In filing Judge Merchan allowed evidence of Trump's presidency to be presented, Everyone, this is perhaps in elliptical lawyer-speak for some of you. So let me translate — Bragg agrees that Trump has filed a motion to dismiss the New York charges in light of yesterday’s immunity ruling. The Manhattan DA needs until July 24 to respond. Also, Bragg admits that the legal effect of Trump’s ruling + their requested extension meaning that Trump should not be sentenced in New York until the motion is resolved. This means that if Bragg gets his extension (which he will), the earliest Judge Merchan could deny a motion to dismiss the case and reset sentencing would be July 25. And that would be only after studying the matter for a single day, which should be insufficient. And doesn’t even consider oral argument on the motion if that gets held. The Republican Convention is from July 15-18, so Trump will not be sentenced before the Convention! On balance of all factors, the earliest Trump gets sentenced is realistically now some day in August. And in reality the whole case should get tossed before then. |

With SCOTUS rulings in last 2 weeks, how did judges allow the cases to go on trial. Are they just half baked law school graduates or partisan. Are they in a coordinated get trump partisan campaign. Do cases have to go to the highest court to determine constitutionality of charges. These judges should be investigated. Wait , they have immunity of their official actions. Take a look. Jack Smith most famous successful conviction of a Republican governor. Overturned 9-0 by the Supreme Court. Andrew Weissman successful convictions in Enron cases. Unanimously overturned by SCOTUS. Good Lord . Addendum..Judge Chutkan quickly processed Jackboot case despite glaring questions of the appropriateness of the case. How did the case get there to SCOTUS Judge Chutkan was appointed by Obama. 3 DC Appeallate judges ruled that Trump has no immunity. One appointed by GW Bush, the other two by Biden SCOTUS 3 dissenters are all liberals appointed by democrat presidents Nothing to see here folks Who comes off worse. Chutkan should have thrown out the case against Trump or at least determine what was personal or official. In the other ruling by SCOTUS on Friday the charge of obstruction against official proceedings was remanded to lower courts to properly define the congressional law that was enacted after the Enron case where auditors destroyed evidence. Judge Chutkan should have known that, but she proceeded with the trial preparation. |
