You bet...even foreign spouses of permanent residents and Canadian citizens too. CIC is known for notoriously keeping families apart.

It is even unimaginable to think of the time it takes to process these applications that they reject with flimsy excuses.

My brother.. I understand what you said especially the bolded.. bcuz even those of us here have to go through all dis drama b4 getting PR.. while you see lots of Indians, Philipinoes, Iranians and Iraqis granting dem PRs like no tommorrow before coming here.

Well, we have been at this for the last two years. The first application was a visitor's visa in December 2015. I was a student at the time and they essentially rejected based on assets and other things. We did a second visitor's visa application in July 2016. At this point I had already graduated and working full time NOC A and got a provincial nomination. It still came back with a rejection saying something about my wife does not have ties or something like that.

We decided to hire a lawyer here in Canada. The lawyer explained that we should have been doing SOWP instead of visitor's visa but the VO could have still granted based on dual intent. So she helped us package a SOWP application by paper from here and mailed it to Nigeria in December 2016. Sometime between when the application was processed and all, my wife was interviewed for an American visitor's visa and was rejected because of previous rejections in Canada. We forgot to update this information in the background section of the SOWP application in December 2016. The application came back rejected in April 2016 stating incomplete background info.

This recent application essentially addressed the error in the background info as not an intent to misrepresent bla bla bla. Long story short, my biggest regret is not starting express entry soon enough. I was doing PNP PR and close to 10 months in now out of the estimated 16 months. I also started Express Entry in June, got ITA in July and AOR about a month ago. EE usually takes about 3.5-4 months based on the timeline of my colleagues here at work, so I am really counting on EE more than anything else.

[/b]Altogether, I would implore most folks that can start EE to start EE instead of SOWP. These people don't have sense especially when processing applications from Nigeria. I don't understand how the same profile that grants your PR cannot grant you visitor's visa or SOWP. PS. All of these things would have consumed $10k minimum.[b]

I have a friend here in Regina, SK. His wife applied 3 times dey kept rejecting her.. they also got ITA dis august after writing ITELS like 3 times..

I "think" the C41 issue is because you have already started working and you are through with skol.. so they believe you dont need support from your husband since you are already working full-time.

sometimes if u have 3 months on ur study permit.. they feel u dont need a support from your spouse again..

I really pray everyone waiting for monday get approvals IJN. My husband applied 17th May and I was finally able to link his app online just last week. I got his refusal letter today dated yesterday and they had ticked employement prospect in country of residence, travel history (he had studied in UK and visited Italy once, so i'm not sure if they need him to visit the moon before they are satisfied with travel history) and they ticked he did not meet exemption for C41(I am on Postgrad openwork permit and working fulltime in a skilled job. We attached my employment contract stating my job duties, hours per week, salary and NOC code and also attached my payslip, so I don't know their problem).

He did not do medicals because he just got back from UK in May and they said he doesn't need one. This is the third refusal for OWP, the other two my husband applied while in Uk, in the notes they had stated his immigration status in UK, that he was on study permit bla bla bla which was why we decided he return to Nigeria to apply for it and now they came up with another story.....End of Rant

Anyway on the positive side, we got ITA for express entry last week, I had already filled out the forms and waiting to attach proof of medicals, my husband had called the medical centers in Lagos and they said they collect only passport as proof of ID, so good thing we got the decision yesterday so he can get his passport and go for the medicals and we can face express entry. IT IS WELL. Sorry for the long story

At the bolded.. not really true bcuz my kids 3 and 5 years respectively got study permits..

I think she will get a visitors visa now.. when the parents are renewing their visas in d next 2 years she could get a study permit.. bcuz she will be approaching the school age.

1. I don't understand why you applied for change in Name even though its not mendatory at all. Anyway, as long as you dont have changed name mentioned anywhere on docs, you dont need to declare it proactively, neither you need to change it in passport right now and apply for new passport.

2. Regardless of age, you need a travel document/passport even for one day old child. So definitely you will need passport for your baby.

3 yes, you will apply for a visitors visa (more than six months) for your daughter separately. That visitors, when accompanied with a valid student visa/work visa of parents can let her attend any eligible school for free of cost.

4. Passport and birth certificate is fine, dont need any additional doc

I will answer you to best of my knowledge. YES, you can apply as an accompanying spouse but you have to demonstrate having strong ties back home and justify why you decide to follow him convincingly. This can be explained in your letter to the visa officer.

You guys must also demonstrate a very strong financial strength to support your application. I know of someone going for PhD that got approved with his wife and children and in addition to the funding he received, he had a closing balance of 10 million in his account.

Alternatively, I would advice you let your hubby get his visa and once he's enrolled, you can apply to join him on open work permit, your chance of approval is very high with this method, I have not seen any spouse of a PhD student denied by going through this method
