Yes. I knew initially. I was just confused, my first and last withdrawal was made before PENCOM made the rule. In most cases, the rule should be effective starting from when it was made.. Thanks

If your are less than 50, you can apply for a quarter(25%) of the balance in your Retirement savings account (RSA) after four months of exiting your job(no matter whether the exit is voluntary or involuntary). However, starting from Dec. 1 2017, you could only access 50% from your Additional voluntary contributions (AVC) after two years of making the contributions subject to a tax on the interest generated. The balance of 50% is added to the mandatory contribution at retirement.
Certain categories of people are however exempted. 1. Retirees 50 years and above and on pension who have gone back to work can only make AVC, hence can make a withdrawal of 100% after 2 years of contributions but subject to tax on both principal and interest. 2. Foreign employees in Nigeria can withdraw 100% subject to a tax on principal and interest when returning to their country. 3 Employees of companies like Exxon Mobil, Shell, Chevron etc who operate Closed Pensions can withdraw 100% subject to tax on principal and interest.

Note the conditions on withdrawal of AVC was made this stringent because employees deviced a way of avoiding tax by paying up to 90% of their salary into their AVC thereby reducing tax by up to 95% and is denying the tax authorities the income from tax.

PENCOM is a govenrment organisation who still believe in hard copy letters, memos instead of e-mails. I was even surprised they responded to mails after 2 weeks. If you haven't settle this...pm let me give you a number to call for immediate actions.

Adeleke defeated APC in only his senatorial district not the whole of Osun state. There's a huge difference and also Adeleke won because of the circumstances of his brother death who also won on the platform of APC.

What you dont know is that Spain and Portugal for example might meet in the quarter final stage. Liverpool didn't get to play PSG, Barcelona, Madrid, Juventus before getting to final.

Bro, it's taxable according to the Nigerian Law (Personal Income Tax Act). However, so many organizations don't pay tax on it. In fact, some organizations don't pay tax on the total salary which is why some of them have two salary accounts; one for upfronts, another for end of the month. They remit only on the end of the month's salary.
That is salary. 13th month shoulder not be referred to as salary. Its like a bonus ans not taxable.

Well the 13th month should be like a bonus e.g. holiday allowance. I see no reason why it should be taxed. Its an appreciation to encourage the employee. Like I said earlier, mine don't deduct.

one fact most people fail to understand is that 13th month salary is not a bonus but rather be a normal salary being worked for as an employee.

Go to your calendar, you would see that month February is the only month with normal days outline.

A simple arithmetic shows that a month should have 4 weeks multiplied by 7 days to give you 28 days as normal.

Every other month has additional 2 to 3 days making it has 30 or 31 days within.

Now sum up these extra 2 to 3 days on the rest eleven months in a year, you definitely get 29 days as your answer, resulting to another month.

Hence you agree with me that 13th month salary is never a bonus to you but an accumulated extra 29 days in a calendar year which ought to be taxed like your regular salary.

You are right. 13th month is your salary oooooo, so it will be taxed. For those saying its Leave allowance, no no, it is not. I collect both my Leave allowance and 13th month salary.

I work with a multinational organization. We are paid 13thmonth salary (bonus) at year end. However, tax is deducted and we end up getting net instead of gross. I tried to search online to see what the Nigerian tax law states as to taxation of 13month salary but couldn't find any.

To that, I brought it here for the experienced and learned heads to throw light on the subject. Please is it taxable? And where can I get where the Nigerian tax law talks about this so I can follow it up in my organization
