Last Friday, Nigeria achieved a significant milestone in its war against corruption and looting of public funds.

But the war and the victory were on foreign soil in faraway Washington DC, where United States District Court Judge Barbara Jacobs Rothstein announced a default judgement against Emeka Ugwuonye in a case that has lasted over five years.

The judge found Mr. Ugwuonye liable on all claims made by the Embassy of Nigeria in Washington DC, and awarded the Embassy monetary damages in excess of $2 million.

Mr. Ugwuonye’s troubles in the United States with the Embassy, his former client, concern diversion of $1.55 million proceeds of tax refunds in a real estate transaction in Washington DC he undertook for the Embassy.

Mr. Ugwuonye, who practiced law in the State of Maryland, has proved to be a bad lawyer, but perhaps an even worse gambler or mathematician who chose the risk of a $1.55 million check in exchange for monetary damages that could rise to $6.2million. He also stands to lose his professional licence and even personal liberty.

In the five years in which Mr. Ugwuonye has been defendant rather than counsel in a State of Maryland courtroom, he has suffered loss after loss, including even the very companies he used in the real estate transaction on behalf of the embassy, for failure to pay property taxes.

He has forfeited, at least twice, ECU Associates PC, the firm he used in some of the real estate transactions. Originally incorporated in July 1999, the firm was forfeited in October 2006, following which Mr. Ugwuonye incorporated ECU Law PC with the State of Maryland between January and March 2007.
Between April and June 2007, Mr. Ugwuonye somehow revived ECU Associates PC to receive money from the Nigerian Embassy for shady real estate deals, but he would eventually forfeit the company to the State of Maryland, like ECU Law PC.

In October 2009, Mr. Ugwonye sued various Nigerian citizens and reporters who questioned his sale of the properties and handling of the tax refunds. He lost all those cases.

He has also remained suspended from practicing law in Washington DC and New York jurisdictions after the state of Maryland suspended him for mishandling cases involving some of his clients.

Filing a motion for default judgement on May 23, the Embassy asked the judge to compel Mr. Ugwuonye and his firm to pay $6.2 million in restitution and additional costs, as follows:

· $1.55 million in base compensatory damages;

· Prejudgment interest on the tax refund in the amount of 6% per annum commencing on November 20, 2007;

· Punitive damages in an amount equal to two times the total compensatory damages, inclusive of prejudgment interest;

· Post-judgment interest in accordance with 28U.S.C. § 1961; and

· Such other relief as the court may deem just and proper.

Evidence presented to demonstrate the scope and severity of Mr. Ugwuonye’s fraud in the matter and his contempt of the Court’s procedures and orders included documents showing that he recovered the tax refund on the Embassy’s behalf, lied to the Embassy concerning the whereabouts of the funds, and proceeded to use the funds for his personal benefit.

But as had been the pattern, Mr. Ugwuonye was absent at the hearing, having filed a 3:00 a.m. motion requesting an indefinite continuance of the case
“He did this clearly fearing vigorous questioning and simply failed to appear, in the process further exasperating the court,” said a lawyer for the Embassy who noted that Mr. Ugwuonye’s absence was particularly glaring in light of the court’s scheduling order which cautioned him not only to be present, but also prepared to respond to [the] Plaintiff’s allegations.”

The lawyer recalled Mr. Ugwuonye’s flouting of discovery deadlines; court deadlines to file motions and oppositions to motions; failure to produce documents and information in discovery; violating a court order compelling discovery, and failing to appear at his duly noticed deposition, all of them held as evidence of obvious disrespect for the U.S. justice system.

In her judgement, Judge Rothstein announced her intention to award the Embassy $1.55 million in compensatory damages, pre-judgment interest at a rate of 6% per annum, post-judgment interest, and certain categories of attorneys’ fees and costs, bringing compensatory damages and pre-judgment interest alone, as of that day—July 12, 2013—to $2,075,131.30.

The judge will issue a written order over the next few weeks summarizing her findings and specifying the full scope of damages she is awarding. She has already indicated that she will seriously consider the Embassy’s request for punitive damages.

A lawyer familiar with the case said, “An award of punitive damages in the context of default judgment is highly unusual in the U.S. legal system when the parties have not directly litigated the merits of the case.

“Nonetheless, Judge Rothstein agreed to consider a punitive damages award due to the extraordinary nature of the matter. Specifically, she expressed concern that the Embassy’s views of the U.S. legal profession had been tarnished by Mr. Ugwuonye’s outrageous misconduct.”

Beyond all that, it is noteworthy that Judge Rothstein urged the parties to pursue the bar complaint the Embassy has filed against Mr. Ugwuonye in the State of Maryland, another highly unusual step on the part of the judge, but reflecting the severity of Mr. Ugwuonye’s professional fall.

The irony however, is that while Mr. Ugwuonye is being made to pay back what he stole from Nigeria in far away America, he has tactically relocated to Nigeria where he is rebranding himself as an “anti-corruption crusader”.

In Nigeria where Mr. Ugwuonye is facing several other criminal charges, he continues to thumb his nose at the justice system, with perhaps a solid understanding that the justice system is weak and slow.
In the Senate, the committee investigating how the Embassy of Nigeria came to sell off many properties in the Maryland area in the first place and the propriety of the sale of those real estate holdings has treated Mr. Ugwuonye like a star, even allowing him get away with a petition in which he sought to turn his accusers and victims into criminals

If one scrolls down to my post on "If all Nigerians used their heads" where I used pure logos to show that Soludo's claim of GEJ stealing 30 trillion was impossible as our budget for 5 years was not up to 30 trillion, as usual, a Northerner came on and put this picture and said "Baby factory. this is all Igbos are good at." Of course he assumes I am Igbo and also since if he and his people were to do their usual massacres in the North, I will be classified as Igbo, let me respond to him as no different from an Igbo (though Urhobo and proudly so)

When your only argument against me is a perceived wrong by my people... baby factory, totally ignoring the salience or otherwise of my post, you amuse me. And if it is "baby factory" that you consider my people's greatest disgrace, then I am the proudest person on earth.

Speaking of the earth, both your Allah and my Jehovah said to Adam and Adamu "go and multiply." So forgive me if I do not see having children as a wrong. Speaking on joys of motherhood and adoption and surrogate motherhood and all such matters, I use this medium to ask state governors in the south and Middl-belt, areas of modern up-to-date thinking, to immediately look at their adoption and surrogate laws and bring it up global standards. It should be quick and as secretive as will ensure confidentiality as well as monitoring to avoid abuse and ill-treatment of adopted kids. Furthermore, enabling laws that will guide sperm donation, egg donation, surrogate motherhood etc etc should be made and so these police raids and illegal "baby factory" can be a thing of the past. Hiding away teenagers to give birth happens only because it is illegal so to do. Let us make it legal so good hospitals can offer such services. This will also put a seal on the mouth of some stupid Northerners who do not know the value of children.

1. First, you claimed that the $2.2billion extra budget for arms was a scam that it was "only" $300m. However, the said $300 million only form a part of the $2.2billion and was repatriated late 2014, while the total sum of the extra-budgetary spending for arms started even before that time.

Many have been puzzled and piqued over this question. How did the new Buhari/Osinbajo government suddenly and rather drastically improve the power situation in Nigeria literally overnight? Apart from Asari-Dokubo and the people of Borno, most Nigerians have celebrated stretches of uninterrupted power like never before.

My niece and nephew were overheard arguing on if it had been a full 24 hours of uninterrupted light. One said it was, the other said it was over 20 hours but not 24. In the past they barely had 20 hours of light per week. It's been so across Nigeria, an unexplained miracle of the new "change" government.
Some die-hard Jonathanians have claimed the glory, "Jonathan did it," they say, "after all has Buhari repaired any power plant?" Some have even accused Buhari and Osinbajo of sabotage, claiming they kept the power down for the 16 years of PDP to pave way for their 2015 election victory.

Let There Be Light
I believe I figured out what the miracle was today and realize the answer is simple and rather painful. While chatting with a friend and ENDS General, who rejoiced that he had not turned on his generator for a whole month, it suddenly hit me. I asked how much fuel he bought into his generator per month, "N30,000" he replied. I asked how much fuel he bought into his car monthly, he said, "about N5,000 a week, about N20,000 a month." It was so clear. I called up several other friends and asked the same question. One said, no, that he doesn't use more petrol for his home generator than his car, then he said, actually I use the petrol for my office... "yeah, I do spend more fueling a generator than my car."

You have been kept in darkness for the 16 years of PDP, not so much because of the generator cabal, but because of people more wicked than them. Because of the fuel cabal. It is the fuel cabal that ensured that you never had power, the same cabal and for the same reason that they ensured that your refineries never worked. They are the ones that said, "let there be darkness over Nigeria."
The Nigerian fuel cabal make their trillions from fuel subsidy payments. The more petrol Nigeria consumes, the more money they make so long as the fuel is imported and not made by our refineries. According to the National Bureau of Statistics, fuel accounts for over 40% of Nigeria’s total foreign exchange expenditure on imports! When Nigeria is in darkness, there is a party in the fuel-cabals' homes. We saw the generators as noise makers and income for the generator marketers, but we rarely recognized them as a cash cow, magic money for fuel cabal. Nigeria uses possibly double the fuel it uses for transportation, for providing power. Like a magic trick, our eyes were covered from realizing the real hustle of generators – doubling Nigeria's fuel imports.

And this explains why, the minute Buhari and Osinbajo came into power and they repaired those refineries, banned those 120 ships and called all the fuel cabal to line-up and account for and return the billions in payments they have gotten for supplying fuel they don't even supply, that same minute the power became steady.

We are talking of $5 billion in imports a year, more than double what it should be, thanks to our generator consumption. There is a long chain that makes money in this scam, from the government to the banks, to importers, to the supply chain and fuel stations. The banks for instance make as much as $100 million annually on premiums on forex sold to marketers to import this fuel.

How did the fuel-cabal keep the power off? The Buhari government must investigate old NEPA, they must investigate PHCN. There are people in those agencies that were on the payroll of the fuel cabal who kept the light switch off. Of course the privatization needs to be reversed as many have said. Imagine, the very same fuel cabal invested in keeping Nigeria in darkness bought PHCN assets and now controlled the switch their very selves! That's getting the wolves to tend the sheep.

The fuel cabal must sit in the dock! I have mentioned before that our refineries were never really that spoiled . Our power was always better than we suffered through. What Nigeria suffered for 16 years was people so wicked they kept us in darkness to fill their pockets. After all how can stuff built in early post colonial "prehistoric" era be impossible for us to build and maintain for 30 years of PDP and PDP's godfathers? Of course not. We could have solved our refinery problems 10 times over and our power problems 20 times over had the fuel cabal not collaborated with the IBB and his PDP sons' governments all these years to shut off our refineries and shut down our power supplies so they raked in their billions.

How the lack of steady power hindered Nigeria's development can never be overstated. I believe these matters must be seriously considered, investigated and there must be justice for any and all culprits.
