LG as the third tier of government have a statutory Federal revenue and state allocation.They are are also entitled to  internally generate funds.
Deduction of funds from the LG at the states level is to cover for Primary education teachers salaries.
Other deductions are for sundry debt services that was made available to the LG from the state.
The state is under obligation a % allocation to the LG from funds accrued to the state other than from the Federal allocation account.
So,deductions from the LG account by the state is illegal except their is a previous agreements.

Brownbono am not pulling any strings oooo i be jjc for the whole UK immigration stuff. Infact , i never knew about the the Surinder Singh ruling untill i saw it on your post and i googled and you are absolutely right about what  you stated. The point am trying to make and understand is that if he enters into a civil partnership in denmark with a visit visa  with a british national does that grant him to apply at the danish home office for extended stay or resident permit if the british national decides to stay in Denmark as self sufficient for 6month?

Thanks for stating that last sentence , these is what i really wanted to know .
Bear in mind,he can change his status anywhere in Schengen states and not just Denmark as soon as the CP is signed.

The Surinder Singh case only applies if his Partner live and work in Denmark and he reside there with him for at least six months , But since he is on a Schengen visit visa and his partner works in Singapore not sure how it is possible to apply under the Surrinder Singh ruling after they sign a civil partnership in Denmark cause am not sure if signing a civil partnership/marriage in Denmark grants him to change his visit visa to resident permit (huhhuhhuh??, lots of question-marks , meaning i stand to be corrected ).
Dude,i said "your partner either as a worker or self sufficient " for the ruling to be activated.Get your facts before pulling your strings.Moreover,he can switch his Visa status anywhere within Schengen states as soon he signed the CP.

Am not a resident in Denmark and i know i cant apply for a UK visa there but we can register the civil partnership in Denmark on a visit visa unlike UK where you need to have a civil partnership entry visa first before u are allowed to register . After the the registration in Copenhagen we will post a copy of the certificate to nearest british consulate and it will be sent to GRO to be registered in the CPB ,after it has been registered by GRO they will notify us then i can apply for settlement visa.
You can reside in Denmark for 6 months with your partner either as a worker or self sufficient and then apply for the EEA family permit to the UK with the EU free movement dimension(Surinder Singh
ruling).That will be an easy one to get to the UK.

Thats a valid point Brownbonno!! the HSMP requirements does have that.

But is it the same applicalble for dependent HSMP? Logicaly ,it sounds Yes. But is that what ECR is trying to redirect that since my spouse would be on dependent HSMP, she will have to be depdent on my visa timelines,
I have said in my first post that most of the ECOs are with empty brains.
Your status in the UK is extendable if you have the requirement.You wife depend on you and she will have a right to live here with you.

Am not sure if permanent is the right answer because your spouse is only allowed to stay in the UK as long as your HSMP is valid . ( I stand to be corrected ooo)
HSMP REQUIREMENTS

"In addition to scoring at least 75 points in the above areas you will also need to demonstrate:
1. Your ability to continue to work in your chosen field in the United Kingdom.
2. That you have enough savings and/or potential income to be able to support yourself and your family. You will not be allowed any use of UK public funds (for example income support) whilst in the United Kingdom with permission to stay under the programme.
3. That you are willing and able to make the United Kingdom your main home. We will ask you to provide a written undertaking to that effect. You will be expected to make the UK your country of habitual residence….".

Hi

i am on HSMP in UK and i and my wife got our marrige resigtered. since we didnt have any marriage photos with us at that time, we took a joint photograph at a local studio and submitted the same along with the original marriage certificate.SInce the photograph was taken against plain background, the photographer suggested to enhance the beauty of the photograph by using his digital techniques. The ECR refused the visa stating that a false document had been provided under section 320 (7a). we re-applied this time again with the complete marriage album(as we now have the complete snaps of our rituals) and the application form. They again rejected stating 2 comments.
1. As the earlier application was refused under false act
2. My wife had mistakenly given a wron statment against one of the question. i.e when asked "how long do u wish to stay" - my wife had given as permanently. This was writtern after asking the agent at the VFS counter. i think this should be my(spouse) visa expiry date.

Can anyone suggest, if i should re-apply (3rd time) or should i go for appeal?

The empty brain ECO is only trying to fool your process.There is nothing wrong give them a private picture without the usual crowd.
point 2,the answer-permanent is the right answer as she wants to have the UK as her primary place of abode as a spouse of HSMP holder residing and working in the UK.
Personally,i will go for an appeal instead of allowing the rants to ruin your marriage.Get a good UK solicitor to screw them up as usual with their flippy excuses.

Brownbonno i owe you , you are a life saver . It cost less than nothing to register the civil partnership at BHC in Vietnam and who knows may be they would allow me to apply for the indefinite stay from the BHC in Vietnam

I no sure say na the same google search engine we dey use oooo , have searched before but got nothing regarding this , I only got the one for Hongkong but u have to be honkong residency to register.

DISQUIET IN EDO ASSEMBLY: Oshiomhole’s style draws lawmakers’ ire

IT is very obvious that a crisis is brewing between Governor Adams Oshiomhole and the Edo State House of Assembly over alleged refusal of the state government to recall the sacked 75 workers of the state owned Edo City Transport Service (ECTS). Besides, the House is also not happy over what it described as some unilateral decisions that have been taken so far by the governor since he assumed office, following the Appeal Court Judgment that sacked the former governor, Oserhiemen Osunbor of the Peoples Democratic Party (PDP).

Among the 24 members of the House of Assembly, PDP has the majority of 16 while the Action Congress (AC) has 8, though the state government, headed by the Action Congress/Labour Party alliance, is hoping that about eight cases still pending in the court will go in their favour.


Gov. OshiomholeThe strength of the PDP in the state now lies on its majority in the House and the 18 Local Government Councils and, following the on-going reconciliation moves, Vanguard learnt that they have agreed to close ranks to fight for their survival in the state.

But, as it seems, the AC law makers are the ones that may give the governor his first shocker in governance. One of his actions, which the law makers frowned at, was the dissolution of the Edo State Oil and Gas Development Areas Commission (EDOSOPADEC) which is a statutory appointment.

Secondly is the alleged deduction of 10 per cent from the monthly allocation of the 18 Local Government Councils by the state government.

Though the state government had already stated that the local governments would contribute to the payment of the 10,000 workers expected to be employed, but the lawmakers, Vanguard learnt, are saying that the deduction, no matter the intention, must be backed by a resolution of the House. Therefore, as it is now, it appears illegal.

Then the issue of the Permanent Secretaries who were appointed by the former administration that were allegedly demoted by the state government. Though majority of them have been recalled, but the lawmakers felt slighted because they were not consulted before their demotion.

It would be recalled that the issue of the sacked 95 workers of the Edo City Transport was seriously debated on the floor of the House prior to the Christmas break. The House Minority Leader, Mr Paul Ohonbanmu, condemned the sack of the workers and called for thier immediate recall.

The House subsequently passed a resolution calling on the governor to recall the sacked workers. Their sack followed a circular signed by the Secretary to the State Government, Mr Pally Iriase, directing the General Manager of the ECTS to sack the workers since the administration that employed them has been declared illegal by the Appeal Court. That same circular also dissolved the State Oil and Gas Commission but its members had gone to court to challenge the dissolution.

Ohanbanmu, who was furious about the decision of the state government, which seems like a contradiction of the promise by Governor Oshiomhole to employ 10,000 workers so as to reduce the 'alarming' unemployment level in the state, stated on the floor of the House that “yes, we are aware that the Appeal Court declared Osunbor’s administration as illegal, but it does not mean that all the actions he took were illegal.

If that is so, this House came into being due to the proclamation of the former governor, are we now saying that this House stands dissolved? Osunbor’s administration was illegal but his actions are not illegal and that is why we condemn the sack of the 95 workers.”

After the heated debate in the House that fateful day and the subsequent resolution calling on the state government to recall the sacked workers, the brewing crisis deepened when the governor summoned the House leadership, led by Speaker Zakawanu Garuba, to the Government House so as to resolve issues involved.

But, surprisingly, Vanguard observed that the Speaker and other leaders of the House were embroiled in a serious argument with the personal staff of the governor and they stormed out of the Government House shortly after the incident. It was later learnt that the Speaker and others were kept waiting for several minutes with out seeing the governor, they apparently ran out of patience and decided to leave.

A driver to one of the House leadership told Vanguard that “this is always the situation each time oga comes here to see the governor. When Osunbor was here, he would not allow the Speaker or any of the House leadership to spend a minute waiting for him, but since this governor came in, we wait for over 30 minutes before my oga will see him.”

When Vanguard confronted the Speaker on the issue, he declined comment, rather, he decided to address the issue of the sacked workers. “If you look at majority of the people that were sacked by the governor, 70 per cent of them were employed over 20 years ago, you can say that only 30 per cent of them or even less were employed during the administration of Osunbor, so what are we talking about?

“The person who wrote the petition which we've now dealt with, has worked for over 25 years so will you now come to say that he was employed by an illegal government or that it was one of the god fathers that employed him? We have passed a resolution calling on the governor to recall the sacked workers because that decision was unjustifiable and we expect him to execute the House’s resolution.”

When he was reminded that the governor had insisted that the sacked workers remained sacked, Speaker Zakawanu reiterated that “We have sent him a copy of the resolution and on that resolution we stand. Whatever he must have said has not been communicated to the House and that is the situation for now.”

One of the law makers, who craved anonymity, lamented that “since the governor came in, he has not consulted the House when taking some major decisions as if we are not representatives of our people. You press people are also part of the problem. We noticed that when Osunbor was there, you people criticized him a lot but what is happening now? Are you people not seeing that there is lawlessness in the state. Did you remember the day we called on the governor to give us a blue print on how he intends to develop the state? We did that because we discovered that nothing is happening.

“He is yet to submit the list of his Commissioners up till now, yet, you people are not asking why. Because of that, we sat till 24th of December, yet, we did not receive the list. He promised to employ, at least, 5,000 workers before December, he has not employed one and we are in January. As representatives of the people, we have the right to comment.

“The reason why the House is even calm now is because if we start pointing out his sins, they will say we are fighting him because PDP dominates the House or he refused to give us money. Every body knows that this is a propagandist government. But one thing I will tell you is that we will not be intimidated and we must stress that the right thing should be done”.

Surprisingly, apart from the battle with the state House of Assembly, the governor is still at logger head with members of his constituency, the organized Labour, in Edo State. Shortly after the House’s resolution that the sacked 95 workers of the ECTS be recalled, the Nigeria Labour Congress (NLC), the Trade Union Congress (TUC) and the Joint Negotiating Council (JNC), after an emergency meeting, condemned the action of the state government and backed the resolution of the House of Assembly, which called for the recall of the sacked workers.

In a communiqué signed by the leadership of the unions, it also expressed shock over the demotion of the Permanent Secretaries and the subsequent appointment of new ones and urged the House to ensure their recall.

The communiqué appealed to the governor to “revisit the decision with a view to regularizing their appointments and re-instating them. And we thank the lawmakers for taking a solid step on the matter.” It further reminded the governor of “his campaign promise of paying workers of the state a living wage comparable with the Federal Government workers. And we appeal to you to also implement the new teacher’s salary structure. We appeal to government not to also witch hunt those worker who refused to be members of their political parties.”

While commending the governor on his moves to create jobs for the youths of the state, the communiqué also frowned at the deduction of 10 per cent from the allocation of the Local Government Councils without the approval of the House of Assembly.

On the ban on the collection of illegal levies by the state government, it commended the action but, urged the state government to define revenues that could be collected by the Councils and that of the state, saying that the blanket ban is taking a negative toll on the finances of the Councils which, according to it, is unhealthy.

Vanguard further learnt that the leadership of organized labour is not happy with the governor because of the alleged bashing from him that they are stooges of the past administration.

Apart from the Organized Labour, Oshiomhole will also have to face the larger PDP in the state. The general believe is that what will make or mar the AC in the state is appointments. And, already, there are three factions in the party today.

The Igbinedion led faction, the faction led by Pastor Ize-Iyamu, former Secretary to the State Government under Lucky Igbinedion, and the Governor Oshiomohle/Labour Party faction.

A chieftain of the party told Vanguard that “Osunbor was the problem of the PDP but now he is gone. We are watching and bringing our real members back to the party. We are not afraid whether we will bounce back because we know we will. The governor is already hobnobbing with Igbinedion.

“You can see that he has announced Igbinedion’s in-law as the Deputy Chief of Staff. Does that not tell you that something is happening in this state? The same old people are back but we will fight them, no matter what it takes. You will agree with me that if not for the fact that Osunbor messed up the party, he would have been a hero today. But we are watching”.

These are the challenges Governor Oshiomhole would face this new year. But it would be difficult for the opponents to have an upper hand if he performs.

Assets C’ttee cannot audit the Auditor-General- EDHA

BENIN CITY – Edo State House of Assembly yesterday in Benin City declared that the State Assets Verification Committee has no authority to audit the Audit-General, adding that it is the constitutional responsibility of the state Legislature.


Announcing it during plenary, the Speaker, Rt. Hon. Zakawanu Garuba said the Executive arm of government should not carry out the duty of the Legislative Arm, explaining that such act had led to avoidable unprovoked litigation which the state House of Assembly was being compelled to spend its scarce resources on, citing the case of Edo State Oil and Gas Producing Areas Development Commission (EDSOGPADEC) and Edo State Independent Electoral Commission as examples. He pointed out that such bodies were supposed to be independent, and should not be subjected to scrutiny by the Executive arm.


Meanwhile, the State House of Assembly has passed a resolution ordering the re-instatement of Prof. Patrick Ehi Osho as a member of Edo State Judicial Service Commission with all his entitlement, privileges, allowances and obligations.


The Parliament also resolved that the letter that ordered the termination of his appointment written from the office to the Secretary to the State Government be set aside. The Speaker directed that clean copies be sent to the governor, chairmen of both Edo State Judicial Commission and National Judicial Council.


The resolution of the State House of Assembly flowed from the amended resolutions in the report of its standing committee on Judiciary, Human Rights and Legal Matters on a petition titled “Illegal and Unconstitutional Removal from office as a member of Edo State Judicial Service Commission” dated January 28, 2009, presented by the Chairman of the Committee, Hon. Kingsley Ehigiamusor.


Similarly, the House struck out a petition titled Removal of Hon. Ofure Osa-Uwaigie as Deputy Leader of Oredo Local Government Area Legislative Arm”, dated February 6, 2009.


During plenary, the House gave the Bill on the Edo State Youth Employment Scheme (Edo Yes) Agency and for matters connected therewith H.A. 21, 2009, its first reading after which the Speaker, Rt. Hon. Garuba directed that steps should be taken to list it for the second reading.

Nigeria: Salary Cut - RMAFC Yet to Decide on Percentage

The percentage cut in the salaries of some political officer holders suggested by President Umar Musa Yar'adua cannot be fixed now until it is well deliberated upon, the Revenue Mobilization, Allocation and Fiscal Commission (RMAFC) said yesterday.

Chairman of the commission Engineer Hamman Tukur told newsmen in Abuja that the President's letter has certain implications which may take sometime to analyze and digest before any amendment in the current revenue package is proposed to the National Assembly.

President Yar'adua had written a letter to the commission last Monday, suggesting a downward review in the current salary package for certain political, public and judicial office holders in the country. In the letter, the President cited the current global financial meltdown and the declining oil revenue as the main reason to review downward the recurrent costs of government in order to maintain the momentum of the country's development. Briefing newsmen at an emergency meeting where commissioners of the revenue body deliberated on the president's request, Tukur said it is difficult to say when a new salary for the affected workers will be fixed.

He said: "We can't say this is our response now without digesting Mr. President's letter. The effect of the letter has many implications, so we cannot say now this is the percentage we are going to reduce from the present package.

"We are perpetually looking at market issues and all our zonal officers are looking at the market.

This commission has to deliberate and work out a realizable package. Whatever decision we arrive at here now, it will still go to the National Assembly." Tukur said since revenue packages that the commission deals with are in different versions as they affect the legislature, the executive and the judiciary, the commission needs to study the particular aspects of the constitution that deal with that. On whether the President's directives affects local government chairmen and such other categories of political office holders, Tukur said they may be affected too.

"But one thing that you need to know is that some people would say that you cannot reduce my salary unless you demote me from my current level. So, we have to legally review the remuneration and come out with a strategy on that", he said. In the current salary package for political office holders, the President receives as basic salary N3,514,705, Vice President N3, 031,572.50, ministers N2, 026, 400, ministers of state N1, 957, 580, special adviser N1, 942, 875, and auditor general/ permanent secretaries N1, 925, 865.

While all the goverment of serious country all over the world are slashing their interest rate to 1% sometimes 0%. The cabal that runs the Nigeria banks and central bank still maintain this clueless economy sense. Yaradua thinks by reducing the salary of the political office holder will improve Nigeria economy situation as if this people really depend on their salary to survive . How can any nation that have the interest of her citizen at heart justify 30% interest rate?

Salaries of government functionaries is only fraction of the expenses and allowances they collect  and that is a heavy weight to the overhead cost of running the government of the day.

@ Lawyer, Brownbonno and Papabrowne, let me update you guys on my recent adventure in the picture taking new year resolutionist agency agenda.

After all the 'accusations' of laziness, off I went with my digicam just before the end of last year. I proceeded to take pictures of some properties I had on my hands. Having satisfied myself that I had sufficient to silence the nairaland naysayers, I proceeded to try to upload the pictures. And that's where the whole drama started. Try as I may, the pictures wouldn't upload before the internet would be disconnected. Day after day since the first day of this year, I tried and tried and tried. Sometimes even waking up in the early ungodly hours just to work. No show. Then three days ago, while doing the same, I decided to take the laptop to the bedroom and lay my head down while waiting for the effing thing to upload. Eureka! I made a great discovery. The internet connection was better. I had been using one of the corridors as my office and the network was no good there and I hadn't noticed. So I thought surely, I would be able to upload my pictures now.

Then to my utter dismay after the picture ought to have completely uploaded, NAIRALAND gave me an error message: YOUR FILE IS TOO BIG. What the fffff? I could not upload more than 200KB at a time. What? In this day and age? My average file was 600KB.

So, I've only been able to post the pictures of stuff that are under 200KB so far on one of my ads.

Unfortunately you have not been able to silence the naysayers at this point.You need to do more research on how to reduce photo file sizes.Thanks for the efforts so far.

For example, The UK already has a good system and they have data on 'legal' Nigerians in the country 'temporarily' or 'long term'. !
Only the Home Office have such a data base(Not even the Police lol) and might not legally be made available to the Local authorities(Data protection Acts).Morealso the administrative charges will too be much for Naija to pay to the UK authorities.
One of the solutions  is for eligible voters to register with the Nigeria High commission and the election conducted by post.

You are right. There are exceptions. In those cases, it is usually made clear in the job advertisement. Particular jobs to do with national security are reserved for 'UK citizens and nationals'. Exceptions or exemptions are usually made clear at the time of advertisement.

the work of the Houses of Parliament or the security services
judicial or legislative acts and decisions not to prosecute
certain immigration and nationality functions where discrimination is permitted on grounds of nationality or ethnic or national origin

The race relations act 1976 is there to protect you. Discrimination still happens though despite the act. If you feel you have been discriminated against, and don't mind going through all the time and paperwork involved, all you need to do is take it up with the party/parties involved. It is not all about monetary compensation, its also about trying to get those discriminating to stop doing it!

When I first came to the UK, there was situations that I had to let go, but I tell, if anything like that happens now, I will see it to the very end.

If your friend felt she was discriminated against because of her nationality, she should take it up. The proof of burden in racial discrimination cases is on the defendants. The defendants have to proof that they did not discriminate against you.
Discrimination in the employment context on the grounds of race or ethnic or national origins is permissible where being of a particular race or ethnic or national origin is a genuine and determining occupational requirement, and it is proportionate to apply that requirement in a particular case. Discrimination on the grounds of colour and nationality is also permissible where being of a particular racial group is a genuine occupational qualification for the job. The circumstances in which this would apply are identified in the Act.

It depends. I know abt Virgin Nigeria for international routes - if they are in a 'good mood', they will lodge you in a hotel and give you 60% off your next ticket purchase (valid for one year).

Last week, my flight from London to Scotland the flight was cancelled, no compensation, i went back the next day the flight that was supposed to be for 7;20am, was delayed till 2:00pm, they did not give us any reason, and nobody fit cough, by the time we got to the tarmac, we discovered that the airplane was covered with snow, it was in our presence they desnowed and fueled the plane, all dem Britico's no fit talk until I and one Naija boy started asking questions, these people get rights at all  huh
Airlines won't have to pay compensation if the reason for delays or cancellations was due to "extraordinary circumstances".
Airlines are likely to argue that bad weather, strike action, or delays caused by air-traffic control or security alerts are outside their control.

are nigerian airlines under some sort of international ( customer service) laws when they are travelling out?
There is case at hand where a Nigerian Airline(Name with held for legal reasons) cancelled the second leg trip back to the UK without informing the traveller or her agent.The passager is at the moment demanding a compensation of 600 Euros(pounds equivalent).The EU Regulation 261/2004 did spells out travellers rights in an event of denied boarding,cancellation etc.
Unfortunately most Naija travellers takes these breach for granted and allow the airlines to go free.
