Chicago State University: US court assumes jurisdiction, says Atiku satisfies all requirements

The United States District Court for the Northern District of Illinois, Eastern Division, says it has jurisdiction in the case instituted by the Peoples Democratic Party (PDP) Presidential candidate, Atiku Abubakar, to compel Chicago State University (CSU) to produce critical documents relating to Bola Ahmed Tinubu.

Tinubu who is currently the President of Nigeria contested the February 25 Presidential election on the platform of the All Progressives Congress (APC).

Atiku’s application was spurred by an earlier case in Nigeria precisely on November 9, 2022, several months before the Presidential elections, in which one Mr. Mike Enahoro-Ebah, described as a “Human Rights Defender and Public Interest Litigator” in Abuja, Nigeria, commenced proceedings against Mr. Tinubu by filing a “Direct Criminal Complaint” in the Chief Magistrate Court of the Federal Capital Territory (FCT).

In his complaint, Mr. Enahoro-Ebah alleged that Mr. Tinubu submitted an “Affidavit of Personal Particulars” to INEC in June 2022 as part of a required filing to run for President that included a forged CSU diploma dated June 22, 1979 and other information that is inconsistent with the CSU documents.

According to court papers filed by Atiku in the US court dated August 2, 2023, to support the allegations, “Mr. Enahoro-Ebah stated that after Mr. Tinubu made his INEC filing, Mr. Enahoro-Ebah obtained a subpoena from the Circuit Court of Cook County, dated August 11, 2022, and served it on CSU. In response to the subpoena, CSU’s Registrar, Mr. Caleb Westberg, sent a letter dated September 22, 2022, to Mr. Enahoro-Ebah’s Chicago counsel, Mr. Matthew J. Kowals, advising Mr. Kowals that “[t]he enclosed documentation is all the records we have for Bola E. Tinubu.

“According to the complaint, the documents that accompanied Mr. Westberg’s letter included a CSU diploma issued to Mr. Tinubu on June 27, 1979. The June 27 diploma allegedly produced by CSU to Mr. Kowals, and the June 22 diploma allegedly submitted by Mr. Tinubu to INEC, are very different documents. In addition to the different dates, the documents have different seals, fonts, and language. The June 22 diploma has grammatical errors that the June 27 diploma does not have. They are also signed by different persons who are ostensibly officials of CSU. The June 22 diploma has three signatures, one of which purports to be the signature of Dr. Elnora Daniel as President of CSU. The other two signatures on the June 22 diploma are illegible.

“By contrast, the June 27 diploma only has two signatures. They purport to be the signatures of Dr. Daniel, again as the President of CSU, and Dr. Niva Lubin as the Chairperson of the Board of Trustees. Compare

“In his complaint, Mr. Enahoro-Ebah asserts that the June 27 diploma produced by CSU to Mr. Kowals is authentic, and that the June 22 diploma submitted by Mr. Tinubu to INEC is a forgery. However, Applicant’s staff have recently conducted further research into the names of CSU officials with legible signatures on the two diplomas: Dr. Daniel (whose signature appears on both the June 22 and June 27 diplomas) and Dr. Lubin (whose signature appears only on the June 27 diploma). According to public records, Dr. Daniel and Dr. Lubin did not join CSU until the late 1990s—around two decades after CSU supposedly awarded the June 22 diploma and/or the June 27 diploma to Mr. Tinubu.

Applicant’s research therefore calls into question the authenticity of both the June 22 and the June 27 diplomas.

In his complaint, Mr. Enahoro-Ebah alleged the following additional discrepancies between the information provided by Mr. Tinubu to INEC and the documents produced by CSU to Mr. Enahoro-Ebah:

“According to documents produced by CSU, the “Bola Tinubu” who attended CSU was a U.S. citizen, while in the information provided to INEC, Mr. Tinubu states that he has always been solely a Nigerian citizen and has never acquired the citizenship of any other country. According to the documents produced by CSU, the “Bola Tinubu” who attended CSU was born in 1954, while according to the information provided to the INEC, Mr. Tinubu was born in 1952.

“According to the documents produced by CSU, the “Bola Tinubu” who applied to CSU submitted a prior transcript from Southwest College that identified “Bola Tinubu” as “female.” According to the documents produced by CSU, the “Bola Tinubu” who attended CSU claimed that s/he had graduated from Government College, Lagos, in 1970, while in the information provided to INEC, Mr. Tinubu makes no mention of having attended Government College.

Pursuant to the above, Atiku, by and through his counsel, applied to the Court for an order granting him leave to compel CSU to release and verify the authenticity of documents purportedly issued to Tinubu by the university.

Going by available court papers, the Court has established that it has jurisdiction over this matter in accordance with US laws which “authorizes any “interested person” to request that a United States District Court order the discovery of documents and testimony for use in a foreign proceeding from persons that “reside[] or [are] found” within its District.”

The court said Atiku has satisfied all statutory requirements as he is an “interested person”; and the respondent, CSU, is a public university established and existing under the laws of Illinois, with its principal campus and offices in Chicago.

Having met all requirements, the court said it will not hesitate to grant the prayers of Atiku.

The United States District Court for the Northern District of Illinois, Eastern Division, says it has jurisdiction in the case instituted by the Peoples Democratic Party (PDP) Presidential candidate, Atiku Abubakar, to compel Chicago State University (CSU) to produce critical documents relating to Bola Ahmed Tinubu.

Tinubu who is currently the President of Nigeria contested the February 25 Presidential election on the platform of the All Progressives Congress (APC).

Atiku’s application was spurred by an earlier case in Nigeria precisely on November 9, 2022, several months before the Presidential elections, in which one Mr. Mike Enahoro-Ebah, described as a “Human Rights Defender and Public Interest Litigator” in Abuja, Nigeria, commenced proceedings against Mr. Tinubu by filing a “Direct Criminal Complaint” in the Chief Magistrate Court of the Federal Capital Territory (FCT).

In his complaint, Mr. Enahoro-Ebah alleged that Mr. Tinubu submitted an “Affidavit of Personal Particulars” to INEC in June 2022 as part of a required filing to run for President that included a forged CSU diploma dated June 22, 1979 and other information that is inconsistent with the CSU documents.

According to court papers filed by Atiku in the US court dated August 2, 2023, to support the allegations, “Mr. Enahoro-Ebah stated that after Mr. Tinubu made his INEC filing, Mr. Enahoro-Ebah obtained a subpoena from the Circuit Court of Cook County, dated August 11, 2022, and served it on CSU. In response to the subpoena, CSU’s Registrar, Mr. Caleb Westberg, sent a letter dated September 22, 2022, to Mr. Enahoro-Ebah’s Chicago counsel, Mr. Matthew J. Kowals, advising Mr. Kowals that “[t]he enclosed documentation is all the records we have for Bola E. Tinubu.

“According to the complaint, the documents that accompanied Mr. Westberg’s letter included a CSU diploma issued to Mr. Tinubu on June 27, 1979. The June 27 diploma allegedly produced by CSU to Mr. Kowals, and the June 22 diploma allegedly submitted by Mr. Tinubu to INEC, are very different documents. In addition to the different dates, the documents have different seals, fonts, and language. The June 22 diploma has grammatical errors that the June 27 diploma does not have. BEWARE THE COUP BELT

Despite the hysteria about who has been made a Minister and who has not and the euphoria about which portfolios they have been given or not been given, let us remain focused on the major issues of the day and not take our eye off the ball.

And other than our economic and security challenges the most weighty issue is the conundrum that we are presented with in Niger Republic and the challenge of military Governments in our backyard.

The facts are as follows.

Sudan, Chad, Niger, Burkina Faso, Mali and Guniea have all been plagued with coup d'etas and military Governments over the last 3 years.

They have formed a formidable and intimidating 'coup belt' of unelected military rulers which stretches from Guniea on the western flank of the West African sub-region right on the Atlantic ocean up across the southern flank of the North African Sahel and the Lake Chad region all the way to East Africa and the Pacific ocean.


They have effectively drawn an iron curtain and uninterrupted chain of unelected and unconciable military juntas right across the center of our continent dividing North Africa from the rest of the continent.


It follows that the greatest challenge of our time is to ensure that this leperous belt of unconstitutional Governments does not get any bigger, stronger and wider and that the virus of military interventions and coups does not spread any further.


We must, no matter the cost, fight for and defend our democracy and preserve our freedom and way of life.

We cannot do this by relying on foreign and regional armies to come and save us and neither can we achieve it by marching into Niger in a gung ho attempt to restore democracy.

We can only do so by winning the hearts and souls of our people by providing good governance, justice and accountability for them.

Once you do this and any military adventurer tries to do a coup, the people themselves will come out in the streets in their millions to denounce and resist it.

In such circumstances you will not need any foreign force to come and reinstall or reinstate you.

This is the point that President Bazoum failed to appreciate.

He allowed his people to suffer under the yoke of the French and was totally oblivious and insensitive to their yearnings and aspirations to be freed from the vestiges of neo-colonial bondage.

That is what the mutineers took advantage of.

Let us hope that other African leaders can learn from his mistakes.

If they do, we shall go from strength to strength and democracy shall
flourish in our respective countries.

If they do not they can expect the worse. The choice is theirs.

Permit me to conclude this contribution with a final word on the misplaced notion that a military assault or threat of it on Niger would be a fruitful endeavour and the best and only way to restore democracy in that beleaguered nation.

After the meeting of the Chief of Defence Staffs and military commanders of the ECOWAS countries in Accra on Thursday the following definitive statement was made by the commanders of the ECOWAS Force.

They said, "we are ready to storm Niger Republic".

This despite the counsel of the African Union and powerful North African countries like Algeria not to do so.

I am constrained to respectfully put the following questions to these ECOWAS military commanders and I challenge them to provide the answers.

Can we successfully attack a country where the civilians are holding rallies in solidatiry with their supposed oppressors?

Surely, in the end, no one will come out victorious as these things are always easier said than done.

Russia thought Ukraine would fall in two weeks yet today it is well over a year, hundreds of thousands of innocent lives are still being lost and the war is still raging.

Quite apart from that has this ECOWAS "force" already been formed or will they divide the operation into sectors with each country taking a sector?

Where is the Command HQ located? Who takes care of Nigér's sector 3 of the MNJTF in the Lake Chad, for I guess they will withdraw their troops?

If Burkina Faso and Mali join Nigér forces, as they threatened they would, who blocks the southward movement of the insurgents and terrorists scattered around the triangular borders of Mali, Burkina Faso and Nigér?

Is the Russian Wagner force still active in the region? Have we prepared adequately to handle the weapons and drug-trafficking across the borders with Niger since our partners in that nation are now our enemies?

Even with them working with us, cross border crimes are still serious issues.

Will the AU or the UN or the West be responsible for the logistics? As at now Nigeria can't afford to do so like it did in ECOMOG. We simply do not have the financial wherewithal or the resources.

In my view we should still vigorously pursue the application of conflict resolution mechanisms in order to buy time to address these questions.

We must approach the entire matter with the utmost caution, wisdom and care.

If Niger Republic and her allies deliberately open a corridor for the elements of ISIS, AQIM, ISWAP etc to move into Benin and Togo, ECOWAS' weakest link, then the whole of Nigeria's western borders, from Sokoto to Lagos, would be vulnerable to terrorist attacks.

Already some of the elements have penetrated into Niger State, around Borgu and Shiriro, very close to Benin Republic and some states in the South West of Nigeria.

These questions need answers.

There is no doubt im my mind that an attack on Niger Republic would result in a massive military conflagration that will engulf the entire West African sub-region and which would eventually spread to North, Central and East Africa.

The mutineers and coupists have agreed to dialogue and now ECOWAS wants to use force, launch an attack and endanger the life of President Bazoum? This hardly makes sense.

If we are not careful and if we refuse to use diplomatic means to resolve this matter we may end up throwing ourselves into the greatest and most destructive war in the history of Africa and few African nations would survive it.

Apart from those that wish to depopulate and destroy our continent and sell their arms, no-one, least of all the African people, stands to benefit from a rash collective of vicious and unaccountable military Governments strewn across Africa or from what may end up being a massive continental war which, to all intents and purposes, may end up transmuting into a proxy one between the world's super powers.

Worse of all such a war will probably be partly fought by mercenary armies from both sides of the divide.

May God deliver us from evil.

One indisputable fact is that the military rulers of Niger are enjoying mass local support. History has proven that when locals are united against an invading army, it doesn't end well for the Invaders, no matter how strong they might be. Suspended Central Bank of Nigeria Governor, Godwin Emefiele has unilaterally been operating a separate foreign reserve account on behalf of the country without the knowledge of the Federal Government, a security report has revealed.

Emefiele, according to the report, masterminded the creation of two foreign reserve accounts for Nigeria with the second one the Federal Government is not aware of, having about $47billion.

CBN under Emefiele, the report further revealed, has also been running no fewer than 527 private bank accounts with public monies running to several billions stashed in them without the government being in the know.

These allegations, amongst several others against Emefiele, are contained in a security report submitted by the Department of State Services to former president Muhammadu Buhari since January this year.

The security report was sighted by our correspondent over the weekend.

The report handed over to former President Buhari by the DSS Director General, Yusuf Bichi, in January, it was learnt, contains more damning evidence against the suspended apex bank boss over a series of some fresh allegations.

The submission of the security report to the then President, First News had reported, necessitated Emefiele’s visits twice on Thursday January 19, 2023 to the Aso Rock Presidential Villa. The then CBN governor, First News had reported, was summoned by the then President Buhari following his receipt of the DSS security report on the fresh allegations and “overwhelming evidence” against the apex bank boss earlier that day from the DSS DG.

Emefiele had earlier that same day visited the Presidential Villa as part of the delegation of the Arab Bank for Economic Development led by its Director General, Dr Sidi Ould Tah.

But Emefiele’s second meeting that same day with Buhari was held behind closed doors at the Presidential Villa, where he was confronted with the fresh allegations leveled against him by the DSS. At the end of his closed door meeting with the then President Buhari, Emefiele declined to comment on the issues discussed when approached by State House correspondents.

Earlier, the DSS had accused Emefiele of aiding and abetting terrorism, insisting that the then CBN Gov must be prosecuted for the alleged crimes.

According to the report, DSS’ preliminary investigations revealed Emefiele’s involvement in various acts of terrorism financing, fraudulent activities and economic crimes of national security dimension.

But the already embattled Emefiele continued to employ all means to escape arrest and interrogation by the DSS. He even had to delay his return to Nigeria after a trip abroad. He was also said to have engaged some close associates of the then President Buhari to help him prevail on the DSS to let him off the hook. He was also alleged to have been employing propaganda through organised public protests and demonstrations by CSOs, all in a bid to stop his investigations by the DSS.

A nephew and close confidant of the then President Buhari, Mamman Daura and the then Kaduna State Governor Nasir El-Rufai were said to be the arrowheads of the highly influential and powerful politicians pressuring the DSS DG, Yusuf Bichi to let go of Emefiele, resulting in the inability of the secret police to interrogate the apex bank boss on the allegations leveled against him while Buhari’s tenure lasted.

First News, however, learnt that unknown to Emefiele, while he was out of the country, the DSS had interrogated and obtained documentary evidence from his deputies at the apex bank, external auditors to the bank and managing directors of 27 commercial banks regarding the monumental allegations of corruption and fraud being levelled against him by the secret police regarding forex allocations and other corruption allegations.

It was in the course of these widened investigations that the DSS unearthed 12 fresh allegations against the CBN Gov, First News reported.

It was gathered that during interrogation, the CBN external auditors, who have been working for the apex bank in the past six years, “gave evidence under caution” to DSS interrogators and provided documents to back their claim that Emefiele paid them to prepare “doctored audit reports” which the Federal Government under Buhari was inadvertently relying upon.

It was also learnt that during investigations, the DSS discovered that the controversial Ways and Means approval requested by the Finance Minister was actually in the region of N23.7trillion as against the N7.3trn presented to the National Assembly.

Some of the new allegations Emefiele was then being investigated for by the DSS include the N3.6bn COVID-19 palliative funds given Nigeria by the IMF two years ago to cushion the effects of the pandemic.

Emefiele, it was learnt did not inform the Federal Government about the IMF palliative but only allegedly diverted the money into a private account in China.

The demand for acknowledgement letter by the IMF from the Finance Minister let the cat out of Emefiele’s bag. The CBN Gov was however said to have told the then Finance Minister that he invested the money for the country.
The then Finance Minister on her part, was said to have demanded for about $700m out of the IMF palliative to enable her Ministry to “offset staff salary.”

The remaining $3billion, it was gathered, is still being kept in a bank in China without the Federal Government being aware of this development.

Also, the much-vaunted Single Treasury Account (TSA), it was learnt, has been discovered by the DSS to be a phantom device by Emefiele to deceive the Federal Government and all Nigerians. “There’s nothing like TSA account. Only Emefiele knows what he means by this,” a source said.

The DSS, it was further gathered, while grilling bank chief executives in January, also unearthed an allegation that the CBN boss directed all commercial banks’ managing directors to give him N30bn each every year as his own “pocket money.” Only a newly established bank (names withheld) allegedly paid Emefiele the least sum of N5bn. The bank MDs involved, it was learnt, wrote statements and provided the DSS with documentary evidence.

This was part of the reasons Emefiele, on January 18, 2023, through a CSO, approached an Abuja High Court presided over by Justice Belgore to obtain an interim injunction to restrain the DSS from obtaining information from the CBN and the commercial banks regarding forex allocations in the past six years.

But unknown to Emefiele, the DSS had already obtained a comprehensive list of all those involved in the forex distribution deal, including some highly placed Presidency officials and which was included in the security report on the CBN boss submitted to former President Buhari.

This security report, which former President Buhari refused to act upon, it was learnt, was recently dusted by the DSS and re-submitted to the President Bola Tinubu-led administration, which last Friday night suspended Emefiele from the office of the CBN governor and subsequently appointed an acting governor in his stead.

This action by President Tinubu against Emefiele gave the DSS the needed clearance and the green light to move in and arrest the suspended CBN governor on Friday night in his Lagos home, flying him to Abuja, where he’s currently being detained to answer questions on the various allegations leveled against him.
