Politics › Ondo Crisis Deepens As Protesters Attack Governor Mimiko's Convoy- Premium Times by BeeBeeOoh(op): 10:27am On Feb 03, 2017
The crisis rocking the Ondo State House of Assembly took a dangerous twist on Thursday in Akure as some protesters attacked the convoy of Governor Olusegun Mimiko.

The News Agency of Nigeria reports that the hoodlums smashed the side screens of two vehicles in the governor’s convoy.

It took the timely intervention of the men of the state police command to disperse the protesters, some of whom were also injured in the pandemonium that ensued.

The protest, which started on Wednesday, was against the governor’s move to present the 2017 budget to the Assembly.

Following the protest, Mr. Mimiko reportedly shifted the budget presentation to another day.

The protesters alleged that the governor wanted to sponsor 38 bills and ensure that the bills were passed into law before his tenure expired on February 23, 2017.

The protesters vowed to prevent the governor from presenting the appropriation bill to the Assembly.

According to a witness, immediately the protesters sighted the governor’s convoy on the road leading to the House of Assembly, some of them started throwing stones at the convoy.

However, the leader of the protesters, Saka Yusuf-Ogunleye, condemned the action of the police in dispersing them, saying that the protest was not a violent one.

“We don’t know why there is this issue of sporadic shooting by the police in a peaceful protest.

“It is uncalled for, and we are calling on the Inspector General of Police, well-meaning Nigerians and citizens of Ondo State to look into the matter.

“What we are protesting for is to tell our people that the governor is bringing a bill that will bring untold hardship to the people of the state. We are not violent with it,” he said.

The state Police Public Relations Officer, Femi Joseph, who confirmed the attack on the governor’s convoy, explained that the police had to disperse the protesters when they appeared to be going violent.

He said that the Commissioner of Police in the state was not biased, saying the commissioner’s interest was to ensure that there was no breakdown of law and order in the state.

“Some of them attacked the convoy of the governor; about two vehicles in the convoy were damaged by the protesters.

“We initially allowed them to protest peacefully, we also appealed to them to be peaceful but when they started barricading the road throwing stones at the governor’s convoy, we have to disperse them,” he said.

The police also attempted to seal off the Assembly complex over the crisis

The police in Akure had stormed the Assembly complex in an attempt to prevent breakdown of law and order while a faction of the lawmakers were holding a plenary session.

The News Agency of Nigeria reports that the security agent, led by the state’s Commissioner of Police, Ibifuro Harrisson, also disrupted a meeting of the staff of the Assembly and ordered them out.

However, the situation became chaotic when the lawmakers, who were still in the chamber, refused to vacate the premises.

The police also had a hectic time controlling a number of hoodlums, who had converged on the assembly complex.

Subsequently, the police resorted to the use of tear gas to disperse the unruly crowd and thereby denied journalists and others access to the assembly premises.

The factional lawmakers had earlier dissolved all standing committees of the House during a plenary session presided over by its Acting Speaker, Malachi Coker.

The factional acting Majority Leader, Olamide George, also moved to nominate Iroju Ogundeji, member representing Odigbo 1 constituency as their spokesman, while Kazeem Suleiman, representing Akoko South West constituency 1, seconded the motion.

The lawmakers unanimously accepted the nomination of Mr. Ogundeji as the spokesman for the house.

The House also announced that all staff of the Assembly should resume their duties, and subsequently called for a meeting with them.

All efforts to speak on telephone with the State’s Police Public Relations Officer, Femi Joseph, proved abortive as calls put on his line were not going through.

NAN could not speak with any of the factional lawmakers, who refused to leave the hallow chamber as at the time of filing this report.

The crisis followed the suspension of the embattled Speaker of the State’s House of Assembly, Jumoke Akindele, by a faction of lawmakers for alleged fraud.

Ms. Akindele enjoys the support of 12 other lawmakers who are loyalists of Mr. Mimiko.

Thirteen lawmakers, who sat in the Assembly on Thursday, are opposed to Ms. Akindele and Mr. Mimiko and are believed to enjoy the support the incoming administration of Rotimi Akeredolu of the All Progressives Congress.

Politics › Rivers Rerun Violence: Why Wike Is Desperate To Stop Probe - IGP by BeeBeeOoh(op): 12:17am On Feb 03, 2017
Sibrah:
Whoever do you this way do you strong.
The Inspector General of Police (IGP) Ibrahim Idris has said the suit by Rivers State Governor Nyesom Wike challenging the probe into the violence the rerun election is intended to cover his tracks.

The IGP said the decision by Wike to investigate the violence, for which he is being investigated, was a desperate move to pre-empt outcome of the probe by the Special Investigating Panel (SIP), constituted by the IGP.

The police boss spoke through the notice of preliminary objection against the suit filed by Wike at the Federal High Court in Abuja.

In the objection filed for him by Femi Falana (SAN), the IGP argued that the Judicial Commission of Enquiry set up by Wike had no power to investigate the crimes committed during the rerun election in Rivers and prosecute the culprits.

He argued that pursuant to Section 150 of the Electoral Act, the crimes committed during the rerun were federal offences, which could not be investigated and prosecuted by the plaintiffs.

The suit, marked: FHC/ABJ/CS/13/2017, filed by Mike Ozekhome (SAN) for the plaintiffs, has Wike and the attorney general as plaintiffs.

Named as defendants are the IGP, Department of State Services (DSS) amd Damian Okoro (a deputy Commissioner of Police).

The IGP, who gave reasons for his panel, painted a picture of the violence during the rerun of December 10.

“Even thought a combined team of the Army, police and other security personnel were on ground during the election, criminal elements committed many crimes and unleashed violence on unarmed voters and electoral officers.

“Two policemen were beheaded by a criminal gang. Based on complaints received from several members of the public, coupled with the crimes committed in the presence of security personnel, the 1st defendant (IGP) decided to set up a special investigation panel of the police headed by the 3rd defendant to investigate the killings and other electoral offences which occurred during the rerun election.

“The 1st and 3rd defendants have made progress in the investigation being conducted into the crimes. Among the several arrests of the criminal suspects made, is that of the fellow, who stole the telephone handset of the beheaded Deputy Superintendent of Police.

“The bodies of the beheaded policemen have also been recovered while the tape of the telephone conversation between Governors Wike and Ayodele Fayose on the rerun election is being analysed.

“The policemen, who accompanied the 2nd plaintiff (Wike) when he stormed polling units and the collation centre, have been identified, investigated and dismissed by the Police Service Commission (PSC), while the 1st defendant has ordered that they be tried for contravening the provisions of the Electoral Act when they illegally accompanied the 2nd plaintiff to polling units and collation centre.

“In a desperate move to cover up the grave crimes perpetrated during the rerun election and shield him from investigation, the 2nd plaintiff is praying this honourable court to stop the 1st and 3rd defendants from carrying out their statutory duty of investigating the crimes on the ground that he had set up a judicial commission of enquiry.

“Based on the questions for determination and the reliefs sought by the plaintiffs, the defendants have challenged the jurisdiction of this court to hear and determine this case,“ the 1st and 3rd defendants said.

Justice Gabriel Kolawole of the Federal High Court, Abuja before who the case is pending, had on two occasions declined Wike’s request for an interim order stopping the investigation by the police.

The latest of such refusals was on January 30.

Justice Kolawole, in a ruling on January 30 said: “As I observed in my ruling of 16th of January 2017, the plaintiff is, by his office, the chief security officer of Rivers State.

“The 1st defendant, by virtue of the provision of Section 215(1)(a) of the Constitution, is the chief law enforcement officer of the federation, who equally has the statutory duties to prevent, to detect and investigate any crime within the Nigerian borders.

“Both the 1st, 2nd plaintiffs and the 1st defendants appear to be exercising powers conferred on them by laws.

“The proceedings for today was for the defendants to show cause and for the plaintiffs’ motion on notice to be argued in the context of the defendants’ responses to the plaintiffs’ motion on notice.

“The question, which tasked my thought is whether the filing of a notice of preliminary objection, strictly speaking, is a process by which the defendant, against whom an order of interim injunction. Is sought, ought to file? I really do not think so,“ the judge said.

Justice Kolawole said the facts in the case did not present themselves as the case of Lagos State and Ojukwu, decided by the Supreme Court in 1986, which Ozekhome relied on to apply for an order maintain the status quo.

In distinguishing this case from that of Lagos and Ojukwu, the judge noted that there were constitutional issues bordering on the exercise of statutory and constitutional powers, which both the plaintiffs and the 1st defendant have.

He said: “The only issue is whether, as between both parties, the said powers were being exercised in good faith and for public interest.

“These are the issue on which I can hardly express any judicial opinion until I am able to listen to detailed forensic legal arguments on the provisions of the Constitution and the duties which it imposes on all persons and authorities, to apply and execute its provisions in good faith and for the public good.

“I really do not see any irreparable lost or damage, which the plaintiffs would suffer if no order is made even at this stage.

“Even though the ideal situation, especially when the Nigeria Police Force, established primarily to enforce law and order, is a party to the suit, is for them to stay action pending when issues in doubt are as to the extent of its statutory powers vis a vis that of the 1st plaintiff, is judicially enquire into and resolved.

“But, it seems that most of the time in our democratic polity, we are yet to reach the pristine level where all forces and authorities will see themselves and subject themselves to the supervisory jurisdiction of the court, established by the Constitution, as the proverbial guidance of the Constitution.

“The question, which I seem to have found an answer to is that even the 1st and 3rd defendants, perhaps, as an act of defiance to the court’s pending processes, precede with the investigation.

“This court, as one of the superior courts of record, created by the Constitution, still retains the inherent jurisdiction, pursuant to the provision of Section 6(6)(a) of the Constitution and in the exercise of its disciplinary jurisdiction, to set aside or nullify 1st and 3rd defendant’s report of investigation and or order that it shall not be acceptable as a report to conduct any prosecution in any court of law.

“It is a power this court can exercise where, at the end of the day, it comes to the conclusion that the investigation ought not to be conducted whilst the proceeding was pending.

“Let me also state that it is a constitutional fallacy for anyone to assert that the court cannot or has no jurisdiction to restrain a party from exercising it’s statutory or constitutional duties.

“To hold this as a principle is to canvass legal proposition that an occasion may arise in the exercise of its judicial powers, that courts, created by the Constitution, will be hamstrung in being able to intervene in a matter by such order, even when it may be shown or proved that genuine constitutional powers, duly conferred, are being abused or misused.

“In the light of these postulations, I will still refrain from acceding to the plaintiffs’ council’s request and leave the defendants’ council with a clear choice to make either to suspend the action or to continue with it when they realise that the final say, as to the validity of their investigation report will be a matter of judicial determination sooner or later,“ Justice Kolawole said.

The judge adjourned further hearing to February 10

Politics › Confab Has Solution To Southern Kaduna Crisis, Says Jonathan by BeeBeeOoh(op): 8:11pm On Feb 02, 2017
The implementation of the resolutions of the 2014 national conference will prevent ethnic and religious tensions that lead to crises such as the ongoing southern Kaduna killings, former President Goodluck, has said.

According to Ikechukwu Eze, his media aide, the Nigerian leader said this when he addressed the United States congress house sub-committee on Africa.

President Muhammadu Buhari has vowed not to touch the report of the conference, which he described as a misplacement of priority.

Eze said Jonathan also identified impunity as a factor that contributes to the reoccurrence of violence, noting that if those behind previous violence were not prosecuted, then like-minded individuals and groups would be emboldened to repeat the same act.

He also spoke on the crisis in the Niger Delta region, and the challenges facing Christians in Nigeria.

Eze said the meeting was part of efforts of the Goodluck Jonathan Foundation to fulfill its mission to promote peace and prosperity in Nigeria and Africa.

He said the former president, who was invited by the US congress subcommittee, spoke in his capacity as chairman of the Goodluck Jonathan Foundation.

Jonathan also spoke on his efforts to end impunity, specifically citing the case of Kabiru Sokoto, the mastermind of the Christmas Day bombing of Saint Theresa’s Catholic Church in Madalla, Niger state.

Sokoto’s prosecution was the first of its kind in the trial of an attack on a place of worship in Nigeria.

“That promise was fulfilled on the 20th of December 2013 when Kabiru Umar, aka Kabiru Sokoto, was sentenced to life imprisonment after my administration investigated that crime, identified him as the mastermind, arrested him and diligently prosecuted him and some of his associates,” Jonathan reportedly said.

The former president added that his administration’s prosecution of the perpetrators of the deadly bombing of an office of the Independent National Electoral Commission also in Madalla on April 8, 2011 was the first successful prosecution of “terrorists” in Nigeria.

On the Niger Delta, the former president said he fully aligned with the views of the national conference which called for true and fiscal federalism as the way out of agitations in the region and in other parts of Nigeria.

He also said that interventionist agencies like the Niger Delta Development Commission (NDDC) tend not to be effective due to over politicisation.

The former president said the almost overnight development of a state like Akwa Ibom proved that what the region needed was resource control not interventionist agencies.

The meeting was attended by chairman of the US house sub-committee on Africa, global health, global human rights and international organizations.

Politics › Why We Are Delaying Justice Onnoghen's Comfirmation - Presidency by BeeBeeOoh(op): 8:00pm On Feb 02, 2017
The Special Assistant to President Muhammadu Buhari on prosecution, Okoi Okono Obla, has advised Nigerians against reading ethnic and religious meanings to the delayed confirmation of the acting Chief Justice of Nigeria, CJN, Walter Onnoghen.

He made the remark while reacting to the controversy generated over the non-confirmation of Onnoghen as the substantive CJN.

President Muhammadu Buhari had on November 10 named Onnoghen, the most senior justice of the Supreme Court, as acting CJN, in line with recommendation by the NJC, following the retirement of Justice Mahmud Mohammed at the statutory age of 70.

Despite that Onnoghen’s tenure will expire soon, the President has been silent on his confirmation, an action that has drawn so much condemnation from a cross section of Nigerians.

A Lagos-based lawyer had earlier in the week dragged the President, his Vice, Yemi Osinbajo, the Senate President, Senator Bukola Saraki, and the Attorney General of the Federation, AGF, Justice Abubakar Malami before a Lagos High Court over the non-confirmation of Onnoghen.

But reacting to the controversies generated over Onnoghen’s delayed confirmation, Obla, on Wednesday urged Nigerians not to capitalise on the situation to blackmail the President.

Stressing that the situation was common in most states of the Federation, Obla maintained that the President has done nothing wrong.

“We have an acting CJN of Nigeria.Well, if his tenure ends, the system will take care of itself. I don’t think the president has done anything wrong,” he told Vanguard.

” In Nigeria, in the judicial branch of government, we have seen this happened. In my own state, Cross River State, the Chief Judge who is the current one was appointed on acting capacity and when his tenure expired, he was again appointed on acting capacity. So, trying to blackmail the president over this is bad.

“People are trying to read ethnic meanings, religious meanings and regional meanings to this because in Nigeria, everything is being looked at from the sectional perspective, I think they are not being fair to the president.

“For goodness sake, has the president not appointed people from that very state where the Acting CJN comes from?

“Recently, the Auditor General of the Federation was appointed from that state based on merit, because he came first in the interview conducted and the president appointed him. The Chief of Naval Staff was the fifth in the Naval hierarchy but the president appointed him Chief of Naval Staff. So what are they saying?

“So, the president would respect the law, would respect the Constitution as far as the appointment of the Chief Justice of Nigeria is concerned. But people should stop reading unnecessary meanings, “he charged.

On whether Onnoghen can still be re-appointed as Acting CJN, the Presidential aide called for patience, saying, “the system will take care of itself when the Acting CJN’s tenure expires.”

” What I’m saying here is that the process will take care of itself. There wouldn’t be any vacuum, the process would take care of itself,” he said.
