ShobayoEmma:The constitution envisaged a situation where a President who is clearly incapacitated or away from office longer than is reasonable ought to be removed. The role of acting President is a temporary office and not one that can run the course of a tenure. The right thing to do is to impeach Buhari on health grounds but that will be near impossible given that the required 2/3rd votes from both houses can not be secured owing to the overwhelming seats occupied by the north. The scenario we are seeing is one of grave recklessness and could only occur in a country like Nigeria under a useless party like the APC. The constitution does not have an office of the acting President rather it only offers a temporary role to be assumed by the VP for a very short period. Osinbanjo is Vice President acting in stead of his principal Buhari. Do not get it twisted! There exists a seal for the President and that of the VP but there is no seal or insignia for the acting President! |

How Saraki will chase that manlet back to Tinubu's bedroom 146. (1) The Vice-President shall hold the office of President if the office of President becomes vacant by reason of death or resignation, impeachment, permanent incapacity or the removal of the President from office for any other reason in accordance with section 143 of this Constitution. (2) Where any vacancy occurs in the circumstances mentioned in subsection (1) of this section during a period when the office of Vice-President is also vacant, the President of the Senate shall hold the office of President for a period of not more than three months, during which there shall be an election of a new President, who shall hold office for the unexpired term of office of the last holder of the office. (3) Where the office of Vice-President becomes vacant:- (a) by reason of death or resignation, impeachment, permanent incapacity or removal in accordance with section 143 or 144 of this Constitution; [s](b) by his assumption of the office of President in accordance with subsection (1) of this section; or[/s] (c) for any other reason, the President shall nominate and, with the approval of each House of the National Assembly, appoint a new Vice-President. Sub-section (c) does not even state clearly how a VP can be removed unlike that of the President which is explicit as contained in sections 143 and 144. So by your logic, the VP stops assuming his elected role once conferred with acting President? Osinbanjo is the VP and he is in acting capacity and can delegate in place of the President. The reason why Nigerians today are particular about the new nomenclature and protocol stems from the Yaradua days when Segun Adeniyi (the then media spokesman of the Presidency) dubiously refused to address Goodluck Jonathan as acting President after the Senate had declared him so and this resulted into a public backlash as if Adeniyi was refusing to recognise the Senate's declaration on GEJ's new capacity. |

Thus, only a VP can assume the role of acting President after a letter is communicated to the Senate by the President stating thus. Whenever the President transmits to the President of the Senate and the Speaker of the House of Representatives a written declaration that he is proceeding on vacation or that he is otherwise unable to discharge the functions of his office, until he transmits to them a written declaration to the contrary such functions shall be discharged by the Vice-President as Acting President. |

Even if we want to go by verbitim, the letter Buhari sent to the senate did not transfer power to Osinabnjo as acting President as it was not communicated in the said letter. Stop grasping at straws!
