At present, each member [/b]of the House of [b]Representatives [/b]is entitled to [b]quarterly allowances of about N42 million, while that of the senators [/b]is reportedly about [b]N60 million.

The allowances [/b]are to cover [b]accommodation, vehicle loan, furniture, wardrobe, vehicle maintenance, entertainment, recess, constituency, personal assistant, domestic staff, utility, severance, newspaper, and house maintenance.

On the other hand, a member of the House is on annual basic salary [/b]of [b]N1,985,212.50; while each senator [/b]takes an annual basic salary of [b]N2,026,400.00.

Ok, you are obviously naive of the crime committed here by Bankole and others.

Let me help you understand something. Taking the loan was not a crime but the purpose for which the loan was taken brought in the criminality. First, Bankole approved that lawmakers should be paid more than what RMAFC approved as their package. That is unconstitutional. Two, he and other principal officers of the house approved to take a loan to finance the illegal salaries and went on further to make Nigerians pay for it from the taxpayers money by building the sums of money meant to repay the loan into the national budget. That again, is criminal!

By the constitution, only the RMAFC determines their salaries and not them by themselves.

Get it now??

Are you sure you are not naive too?  There is a difference between monthly salaries and quarterly allowances.

Now back to your point: The House Resolution to increase quarterly allowances (not salaries) was presided over by Nafada when Bankole was away.  After the House Resolution was passed, non-approval by Bankole would amount to a crime.  Now, if this[b] increase is illegal, how come Mr. President signed the 2011 budget into law[/b] even after all these allegations were out in the open?

The sad part is that most people still believe Dino and media's initial noise that Bankole took N10bn personal loan.  Meanwhile we didn't know Dino got N28m of it in two quarters while Bankole got nothing.  So is it fair that Dino, EFCC etc have slandered Bankole's name?  So why won't we question their actual motive?

EFCC should publish the accounts that Bankole siphoned the monies too. They should prove that public funds entered his account. That is when you can start talking of recovering stolen funds. Was there a crime? Was the crime committed by Bankole? Is there enough evidence to prove this beyond reasonable doubt?

Is EFCC telling the truth about Bankole trying to escape?  If they are, then they should present the[b] evidence to prove it viz a viz the booked ticket, the name of the airline, the name of the aide etc.[/b]  Otherwise, we may have no choice but to conclude that it's an excuse by EFCC to justify his arrest.

Bankole is already defending himself in the court of law using his lawyer.  For your information, EFCC is going to bear the brunt of this embarrassing approach to the 'so-called' anti-corruption war.  You do not share my belief of Bankole's innocence.  No problem.  Let us sit down and watch how events unfold in the next couple of days.

Prediction:
The 16-count charge bordering on procurement of TV's etc will be quashed because there is no case.  Keyamo does not have fiat from the AGF to prosecute Bankole.  Keyamo cannot submit a petition and then be the prosecution lawyer because there is high likelihood of bias and lack of fair hearing.  EFCC cannot prosecute a lawmaker on procurement allegations.  For procurement charges, only the clerk of the National Assembly can be charged to court. 


EFCC and Keyamo are aware they do not have a case against Bankole and yet they have taken Nigerians on this senseless ride simply because they want to persecute Bankole on the[b] pages of newspapers and detain[/b] him for as long as possible.  Once again, we should ask EFCC what their true motive is in this Bankole case.

When the matter of N10 billion arose on the floor of the House of Representatives, Bankole reminded his fellow legislators that the loan was taken to fund their recklessness. He knew they were reckless, and he bowed to them. He wanted to be a team player. He wanted to bear their sins on their behalf. The House Resolution to increase the allowances of the Reps members was taken by the House on[b] March 25, 2010 when Bankole was away and Nafada, his deputy presided[/b].  When Bankole returned, he was not happy.  But he could not singularly reverse or refuse the implementation of a House Resolution.  It would be a criminal offence.

So, he worked with the Management of the National Assembly to implement the increase by employing the most lawful option available to the House of Representatives.
Bankole did not have a choice!

surely figures, in this case bank account numbers, don't lie. Those accounts, said to exist in the UBA, as well the proxies used to facilitate the illegal transfers can easily be verified.

So I scarcely can see the need for all this drama.

That news was broken by Saharareporters.com and has been found to be a goof.  No evidence or proof of this allegation has been presented by anyone.  Saharareporters also tried to justify this initial report with yet another falsehood that still did not explain the $1bn dollar allegation.  Meanwhile, UBA has refuted the claim.

The facts I have shared are not conspiracy theories.  How do you 'know a soft landing is been prepared for Bankole'?  What you believe you know are the false reports you read from some corrupted news media? You wonder why he is not hunted for the 1bn dollars or 10bn naira?  I wonder why you responded to me when you didn't even bother to read my comments.  I have already shared the truth about the N10bn naira.  He did not steal N10bn as alleged in the lie Dino Melaye widely publicised.  It was approved as increase in allowances by the House of Reps and shared by all House of Reps members legally including Dino Melaye at N28m each though Bankole and his deputy didn't get any of the money.  The loan has now been repaid and the President has accommodated the increase in the 2011 budget which has now been signed into law.

As to your wish for him to spend at least only one night in jail, your wish may have been granted already as he has already spent 6 nights in detention.

For those of you that are so sure EFCC and Farida Waziri have no ulterior motives in this persecution of Bankole, just remember:  When a  policeman arrests, detains and maltreats a fellow Nigerian based only on allegation and without investigation or proof of evidence against him, what do you call that?  Because that is exactly what is happening here.  Would you rather trust the EFCC (policeman) or the man that was arrested without any proof of guilt?!

The Alleged N10bn loan fraud:  This allegation was brought to the fore on May 11 immediately on resumption of the House after elections.  Dino Melaye alleged that Bankole took personal N10bn loan for his own gratification without the consent or knowledge of the House( Troubled Bankole Ordered To Appear Over Impounded Cash And Unpaid Wages, House Members Move For Bankole’s Removal).

However, after a few days, the veil that some corrupt media elements, Dino Melaye and EFCC attempted to put over our eyes was blown away and everyone gradually began the see the truth:  Well barely a year ago, on the 25th of May, 2010, Deputy Speaker Nafada presided over a session where members agreed to increase their allowances by N14m each.  Reports say Bankole was away in University of Ibadan at that time.  But we know he was in Europe and affected by the Iceland Volcanic ash event that disrupted air travel at that period.  On Bankole's return, he was not happy but ensured that due process was followed by taking a N10bn loan (N2.5bn from Mgt of NASS, N1.5bn from Senate & 6bn from UBA)All members including Dino Melaye got N14m each except for Bankole and Deputy Nafada who got nothing from the increaseb(The Controversy Behind Dimeji Bankole’s , ).  By the way, the[b] loan has been fully repaid[/b] now and all owed members including Dino Melaye have received their outstanding allowances as reported in the naijan.com link above.

Well, the question to answer is this: Did Bankole violate the Fiscal Responsibility Act?  If he did, who else is a co-violator in the offence? Refererring to the link N10 billion loan: Did Bankole violate Fiscal Responsibility Act? and 2011 NASS Budget Manipulation And N10 Billion Bankole Loan: Falana Petitions FRC, you would realise if Bankole [/b]is to be charged, then the [b]National Assembly Management, the Senate, UBA [/b]and some officials of the [b]Presidency [/b]would be [b]complicit in the offence.  This is because the loan giver and the loan receiver are both offenders.  And given that the 2011 budget was signed into law to accomodate this increase in allowance, then the Presidency is complicit though the President him is immune from prosecution.  Now that is getting too messy with the Senate and the Presidency involved.

1.  Everything you have said are allegations.  He has not being convicted.  Neither have the allegations being proven to any reasonable extent.
2.  The N10bn loan was obtained with his consent.  The House of Reps followed due processBankole [/b]and his deputy [b]did not benefit from the loanEvery [/b]other [b]House member benefited N14m each including Dino Melaye.  Which means Dino Melaye lied when he claimed that Bankole took N10bn[b] personal loan[/b] for himself alone without foreknowledge of other lawmakers!
3.  Mark my words, Keyamo[b] cannot attempt to bring up the N2.4bn car scam[/b] again because it has been shown that the documents he was peddling were fake.
4.  You would wonder why all these allegations came up in the first place.  One reason was because Bankole reshuffled committee chairmen and Dino Melaye and co were on the receiving end.  Also, ex Gov. Gbenga Daniel was sponsoring Keyamo to bring down Bankole after Bankole was seen to back the successful removal of Ogun State Speaker, Titi Oseni, a loyalist to the Governor.

Now that Dimeji Bankole, former Speaker of the House of Representatives, has been arraigned by the Economic and Financial Crimes Commission (EFCC) on a 16-count charge of fraud, and the heated reactions that have trailed the move, it becomes pertinent to raise the following questions:
As at the time (Sunday, June 5, 2011) Bankole was arrested, Nigeria had no Attorney-General of the Federation. President Goodluck Ebele Jonathan
had dissolved the Federal Executive Council about 10 days earlier. Now, the charge sheet before the Federal High Court, Abuja, (where Bankole is being tried) read Federal Republic of Nigeria (Complainant) and Dimeji Bankole (Accused).

I am not a trained lawyer, but as a journalist I know that no private lawyer can prosecute on behalf of the federal government without the fiat of the Attorney-General of the Federation. In the FGN vs. Bankole case, who issued Mr. Festus Keyamo the fiat to prosecute Bankole?

2.            In the very unlikely event any ‘Attorney-General of the Federation’ had issued Keyamo with  such fiat, can EFCC claim ignorance of the fact that Justice Adamu Bello of the Federal High Court had recently discharged a dubious fiat the same Keyamo obtained  to prosecute Chief Kenny Martins in the Police Equipment Foundation (PEF) saga? His Lordship had ruled that it ran against the grain of justice for Keyamo who had done a petition against Kenny Martins to assume the role of a prosecutor in a case involving the same Martins.

Now, the same Keyamo had penned several petitions against the Bankole-led House during the Peugeot 407 cars saga. Also, Keyamo had severally condemned Bankole’s handling of the suspension of 11 lawmakers last year. How could the same EFCC that lost the case against Kenny Martins, partly on account of the withdrawal of the federal government’s fiat to Keyamo, now engage the same Keyamo to prosecute Bankole?

3.            Also in the charge sheet was that Dimeji Bankole “and others now at large, with intent to defraud, did conspire amongst yourselves to inflate the cost of” various electronic gadgets. Could the EFCC clear the air on the identities of these “others now at large” as there is this whispering campaign that the persons may actually be Aminu Tambuwal and Emeka Ihedioha, serving Speaker of the House and his deputy respectively?

4.            Who raised the memos for the purchase of the now controversial television and computer sets? How much was in the memo? Was Bankole involved in the process leading to the award of the contract for the supplies? Did he usurp the functions of the Clerk of the House as well as its procurement officers? If Bankole was the approving authority, it follows that some persons (most probably including those now at large) must have prepared the papers for him to approve. How come it is only Bankole that is on trial? In any case, what happened to the dust initially raised by EFCC on the N10 billion loan?

5.            Finally, Section 58 (3) of the Public Procurement Act 2007 states: “Prosecution of offences under this Act shall be instituted in the name of the Attorney-General of the Federation or such other officer of the Ministry of Justice as he may authorize to do so, and in addition, without prejudice to the Constitution of the Federal Republic of Nigeria.” It therefore follows that that only the Attorney-General of the Federation or any officer in his ministry, and not EFCC, can prosecute any breach of the Public Procurement Act, 2007. In other words, EFCC is on its own- a meddlesome interloper!

Well, sadly, one of the problems with nairaland is the lack of moderating.  That alone has sent many knowledgable people away from this forum.  There are so many people who do not think and just insult anyone at short notice.  Please, @Jarus and @OAM4J, and @Seun, can we attempt a better job at moderating?  I still have hope.

At least you are attempting a reasonable response.  That's what EFCC fed to you.  I am impressed that you people believe in EFCC, Farida Waziri and Keyamo so much to believe the things they say about this case.  And you believe Farida and Keyamo are not corrupt. And you guys believe the only reason they arrested Bankole is because they believe he is corrupt!

The reason Bankole was arrested was to[b] implicate Tambuwal[/b] in the alleged N10bn scam to detain Tambuwal so he won't be present and be able to contest [/b]for the [b]position of new Speaker the next day.  This is because Jonathan wanted a SouthWest woman as Speaker and not Tambuwal.

N[b]OW, THE FOLLOWING IS CLASSIFIED INFORMATION: [/b] You'll read it first here.  Jonathan wants a single 7-year term.  He needs to have 100% control of the Senate and the House of Representatives to achieve that.  He does not want to risk loosing the chance the way Obasanjo lost third term.  This among other reasons is why the House of Reps are not ready to do his bidding.

Then you ask the question:  If there's no case against Bankole for the current 16-point charge against him, why was he charged?  The answer is that EFCC did not want to release him because within 48 hours of detention, you have to either free a suspect or arraign him in court.  Of course, they didn't want to release him but[b] they didn't have a ready N10bn fraud case like they made everyone believe [/b], so Keyamo had to go and dust up the old document he had prepared 3 years ago on TV sets etc.  Hence the question is:  Why did EFCC make so much noise in the media over N10bn fraud?  Why did they arrest him for this case when they had not conducted sufficient investigation?  He should not have been arrested unless they were ready to charge him for the N10bn fraud in the first place!

I answered the question of unspent funds if only you you took time to READ my response right.  Well, I'm nice enough to repeat it for you - IT WAS RETURNED TO GOVERNMENT COFFERS AND ADDED TO FUNDS MEANT FOR THE 2008 BUDGET.  IN PAST YEARS, IT DISAPPEARED INTO THE POCKETS OF MINISTERS, CIVIL SERVANTS AND CO-HORTS.  

Now, I will admit to you, not all the probes were totally successful.  For the Power Probe, even though Bankole had good intentions, the chairman [/b]of the committee, Godwin Ndudi [b]Elumelu [/b]seemed to have been compromised and his[b] report was thrown out.  However, Hon. Tambuwal came up with a set of recommendations that were adopted by the House of Representatives.  Now, if you'll let me return to the other matters at hand;

Back to the 16-count charge, the Sections referred to in the Procurement Act 2007 read thus:

Sections 58(4)(a), 58(4)(b),58(4)(e)
4) The following shall also constitute offences under this Act:
(a) entering or attempting to enter into a collusive agreement, whether enforceable or not, with a supplier, contractor or consultant where the prices quoted in their respective tenders, proposals or quotations are or would be higher than would have been the case has there not been collusion between the persons concerned ;
(b) conducting or attempting to conduct procurement fraud by means of fraudulent
and  corrupt  acts,  unlawful  influence,  undue  interest,  favor,  agreement,  bribery  or corruption ;

(e) bid-rigging;


Section 58(5)
(5) Any person who while carrying out his duties as an officer of the Bureau, or any procuring entity who contravenes any provision of this Act commits an offence and is liable on conviction to a cumulative punishment of:
(a) a term of imprisonment of not less than 5 calendar years without any option of fine
; and
(b) summary dismissal from government services.



My response to the above is that there is EFCC/Federal Republic of Nigeria has no case against Bankole.  Why?  The answers are in Section 20(2)(a) of the same Procurement Act below:

20(2) The accounting officer of every procuring entity shall have overall responsibility for the planning of, organization of tenders, evaluation of tenders
and execution of all procurements and in particular shall be responsible for :
(a) ensuring compliance with the provisions of this Act by his entity and liable in person for the breach or contravention of this Act or any regulation made hereunder whether or not the act or omission was carried out by him personally or any of his subordinates and it shall not be material that he had delegated any function duty or power to any person or group of persons ;

For your information, the Accounting Officer of the House of Representatives is the Clerk of the National Assembly, Alhaji Salisu Maikasuwa and NOT ex-Speaker Oladimeji Sabur Bankole.  Ask any lawyer worth their mettle to challenge be above submission.

Well, if you ever read the news, or read my original post, you would be aware that:

Bankole as speaker established the committee to probe the $16bn power project which failed to deliver power to Nigerians as promised
Bankole established a committee to probe $35bn railway project
Bankole exposed N15 trillion unremitted Government revenue since 1999
Bankole, for the first time in Nigerian history, discovered an unspent N450bn budgetary allocation in 2007 [/b]and ensured they were [b]ploughed back into the 2008 budget.  Previously, unspent funds just disappear and are never returned at the end of the fiscal year

Are you saying the above don't qualify as fighting corruption?  Or are you saying my facts are not right?
