Mr Ologunagba said that the party’s National Working (NWC) received the judgment of the court which affirmed that the issue was that of party leadership positions. According to him, this included that of the national secretary, which is entirely an internal affair of the party, requiring only the party’s internal mechanism to which the court has no jurisdiction. “Today’s judgment of the Supreme Court reaffirms the standing position of the party. “It emphatically settles the emergence of Sunday Udeh-Okoye as the substantive National Secretary of the PDP, having been duly nominated, endorsed and ratified through the internal mechanism of the PDP statutory organs and bodies,” he said. This, he said, was in line with provisions of the PDP Constitution (as amended in 2017). Mr Ologunagba recalled that the NWC had, at its 576th meeting held on 11 October 2023, directed the South-east Zonal Executive Committee to nominate a replacement for Mr Anyanwu upon his nomination then as the party’s governorship candidate in the state. He said that consequent upon the directive of the NWC, the zonal executive committee, on 20 October 2023, passed a resolution approving the emergence. He noted that the zonal committee also forwarded Mr Udeh-Okoye’s name to the NWC as the party’s national secretary.

The Supreme Court has nullified the judgements of the Court of Appeal and Federal High Court which sacked Samuel Anyanwu as the National Secretary of the People’s Democratic Party (PDP). A five-member panel of the apex court held that the issue of who is the National Secretary of the PDP borders on the internal affairs of a political party which is not justiciable. Justice Jamilu Tukur, who delivered the lead judgment of the Supreme Court, consequently struck out the judgement of the trial court delivered in October 2024 and also set aside the majority judgement of the court of appeal which had in December affirmed the sack of Anyanwu as PDP’s National Secretary. Justice Tukur subsequently affirmed the minority judgement of the appellate court delivered by Justice Ekanem which had nullified the judgement of the trial court on account of lack of jurisdiction. Besides, the apex court held that the plaintiff, Aniagu Emmanuel, who initiated the suit at the trial court lacked the necessary legal backing to do so since he did not show how he was affected by who is the National Secretary of the PDP. The PDP National Working Committee, Board of Trustees, PDP Governors’ Forum, and the South East Zonal Executive Committee had at various times affirmed Udeh-Okoye as the National Secretary of the party. Last month, the Tom Ikimi-led disciplinary committee of the party recommended Anyanwu’s expulsion from the PDP. It said Anyanwu failed to appear before the committee to defend himself against a petition by the PDP Young Generation caucus. The petitioner had accused Anyanwu of engaging in anti-party activities contrary to the provisions of Article 58 (1)(f) of the PDP Constitution. It accused Senator Anyanwu of engaging in conduct likely to disrupt the peaceful, lawful, and efficient conduct of the party’s business contrary to provisions of Article 58 (1)(h) of the PDP Constitution 2017. This time, it is before a new judge, Justice James Omotosho. There is also a change of defence counsel, Kanu Agabi (SAN), now heads the defence team for Kanu, while the prosecution retained Adegboyega Awomolo (SAN). Shortly after appearances, counsel to Kanu, Chief Agabi, pleaded to address the court. He started by apologizing on behalf of his client, stating that they are now at a place where they must apologize to Justice Binta Nyako, the prosecution team, and his lawyers. He added that Kanu was angry and had been for a very long time. He said the attack on Justice Binta Nyako was unjustified. He apologized to his team whom he attacked verbally. The apologies were also rendered to the prosecution team led by Awomolo and the chairman of the Body of Benchers, who they hold in high regard. Agabi added that Kanu was a good man and everyone can’t be of like minds. Agabi pleaded that room should be made for errors, and they must strive to save and not destroy. While accepting the apology, the prosecution added that they would do their best to ensure an expeditious hearing of the case. Awomolo says he appreciates the feeling of Kanu and the heat the matter generates. Justice Omotosho says the length of the trial may have taken a toll on Kanu. He said when he was arraigned in 2015, he was 47 now he is 57 and still does not know where he is headed. This, according to him, may have led him to make certain comments which were not right. Justice Omotosho also tendered an apology to the prosecutor on behalf of Mr Kanu.

I am going to meet with them to get the formal briefings from all those I met this afternoon. “I believe it is proper for me thereafter, to have something to say to you all. And I assure you that perhaps later this evening I will be in the right position to address you and on the issues you would want to get now.” When asked of his experience when he arrived the state, the retired Vice Admiral said “Port Harcourt is my city. Everything appears calm, although I know situation is there, but we will ensure Port Harcourt gets back as it has always been”.

They described the move as "mendacious, preposterous, and a big slap on the faces of our noble and respected leaders" who have worked tirelessly to build the party over the past three years. The group condemned the “unacceptable” narrative that a “joiner of less than one week has become leader of the party”.
