Mschew undecided

You gave someone contract to clear vehicles for you and paid a fraction of the costs

He cleared it successfully and kept it for you in his warehouse to pay up the balance and collect your property

You defaulted and didn't pay the balance

The vehicles were kept in storage from 2021 till 2024, blocking useful space and attracting heavy demurrage fees which you also couldn't pay off

Now vehicles were auctioned off to cover for delayed and accrued service and demurrage costs

You vex go call police undecided

Okay, let's see how this case ends cool

Assuming what you stated is what happened, do you not see how E-Money is clearly guilty? Is there an agreement for him to auction the goods or did he get a Court order to do so? Have you not seen cases where Landlord cannot simply break door and remove the properties of a tenant whose rent has expired without a Court order?

Bolaji Ariyo is a nice and good man...
The ball is in Umahi and FG's court to start and complete the project on time..

I presume it is the same Bolaji Ariyo who is a former Local Government Chairman of Oshodi. Being a politician in Lagos under the Tinubu umbrella, it is simple wisdom for him to align with his boss

I will be pleasantly surprised if Tinubu completes the Lagos - Calabar Coastal Highway even if he goes another term.

I believe the rush serves the purpose of securing the beachfront for the Eko Atlantic Project which is also operated by the Chagoury owners of Hitech Construction. Sandfilling and development of the beachfront areas covered have been in the Phase 4, 5 and 6 of the Eko Atlantic Project Development Plan ans auppoaes to have been executed 10 yeara ago.

However if any attempts have been made then to take over the beachfronts under a private project, there would have been uproar and even possible litigation. Getting an opportunity to tag it to a National Interest project in the Coastal Highway gets for the Chagoury and the Eko Atlantic Project what they have been unable to get in the last 10 years. That is why the Honourable Minister let it slip when he said and I quote:

“I have directed that the beach should be shut down for tomorrow and there is no beach. The place is owned by people who are sand filling it, and at the end of the day, there is no more beach."

The place is owned by the Chagoury who are sandfilling it. It is that simple. Even if the Coastal Highway Project stagnates outside Lagos and does not get completed, the Chagoury would have completed their Phases 4, 5 and 6 of the Eko Atlantic Project while hiding under the guise of public good.

Anyway, the offenders may have been recalcitrant and infuriated the Magistrate.

In what way are journalists being harassed?

Any journalist that creates and spreads fake stories will be arrested and that is the law all over the world

The law says the Police cannot hold you for more than 24 hours without charging you to Court. It is harassment and illegality when the Police holds a journalist based on purported crime and refuse to charge him to court after 24 hours. You cannot claim to be law abiding when you choose to obey only the laws that suit your purpose.

Operating an investment business without licensing or registration with the Securities and Exchange Commission (SEC) is a violation of the laws of the country. What he was doing was illegal.

If he was investing his own money by his own hands, there is no issue with that. But when you start collecting money from others to invest, then you are running an investment business. And that is not allowed by the law for a Civil or Public Servant.

I earlier insinuated that the arrest was a smokescreen.

The case is a criminal case and the offense is not against a person but the Federal Government. So the "out of court settlement" only refers to them working out a plea bargain between EFCC and the accused so there won't be need for long trial. The defendant may end up getting a suspended sentence or a more lenient sentence like a fine of 50K which is the minimum punishment recommended by law. To expect that he will walk free with zero punishment is a tall dream.

They will still have to bring the teens of settlement back to the Court for the Judge to agree and adopt.

The hotel is liable in this case. Why would you allow a minor that is not supervised by an adult into your pool area? Imagine their lawyer saying the boys rejected life jackets:

1. That statement confirms the hotel collected money and granted the minors unsupervised into the pool area.

2. In furtherance of the negligence of the hotel, they refused to deny access despite lack of adherence to safety regulations at the pool.

The woman should contact Falana or any of these popular lawyers and sue the hotel. In fact the police should have taken up a case of criminal negligence and manslaughter or culpable homicide against the Hotel Manager that allowed the kids to swim.
Politics / Re: Landmark: The Ocean Would Have Eroded The Beach Without Eko Atlantic - Dr Toks by Babinski: 12:35pm On May 01
Macphenson:
There are certain questions begging for answer as regards the Lagos Calabar coastal high way, and by extension the situation of landmark and other property owners that will be affected.

First and foremost, there was an initial road design, which property owners around that area followed and observed before erecting their structures.

All of a sudden, there was a change in design. Land Mark was given a seven days notice which was later extended to 14 days. This change in design is going to cost govt more because compensations will be paid to property owners that will be affected.
secondly, there will be great loss of jobs as businesses will be destroyed. The initial design avoids these unnecessary demolitions and saves the govt billions. Jobs will also be saved, why is govt embarking on this frivolous spending and wrecking of businesses when there is a better alternative?

The cost of the project and the way it was awarded is also an issue of National concern. The project cost is at #4 Billion per kilometer. Total cost is about #16 Trillion. The entire 36 states budget is about #14 Trillion. Already about one trillion naira has been paid to HITECH.
How are they going to source the #16 Trillion Naira? Govt has given conflicting addresses on the source of funding for the project.

Why spending the #16 Trillion Naira on a new project when there are already existing roads like the east west road that is calling for serious attention which still serves the same purpose.

Why is the project starting only in Lagos? Shouldnt it be starting at different phases like Cross River and Delta state to expedite the execution?

A lot of things are not making sense about the project.

It is difficult to argue against the Government taking over land for public good as long as the land owners are properly compensated. However, my fear about this whole issue is the possibility that after destroying properties in the name of a Highway for public good, the Highway becomes an abandoned, incomplete or delayed project such that the public good that should come becomes an illusion whereas lives have been damaged and huge public fubds expended without results. And that possibility is strongly there because of the following:

1. There appears to be more of the desire to start work rather than evidence of thorough planning regarding the Highway project. Have all rights of way been secured? Is the total project cost known? I find it curious that the Minister is talking about the toll charges at completion yet evasive about total project cost.

2. Eko Atlantic going by the master plan and phases in the development, is at least 10 years behind schedule. Phase 4, 5 and 6 should have been completed by 2015. Yet it is the same HITECH owners that are behind Eko Atlantic Project that have been awarded the Highway Project. That is not reassuring in any way.

3. HITECH Construction appear not to have good records particularly from projects executed by HITECH in Lagos like the Lekki road which was reportedly not completed and had to be concessioned. They are perceived as incompetent and nowhere near the standards of Julius Berger.

Religion / Re: No Prophet Married Only One Wife In The Bible - Olatosho Oshoffa by Babinski: 6:44pm On Apr 28
thesicilian:

It's the same story bro. The Bible does not condemn polygamy. Polygamy is the teaching of man. If it was that important, Jesus would have taught about it.
A lot of the disciples taught what they thought was right, not what Jesus taught them. At a point (Acts 10) God had to personally come down from heaven and correct Peter about the issue of unclean meat and refusing to preach to the gentiles.

What makes polygamy a sin? That a man pays the bride price of 2 or 3 women according to tradition, before taking her home with the consent of her parents, why should there be any law against that?
Is that not what we were practising before the white man came? Are you saying all our ancestors who practised polygamy will go to hell? But that David, Abraham, Jacob etc will all be in heaven?
What kind of logic is that?

If you're going to convince me that polygamy is a sin, you'll have to show me where it was expressly condemned.

Marriage is not an institution invented or started by man; it is an institution ordained by God. God made marriage and he made it with the plan being very clear and unambiguous: it is a union between a man and a woman. Genesis 2:21–22; Genesis 1:27-28.

In Genesis 1:23-24 it said the woman was bone of the man's bone and flesh of his flesh and “For this reason a man shall leave his father and his mother, and be joined to his wife; and they shall become one flesh”. Note that the joining is to his wife AND NOT to his wives.

Jesus while speaking about divorce in Matthew 19:5 reiterated that "so they are no longer two but one flesh". Note that it is no longer TWO but ONE flesh and not no longer MANY but ONE flesh..

So it is clear from the Bible that God's plan for marriage is one man, one woman. That Prophets in the Old Testament had many wives was not in obedience to God but only at best within his permissive will. That several "Men of God" in the Old Testament had multiple wives points to one of the factors that underlie the weakness of the Old Covenant and the need for the New.

God has never showed any liking for polygamy despite being generally silent through the Old Testament on the issue. In fact in Deuteronomy 17:17 when talking about requirements for the future King of Israel, God specifically warned that he (the King) should not acquire many wives.

For a fact, in all biblical accounts of men having multiple wives, there was conflict. From Abraham to David to Solomon. It is indeed polygamy and not monogamy, that it is an invention of man and we can all see the effects even through the Bible.

There are practices that are customs of men and not God and polygamy as well as divorce are some of them. That was why in respect of divorce in Matthew 19:8-9 despite arguments that it was permitted, Jesus made it clear that it was not the original plan of God.

And Paul's positions in the New Testament clearly correspond with God's plan for marriage. So claims that these are simply the opinions of Paul are weak and self serving. In fact, for a "Christian" to say that monogamy is not Biblical shows the level of understanding of the scriptures for such a person.

Amidst the the ongoing EFCC saga and media onslaught against the former governor of Kogi state, Yahaya Bello, a viral letter shows how the former Governor returned surplus funds to the world bank, to the tune of 4.6million US Dollars.

This amongst other reasons earned the former governor accolades allowing other states opportunities to benefit.

Recall the world bank had on numerous occasions awarded Kogi as number one in multiple awards for transparency and fiscal responsibility.

The question now is, if the governor was this transparent with public funds, what then must have resulted in EFCC’s pursuit and media trial, leaving out other governors who have been previously accused? The personal focus and attack on Yahaya Bello may have a political undertone and an agenda yet to he revealed.

Read the letter the World Bank wrote him below;

July 14 2021
His Excellency
Mr. Yahaya Adoza Bello
Exccutive Governor of Kogi State
Office of the Governor
Government House
Lokoja, Kogi State

He should present it to the Court for considerations during his trial and sentencing. But he should focus more on explaining to the Court what happened to the monies budgeted for salaries of Kogi State workers that he refused to pay in full and explain how he acquired his many properties and paid US$845,000.00 (Eight Hundred and Forty Five Thousand Dollars) for his kids schools fees ahead up to 2035 and even for a kid yet to get into the school!

At the end of the day I cannot see how you can convict Gambaryan for something he has no power over. The Federal Government is just holding onto straws here. If they have a strong case they should go and file it against Binance in the US. Binance will not submit itself to the jurisdiction of Nigerian Courts and the Nigerian Courts do not even have territorial jurisdiction on them in the first place.

Put the protesters in first flight to Gaza. At least, let them show support & love within.

It's better not to start what one can't finish.

Silly kids getting high on Hamas misinformation and stupid sentiments. Let them take a trip to Gaza and observe freedom of speech and liberty under the Hamas regime. They'll quickly realize that their protests are only propaganda for Hamas and Hamas do not even value their (the protesting kids) lives one bit.

I am not surprised because some of these kids romanticize the Hamas monster and its minions just like some romanticize and input human values to wild animals, talking about how cobras, tigers, lions and bison are cute and wouldn't even mind trying to pet those animals in zoos or snap selfies with them against conventional wisdom.

If you are sympathetic to killers that didn't mind raping innocent women, murdering innocent and unarmed civilians, elderly and babies and even roasting babies in ovens for thrills, then you need your moral compass and brain checked.

Some have made a case that Israel should only attack Hamas. It is a lame argument for several reasons:

1. The Palestinians whom you try to label as innocent actually aided and some even participated with Hamas in the October massacre. They cheered Hamas on and didn't see anything wrong wth the inhumanity and wickedness demonstrates by Hamas.

2. Hamas and Palestinians are comfortable launching missiles from school buildings, children playgrounds and hospitals despite knowing the effect and import of retaliation against such areas. They have therefore shown repeatedly that they do not value their children's lives. They would rather use them as human shields and collateral damage to curry international sympathy.

When a man sees his children as disposable propaganda material in a war with you, he gains advantage over you when you try to value the lives of those children higher than the value he places on them, particularly when he is ready to treat your own children worse. Mr. Nice guy never won any war.

I don't understand the write up. Is it that EFCC have forgiven yahaya Bello or the case was just withdrawn from appeal court?

That doesn't mean yahaya Bello will not arrested right?

The OP and the quoted media house appear to be Yahaya Bello sympathizers trying to mislead the public. EFCC has not withdrawn any fraud case against Yahaya Bello!

EFCC appealed against the order given by the Kogi State High Court in Lokoja in February that Bello should not be arrested. However, a Federal High Court had given order for Bello's arrest. So by 17th April the Kogi High Court amended its order to say that Yahaya could not be arrested except the Federal High Court orders it. Note that the Federal High Court has already ordered the arrest. So this is just a way of clearing the road by the State High Court. Now the appeal earlier made came up on the 22nd April at the Court of Appeal. By this time it is clear there is no point for the EFCC to continue with the appeal because the State High Court Order has already been amended to allow them exercise the Federal High Court arrest order without any impediment. So they simply withdrew the appeal and told the Judges the appeal has been overtaken by events.

Now the "shallow thinking" Yahaya Bello sympathizers are trying to make it look like EFCC withdrew charges against Bello. That is not true. EFCC now has the right to go and arrest him anywhere they see him without bothering about the High Court again.

The events in Kogi State during Yahaya Bello tenure is prime example of why we need to reconsider our democracy particularly at the State level. Institutions at State level are very weak and Governors are nothing short of dictators without any reasonable democratic or institutional framework to serve as checks and balances on the Governors. State Houses of Assembly are nothing but glorified rubber stamps that are usually the first to be captured and subdued by the Governors.

How can a Governor refuse for years to pay salaries or pay fractional salaries while receiving full monthly allocations and he still gets to complete 2-terms of eight years combined? So a Governor can simply be diverting huge chunks of monthly allocations for his personal use for years and still remain in power? Then what is the difference between such democracy and dictatorship? Just the 8 tenure year limit? I am very sure if State House of Assembly could extend the tenure of Governors, a lot of Governors in Nigeria now would be like Putin, serving unlimited terms. And that speaks volumes about our democracy and institutional checks and balances.

EFCC an organization filled with dull officers who got their appointment through corruption.

First of all why do you think it will be difficult for him to prove he sprayed fake notes, and it will be easy for them to prove that i actually sprayed genuine notes. The burden will rest on them to prove him guilty of spraying genuine note and they cannot do that. it will be so easy for him to get one or two people he sprayed the money on to confirm that they were doing a skit and the agreed to spray dummy notes.
Secondly on counterfeiting they have to prove the intention to defraud using the counterfeit notes, before a case of counterfeiting can be established, i can tell you most of our security agencies are so dull. look at EMefiele today with all the evidence around him the EFCC could not even convict him of anything.

1. There are several video evidence of Cubana Chief Priest or No risky spraying currency notes at events. So the prosecution has prima facie evidence of the crime they are accusing the defendant of. If there are no videos, then it is a different story.

2. With each video evidence, the burden is now on the defendant to either prove he is not the person in the video or the currency being sprayed is not genuine.

3. Under the Counterfeit Currency (Special Provisions) Act, production or possession of counterfeit currency is punishable without any consideration of intent to defraud.

My take is that it is unfair for the governor to make the second wife his first lady when the first wife is still alive. For the benefit of doubt, Ngozi is the first wife, see confirmation link below:

https://www.nairaland.com/7618361/breaking-news-meet-2-wives. This is what brings trouble in a home. Probably, the governor wants to please his people on the alter of tribalism.

I have continued to advocate a peaceful dissolution of this unholy marriage called NIGERIA,that is causing all of us pains. This union is not taking anybody anywhere. If our people can show tribalism in this type of scenario, why are we in one country?

You may make allusions to tribalism in the Governor's choice of Mrs. Titilola Adeleke as the First Lady. However, I do not see any immediate justification for your position. The choice of First Lady is at the discretion of the Governor when he has multiple wives. There must have been a reason for him to marry a second wife in the first instance. It is also said that the first wife had been in the United States for quite some time, meaning the Governor has been here all those while with the second wife. So before you make any allusions, investigate the relationship between the Governor and his wives prior to being a Governor and explore their history to be better informed.

I have seen some commenting that you can claim to be spending "fake" or imitation currency but then you stand the risk of being accused of perjury (lieing on oath) which carries two (2) years imprisonment if it is eventually proven you sprayed genuine naira notes. Why will you risk 2 years for something that carries maximum of 6 months when inside yourself you know you sprayed Naira notes?

Furthermore the burden of proof may shift to you to prove that what you sprayed are not Naira notes and how do you prove that? Judges are not idiots.

Finally the offense of printing money or possession of counterfeit notes carries a sentence of 5 years imprisonment without option of fine. So in trying to run away from 6 months imprisonment, you need to be extremely careful not to run into 2 or 5 years imprisonments that are far more damaging.

Politics / Re: Why Has EFCC Not Arrested Yari, Mattawale Despite Similar Court Order As Bello? by Babinski: 1:12pm On Apr 22
greenermodels:

There's no justification for EFCC's actions, they're perpetuating a witch-hunt, I'm not defending Bello, he's a horrible thief and murderer without an iota of conscience.

It is not a witch-hunt when the person being targeted has actually done something wrong. A criminal cannot cry "witch-hunt" because he is not innocent.

See Collins Dictionary:

A witch-hunt is an attempt to find and punish a particular group of people who are being blamed for something, often simply because of their opinions and not because they have actually done anything wrong.

The same people still defending fraud and criminality. We're not surprised.

Do not mind them. You can see their desperation and frustration mounting by the day. Unfortunately for them, Bello will soon be in the net

How good was Bello in obeying Court orders when he was Governor? Is he and his lawyers not aware of Supreme Court rulings that say the courts cannot stop law enforcement agencies from performing their Constitutional duties?

Have you condemned the atrocities of the Nigerian government against Biafra? No country likes secession. Israel does not want Palestine Arab to secede from them. Same way Nigeria does not want Biafra to secede from them. Unity is not by force. So condemn both countries.

Please educate yourself properly on issues. Israeli-Palestine conflict is not a secession matter. Israel is not Mandatory Palestine. Two States were created out of Mandatory Palestine by the UN in 1947 and one of them was Israel for the Palestinian Jews and the other for Palestinian Arabs. The Palestinian Arabs were not satisfied with the arrangement and wanted to eradicate the Jews and take over the land apportioned to Israel. As God will have it, despite the Palestinian Arabs getting support from other Arab countries, they lost the resulting War to Israel and Israel annexed some of the land. Instead of making a Palestinian Arab State out of the remaining land, the Palestinian Arabs not only chose to become stateless as refugees in the land but also decided to start calling themselves "Palestinians" (not Palestinian Arabs) to convey the wrong impression the land belonged to them. Since then the "Palestinians" have resigned to pursuing the agenda of terrorism which has stagnated their development, destroyed infrastructure and led to avoidable loss of lives.

experience is the best teacher. someone that narrowly escaped the watery beans in an overcrowded cage.

He may get eat the watery beans. This incident only confirms that he was spraying genuine currency and not make believe paper money. It is a dent this defense in court.

EFCC dragging white lion.

Life and history have shown that some of the worst dictators are actually men of little or no courage. Stripped of their garment of political or executive power, they are nothing but cringing little cowards.

Was it not the same Bello that terrorised Kogi State to an underserved second term and even forced his stogie upon them like a demigod? Now hiding and speaking through faceless internet warriors and jobless youths?

Then if "we" local Kogi people are naive leave us alone. However if you are intelligent all you have said constitutes grounds for the EFCC appeal. The FHC and SHC are courts of coordinate jurisdiction

The Supreme Cot has ruled severally that Courts do it have the power to prevent law enforcement agencies from carrying out their constitutional duties. However some Judges either due to pecuniary or other reasons continue to misbehave. It is not surprising that it is a Kogi State High Court that is trying to prevent EFCC from doing its duty in regard to Bello.

He who comes to equity must come with clean hands. You cannot get a court to give you a court order that is contrary to Constitutional provisions and then tell EFCC to appeal it or obey it. It is an abuse of court process and an attempt to subvert justice. Even the High Court Judge and Lawyers involved should be penalized for attempting to undermine the judicial system and erode its integrity.
