My point exactly in that first post that u quoted is that he can be impeached as the VP and the impeachment will be binding because he is still the VP whether he is the acting president or not. Acting president is not an elected post. The constitution has not said that he ceases to be the VP once he becomes acting president and the conditions that the constitution gave for him to vacate the office of VP do not in anyway include being the acting president. It's just like saying that Buhari is no more the president because he became the Minister for Petroleum Resources.
Osinbajo still receives his salary as the VP. He has never been sworn in by the CJN as the president. So, I wonder where u stand to say that he is no more the VP.

The constitution envisaged a situation where a President who is clearly incapacitated or away from office longer than is reasonable ought to be removed.

The role of acting President is a temporary office and not one that can run the course of a tenure.

The right thing to do is to impeach Buhari on health grounds but that will be near impossible given that the required 2/3rd votes from both houses can not be secured owing to the overwhelming seats occupied by the north.

The scenario we are seeing is one of grave recklessness and could only occur in a country like Nigeria under a useless party like the APC.

The constitution does not have an office of the acting President rather it only offers a temporary role to be assumed by the VP for a very short period.

Osinbanjo is Vice President acting in stead of his principal Buhari.

Abacha inserted this clause with his experience with Diya and Obasanjo wanted to use this same bolded clause to remove Atiku.

(2) Where any vacancy occurs in the circumstances mentioned in subsection (1) of this section during a period when the office of Vice-President is also vacant, the President of the Senate shall hold the office of President for a period of not more than three months, during which there shall be an election of a new President, who shall hold office for the unexpired term of office of the last holder of the office.

(3) Where the office of Vice-President becomes vacant:-

(a) by reason of death or resignation, impeachment, permanent incapacity or removal in accordance with section 143 or 144 of this Constitution;

Sub-section (c) does not even state clearly how a VP can be removed unlike that of the President which is explicit as contained in sections 143 and 144.

The reason why Nigerians today are particular about the new nomenclature and protocol stems from the Yaradua days when Segun Adeniyi (the then media spokesman of the Presidency) dubiously refused to address Goodluck Jonathan as acting President after the Senate had declared him so and this resulted into a public backlash as if Adeniyi was refusing to recognise the Senate's declaration on GEJ's new capacity.

Osinbajo is the acting president for now and he is untouchable courtesy of the constitution. He has to be reverted back to vice president before he could be impeached. The constitution has not made provisions for acting capacity (just like in the case of magu). If taken to court any good lawyer would win the case for the acting president as there is no provision in the constitution hence no interpretation so everyone would revert to 'as you were'.saraki sef know say him misfire and he is seeking soft landing una dey here dey argue rubbish.

The same constitution does not have a separate office for acting President.

The constitution only recognizes the President and VP as heads of the executive arm of govt with acting President being a role played by the VP where the powers of the substantive President are duly transmitted temporarily to the VP by the President.

Thus, only a VP can assume the role of acting President after a letter is communicated to the Senate by the President stating thus.

Go and read up on acting President in the constitution before you continue disgracing yourself
