shekarau on May 24, 2018, alongside former Foreign Affairs Minister, , Aminu Wali and one Mansur Ahmad on six counts bordering on conspiracy and money laundering to the tune of N950 million.

Delivering his ruling, Justice Lewis Allagoa, held that the EFCC has made out a prima facie case against the defendants, warranting that they must defend themselves.

“I have considered evidence by the prosecution against the defendants, it is sufficient that they have case to answer and defend themselves,” he said.

Allagoa adjourned the case until Nov.18 and Nov. 19, for defence to open its case.

Earlier, Counsel to Shekarau and two others, Mr Dauda Abdulrahman, and Mr Abdul Adamu, on July 9 filed a no-case submission.

Adamu said EFCC failed to present a prima facie case to warrant the defendants entering defence and urged the court to discharge his clients.

Counsel to the EFCC, Mr Johnson Ojogbane, had earlier told the court that the defendants, between March 26 and March 27, 2015, conspired among themselves and received the said amount without going through financial institutions.

He said that the money was issued to the defendants by the Peoples Democratic Party and former petroleum minister, Diezani Allison-Madueke.

The prosecutor said that the offences contravened Sections 18 (a) of the Money Laundering (prohibition) Act, 2011 as amended and punishable under Section 16 (2)(b) of the same Act and Section 15(1) of money laundering Act.

The defendants had pleaded not guilty to the charges.

NAN reports that the defendants were earlier granted bail in the sum of N100 million each with two reliable sureties in like sum and during the course of trial, the prosecution called four witnesses and closed its case on May 8.

PoliticsBuhari Unfolds Plans To Reverse Climate Change In Nigeria by Apeshy102(op): 9:40pm On Sep 23, 2019
President Muhammadu Buhari on Monday in New York announced robust plans and initiatives by his administration to reverse the negative effects of climate change in Nigeria.

A statement by Mr Femi Adesina, the President’s Special Adviser on Media and Publicity, in Abuja, said the plans were revealed in his address to the United Nations Climate Action Summit with the theme, “A Race We Can Win. A Race We Must Win.”

While sharing the sentiment expressed by the UN Secretary-General that the world is on the verge of climate catastrophe, President Buhari stated that ”undeniably, Climate Change is a human-induced phenomenon.”

He, therefore, stressed the need for Member States to step-up their collective climate actions in line with the request of the Secretary General.

”It is in this regard that I wish to reiterate Nigeria’s commitment to its obligation under the Paris Agreement, the aspirations enshrined in our Nationally Determined Contribution (NDC) and ensure a resilient future that mainstreams climate risks in our decision making.

”I want to announce that the Government of Nigeria will develop a more robust sectorial action plan, and expand the scope of our Sovereign Green Bonds in line with our intended upward review of Nigeria’s NDC’s towards the inclusion of the water and waste sectors by 2020,” he said.

On the water sector, President Buhari revealed that Nigeria would issue a Green Bond for irrigation and construct multi-purpose dams for power, irrigation and water supply.

He said : ”We will strengthen solid and liquid waste management systems to attract more private sector investors.

”We will take concrete steps to harness climate innovative ideas by including youths in decision making processes as part of our over-all climate governance architecture.

”We will mobilize Nigerian youths towards planting 25 million trees to enhance Nigeria’s carbon sink.”

The Nigerian leader also disclosed that Nigeria had embarked on diversification of its energy sources from dependence on gas-powered system to hydro, solar, wind, biomass and nuclear sources.

According to him, Nigeria is progressively working to realize 30 percent energy efficiency and renewable energy mix by 2030, saying this is envisaged to lead to 179 million tons of carbon dioxide reduction per annum by 2030.

”In addition, our Administration intends to develop a shelter belt across 11 States of the Federation spanning a distance of 1,500 km and 15km across through the Great Green Wall initiative.

”Furthermore, the Federal Government has commenced the implementation of the Hydrocarbon Pollution Remediation Programme in Ogoniland, to recover the carbon sink potential of the mangrove ecosystem of the one thousand square kilometers (1,000 KM2) polluted site in the affected area.

”I should also inform the summit that our Government has introduced Climate Smart Agricultural Practices to unlock Seventy-Four (74) Million tons of carbon dioxide per annum, through relevant technologies, advocacy and best practices,” he added.

President Buhari also noted that the Lake Chad Basin, which used to be a region of productivity, food security and wealth for an estimated 40 million citizens living around the Chad Basin, had shrunk significantly from its original size due to Climate Change.

He pledged that the member countries of the region would continue to lead in efforts to have solid partnerships for the ecological restoration and recharge of the Lake.

”We are confident that this would improve the living conditions of the diverse nationals living in the area, promote inter-state cooperation, strengthen community resilience, as well as assist in addressing the environmental and security crisis that threaten the region, its resources and inhabitants.

”Finally, permit me to add that the forty million citizens in the Lake Chad area expect this Summit to take into consideration their concerns.

”They anticipate that the outcomes of this meeting would include solutions to address the Climate Change impact in the Lake Chad area.

”I am glad that the Secretary General and some of the member states represented in this hall are partnering with us in this endeavor,” he further maintained.

President Buhari on behalf of the member countries of the Lake Chad Basin thanked them for their cooperation, saying he looked forward to deepening their partnership.

Politics$9.6b Judgment: Reps Summon Malami, Sylva by Apeshy102(op): 8:49am On Sep 19, 2019

ATTORNEY-GENERAL and Minister of Justice Abubakar Malami and Minister of State Petroleum Timipre Sylva have been summoned by the House of Representatives over the $9.6 billion judgment debt against the country in the United Kingdom.

The angry lawmakers took the decision at plenary on Wednesday after deliberating on a motion of urgent national importance moved by Prof. Julius Ihonvbere.

The House observed that “this embarrassing judgment exposes a deep decay in our governance and leadership infrastructure with far-reaching implications for the credibility of the country’s capacity to handle business and legal cases.”

It mandated a 17-man ad Hoc Committee to invite the ministers and other government officials that are connected to the deal.

According to the Green Chamber, the minsters are to give report on the huge cost awarded in favour of Process and Industrial Development (P&ID) Limited, and explain the lapse in judgment of time and due diligence in the handling of the case with a view to finding lasting solutions to the avalanche of extant and future cases.

The lawmakers are also to invite other officials of the ministries, saddled with the responsibility to negotiate the agreement with P&ID and the prosecution of the matter before the tribunal.

The committee is headed by a Katsina State All Progressives Congress (APC) lawmaker Sada Soli.

The resolution was sequel to the passage of a motion sponsored by Ihonvbere.

Ihonvbere noted that the $9.6 billion (with daily interest accruing) by a commercial court in the United Kingdom (UK) against Nigeria, “leaves a very sour taste in the mouth.”

He said for a country with a foreign reserve of only $45 billion and a sovereign debt profile of over $80 billion, the judgment debt is not only punitive but would devastatingly affect the economy.

The lawmaker said: “Aware of the fact that Nigeria has a penchant for disregarding the sanctity of contracts and terms of agreement, coupled with the failure of Nigeria’s representatives in many cases, to carefully or diligently scrutinize agreements they sign knowing that the consequences will affect past and future generations.

“Aware also that Nigeria had entered into a Gas Supply and Processing Agreement (GSPA) with P &ID Limited, in January 2010, through the Ministry of Petroleum Resources with the understanding that Nigeria would supply natural gas (wet gas) at no cost, through a government pipeline to P&ID’s production facility, while P&ID in return would construct and operate the facility, process the wet gas and return to the government of Nigeria lean gas for the generation of power at no cost to Nigeria.”

He noted that two years down the line, P&ID had not built any gas plant to which Nigeria could supply wet gas for processing, signifying in the first place that the move to Arbitration was opportunistic and grossly self-serving.

Ihonvbere said: “Cognizant of the fact that, the matter went before an Arbitration Tribunal, under the Rules of the Nigerian Arbitration and Conciliation Act 2004, with London, England as place of Arbitration.

“After affirming its jurisdiction in the matter, the Tribunal began hearing to determine whether or not there were any repudiatory breaches of contract. At this point, there was an attempt by the Ministry of Petroleum to reach a settlement agreement with P&ID Limited to the tune of $850 million, payable in installment which obviously was not diligently pursued.”

Ihonvbere expressed concern that the agreement was somewhat shrouded in secrecy and as such apparently dubiously procured, “as those who ought to know about its existence did not and more importantly, the relevant laws in Nigeria for the transaction to be consummated was not applied especially, Part IV of the Bureau of Public Procurement Act 2007 which deals with the fundamental principles of procurement.”

According to him, it was alarming “that it took the new government more than four months to respond to the vital arbitration judgement of about $9.6 billion with a ridiculous excuse that there had been a change of administration in Nigeria and that ministers, including the Attorney-General had only just been appointed thus asking for an extension of time to act on the outcome of the arbitration tribunal.”

He said it was equally alarming that, rather than engage P&ID in the matter before the tribunal with robust legal arguments and interpretations; Nigeria was busy shopping for a favourite forum to plead her case in a court in Lagos, Nigeria.

The ad hoc committee is to recommend appropriate sanctions where necessary without fear or favour or preference for status in line with Order 14 of the Standing Orders of the House.

It will also initiate a process of reviewing all agreements and treaties signed by Nigeria through the appropriate committees to create opportunities to discover anomalies and avoid a repeat in the future.
