₦500 Million Copyright Suits: Appeal Court Affirms Davies Iyiegbu Landmark Victory Vs Globacom Limited

The Nigerian court of appeal has reaffirmed that software developer Davies Iyiegbu and CEO of Torley Nigeria is the copyright holder of mobile recharge card advertisement in Nigeria and has sustained all 3 arguments against Globacom Nigeria Limited.

Davies Iyiegbu has again won Globacom for what is considered one of the biggest copyright lawsuits in Nigeria and spanning over 10 years in court represented by The Chamber of Paul C Ananamba (SAN), which sued Globacom in 2013 on behalf of Davies Iyiegbu, were determined to bring GLO to justice and set an exemplary deterrent to companies who thrive on Intellectual property theft.

The court of appeal agreed with the Federal High Court judgements and awarded damages against Globacom.

You recall that in 2014, the original lawsuit was filed with the lower court, legal tussle has ensured between Davies Iyiegbu and Globacom Limited filed at the Federal Hight court, in Lagos with suit Number FHC/L/CS/609, there were overwhelming evidence against Globacom including video recordings of the meetings, events leading up and after the discussion.

After review of evidence which involved visits, videos, emails, calls and physical exhibits, the court determined that Globacom infringed on Davies Iyiegbu’s copyright which was issued by the Nigerian Copyright Commission by carrying out 3rd party advertisement on printed recharge card, after series of meetings and negotiations were on going with Davies.

Davies has gone on to build multiple businesses such as the Study in Europe Mobile App, Torley Nigeria Champagne brand and is an author of an Amazon best seller book on entrepreneurship titled “Foreignpreneur”: which helps to share the story of how to build a business and overcoming challenges and dependencies of your success.

In a statement Davies said “This victory Is for creatives, and a testament that no matter how long justice takes, if you stand for your invention and stay strong you will be eventually victorious. The Nigerian youths are one of the smartest in the world and today we have demonstrated that, and I want to thank the Nigerian justice system for setting a deterrent to big multinational companies who steal ideas that can help foster a vibrant economy in Nigeria.”

In the video, he tendered his unreserved apology to Nigerians, kneeling and claiming it was not his intention to scam people.

He appreciated those who contributed money and prayed that God blessed them before adding that news of him defrauding people was all fake news and that was why he is clearing his name.

However, he did not go into detail to confirm the severity of his alleged complications and if indeed, there was a failed surgery as he appeared totally transformed.

The 10th year memorial anniversary of the transition of Princess Tejumade Alakija has started in Virginia, the United States of America, AMILOADED reports.

The event started with a church thanksgiving service held at The Redeemed Christian Church of God, House of Praise, Chesapeake Virginia and a Luncheon at the residence of Dr. Akomolafe and Mrs Toyin Lambo-Akomolafe, her daughter, last Saturday.

Speaking on behalf of the family, Lambo-Akomolafe said a lot of Nigerians are beneficiaries of Alakija’s legacy of hard work, discipline and commitment.

“Plans are in place to perpetuate her name in the consciousness of Nigerians because she is an icon of education development, public service and women advancement,” she added.

Also speaking at the event, Alakija’s nephews and nieces led by Prince Abimbola & Olori Esther Olagbaju, Dr Dehinde and Olori Arleen Orafidiya, Prince Tokunbo Adeniji, Prince Wale Adeyemo, Princess Bolatito Mosaku, Mr Akin Fadeyi and Omo Oba Adetola Fadeyi, extolled the legacies of the deceased.

They said they were being comforted by the legacies she left.

Other dignitaries at the event included Ambassador and Mrs Myrick, Mr and Pastor (Mrs) Olugbemi, Pa Lambo, Mrs Layeni, Mrs Yemisi Omisore, Mr Soji Johnson, Lola and Joke Kassim, Foluso & Bolanle Baruwa, Wale and Folasade Oshin, Ajibike Famewo, Adegboyega Adekemi, Folabi and Folasade Ashimi and Mr Fadahunsi.

The family noted that memorial event will continue in Nigeria on August 23 which marks 10 years of Alakija’s demise.

Alakija (nee Aderemi), transited to glory on August, 23, 2013 at the age of 88.

She was born in 1925 to the royal family of late Oba Adesoji Aderemi Tadenikawo, a former Ooni of Ife and Governor of Western Nigeria and Queen Olapeju Aderemi (nee Omisore).

Princess Alakija was a Nigerian Civil Servant, Educator, Administrator and Women's Rights Activist during her lifetime.

Late Alakija started her Primary education at Ile Ife, later attended Kudeti Girls School in Ibadan and CMS Girls School Lagos for her Secondary education after which she enrolled at the Prestigious University of London to study History and Postgraduate Studies in Education at Oxford.

She started her civil service career as a teacher at Queens School Ede, Abeokuta Grammar School and led the establishment of Anglican Girls Grammar School Ijebu Ode at instance of the Anglican Church.

Alakija joined the Western Nigeria Civil Service and served as Assistant Secretary at the Ministry Works, and later the Ministry of Trade and Industry before becoming a Permanent Secretary at the Ministry of Education.

She retired as Head of Civil Service Oyo State, the first female to be so appointed in Nigeria. She was also former Pro Chancellor of three Universities, University of Benin, University of Nigeria Nsukka and University of Abuja.

Timothy Adegoke: Oriyomi Hamzat should release CCTV footage - Adedoyin's lawyer

One of the lawyers representing Dr. Ramon Adedoyin, the Chairman of Hilton Hotel, Ile-Ife has challenged the Ibadan-based blogger who claimed to have seen the CCTV footage of how the OAU Masters degree student, Timothy Adekoge was allegedly murdered in the hotel, to release the footage to the public to confirm his story.

The lawyer, Mr Abiodun Williams also called on the police to invite Mr. Hamzat to assist with their investigations since he claims to know so much about the unfortunate death of Mr. Adegoke.

"We don't intend to join issues with Mr Hamzat on his hatchet job and efforts to incite the public against Dr. Adedoyin over the unfortunate death of Adegoke.

"We think, however, that the police ought to involve him in their investigations since he claims to know so much about the incident.
"His recent claim that he saw the CCTV footage establishing murder is grievous and should not be taken lightly by the police. In fact we challenge him to post the footage online so that the public can see the faces of the murderers as he has claimed.

"Dr. Adedoyin has been in police custody for about two months, denied of bail and even a chance to be attended to by his doctors.
"As his counsel, we believe in his innocence as he was not even in Ile-Ife or has been in the hotel at least one month before the incident. We are therefore curious to see Mr, Hamzat's CCTV footage showing our client entering Adegoke's room with two others and, therefore, urge Oriyomi Hamzat to post the footage online if only to show that his previous allegations were not deliberate efforts to incite the public against Dr. Adedoyin.

"We believe an investigation of this nature should be carried out carefully with diligence by the police and not a meddlesome interloper; and this should not be an avenue to settle some personal scores against an individual or play on the gullible public to increase Oriyomi's social media followership.
"The need to unravel the cause of Adegoke's death is of utmost importance at this point and the police should spare no efforts in ensuring that innocent people are not made to suffer as a result of social media bullying, injurious falsehood, criminal defamation and wicked propaganda," Mr. Williams further said.

... Cause of death still unknown

The non governmental organization, the Vanguard for the Truth Foundation has disclosed that investigations to unravel the cause of death of Timothy Adegoke, the OAU Masters degree student who reportedly died at the Hilton Hotel, Ile-Ife, may have been stalled following the inability of police to establish a case of murder against the proprietor of the hotel Chief Ramon Adedoyin and his staff currently in their custody in Abuja.

According to the spokesperson of the Vanguard for the Truth Foundation which has been conducting an independent investigation on the matter, Mr Adewale Aderibigbe, noted that the police have so far relied mainly on interrogation of the suspects as the autopsy and other preliminary inquiries have not revealed the deceased's cause of death, a situation that seem to have stalled their investigation.

According to Aderibigbe, the only offence against Chief Adedoyin so far, remains his failure to take decisive and legal actions when he was informed that a dead body had been found in his hotel. The Foundation further revealed that he may be charged to court soon for this, adding that no other offence has been traced to him so far.

The Vanguard for the Truth Foundation claimed that police investigations have also not revealed much against the hotel staff as they were all said to have maintained that Timothy's body was discovered by one of the hotel receptionists who immediately raised alarm, calling the attention of the manager who in turn called the chairman of the hotel.

"All the staff, according to the police source, were consistent in their evidence that they acted on instruction to evacuate the body and dump along Ede Road, Ile-Ife in order to protect the image of the hotel."

The Foundation also noted that Police investigation showed that Adegoke's body was buried by officials of the Water and Environmental Sanitation Department of the Ife Central Local Government with clearance by the Divisional Police Officer of the Nigerian Police Force, “A” Division, Moore, Ile-Ife, Osun State when it was discovered where it was allegedly dumped.

Mr Aderibigbe said in an interview when asked for comments about the development, one of the lawyers representing Chief Adedoyin who pleaded anonymity decried the method of investigations so far, saying the police seemed to have been swayed by the social media noise and decided to centre all their investigations only on Chief Adedoyin and the hotel staff.

The Foundation also raised some pertinent issue which was observed in the police investigation

*The police investigators have either deliberately or negligently overlooked several other factors that can assist them in their investigations. For instance, how will they justify the fact that two months after, none of the guests in the hotel at the time of the incidence, including those on the same floor with the late Adegoke was questioned by the police?

* The fact is, there were fifteen other guests/lodgers at the hotel on the night of 5th-6th of November, 2021. As a matter of fact, there were other guests who lodged on the same second floor with the late Timothy Adegoke.

*"The police ought to have invited all these guests and lodgers and obtained their statements. Some of them might have seen or heard things or in possession of information that might have gone a long way to assist them in getting justice for late Timothy. Up till this present moment, the police investigators have not done so.

*"As at the moment, the police do not have any concrete evidence that could establish a case of murder against any of the suspects in their custody. They seem to have been taken in by the social media and unfounded allegations that the man was a victim of ritual murder by Chief Adedoyin.“

* "The rumour widely spread by an Ibadan-based broadcaster was that Chief Adedoyin cut the throat of the deceased, removed the oesophagus and buried the remains in the hotel premises. Yet, both police investigations and the autopsy report have established this assertion to be concocted lies.

* "As you are probably aware, the autopsy report conducted by a team of seven consultant pathologists, including three professors, unanimously maintained that the deceased's internal and external organs, including the Instruments, were complete, untouched and in normal positions as they ought to be. Not only that, they also reported that no incision, cut or blood injuries, bruises or wound were found on his neck. This put to rest the rumours, falsehood and lies that were earlier spread on the social media that the deceased neck was cut and some of his body parts removed for rituals.

* "It is also evident that the police could not fully rely on the autopsy. For instance, no toxicology tests were conducted on the body and other internal organs to determine whether the deceased died of poison, chemical inhalation or other harmful substance (s) or of natural causes or diseases. Therefore, it will be medically and scientifically wrong to rule that the deceased did not die of natural causes.

The Foundation said it believed the police ought to, at this point, either order for a fresh autopsy or a further review of the earlier one as the result currently in their custody, as it stands, establishes no culpability of anybody therefore raising substantial doubts on its stated outcome. This is one of the major reasons it has not been made public.

"And this is why I strongly believe that the police should have widened the scope of their investigations rather than narrow and centre it on Chief. Ramon Adedoyin.

"The extant position of law in Nigeria is that the culpability of anyone alleged to have committed a crime must be established beyond any reasonable doubt. If any doubt is raised, then it must be resolved in the favour of the person accused. This is not to condone or cover any act of criminality, but to bring out the truth and also assist the police and forensic experts in their quest to unravel the cause and circumstances leading to the death of late Mr. Timothy Adegoke.

"We also believe that the police, after two months of investigations, ought to have released Chief Adedoyin on bail or at least charge him to court, unless there's more to this case that is unknown to us,” the lawyer further said.

What was it like beating many other contestants to win Mr Ideal Nigeria in 2020?

It was a mind blowing experience because that was my first attempt and I emerged as the winner amidst over 100 contestants.

Share your experiences after becoming Mr Ideal Nigeria 2020.

I enjoyed the media tour to TV/radio interviews, mostly online tho due to Covid-19. There were very few events due to the lockdown and endsars protest. I was able to feature in couple of TV ads, reality TV shows, walked at Mercedes Benz Global Fashion Week in Accra Ghana amidst other things.

Your immediate predecessor, Mr Ideal Nigeria 2019 winner, Emmanuel Umoh is currently in the Big Brother Naija (BBNaija) Season 6 house. What's your reaction?

I'm happy for him, it's a platform that projects him to the world and I wish him all the best.

What are you currently into now?

I'm currently into modeling, influencing, sales of fitness/sports equipments. I trade cryptocurrency as well

How Do you keep your body hot and in shape?

I love to look good, so I work out regularly from home and eat right

How do you handle ladies that are attracted to you as a good-looking young man and Mr Ideal Nigeria?

I'm used to female attraction, I know how to handle them quite well.

Any advice to some that look up to you in terms of male pageants in Nigeria?

If you want anything go for it, avoid distractions and be focused. Don't worry about what people say, prepare like a winner and you will emerge as a winner. Good luck!
