Odidigboigbo:
Whether NAS delete it or not, that section of the electoral act cannot stand, it's at variance with the constitution. The constitution is clear on this matter, any act or law that is not in concurrent with the constitution, the constitution takes precedence. The constitution says governments appointees should resigned a month before the election, If NAS is serious, they supposed to have amends this section of the constitution before inputting it in the electoral act.
How is the current law incompatible with the 30 day rule? If you resign 1 year before elections, havent you resigned at least 30 days before the election?

Politics › Re: Deletion Of Section 84(12): Malami Effects Judgement In Line With The Law by chloride6: 12:40am On Mar 19, 2022
Reinvented:
Bros, I know say you no like am. NASS was serlf-serving adding that clause. When Buhari returned the bill to them, all what requested was for them to delete the controversial direct primaries. Instead of just doung that they forayed into an area that clashed with constitution. That said, the judge did nothing that requires NJC pinishment. The Nigeria Constitution is SUPREME, any law that indirectly changes the constitutional provision is inferior. At Gazette, such sechtion or sub-section is only included like 8(c) DELETED. This is what Malami is doing. The gazetted law will be made available first thing Monday.
If NASS want to amend the constitution, thatvis different, not smuggling inferior clauses here and there.
It's one thing to declare the law null and void its another to delete. The judiciary cannot amend law.

This case will probably be exhausted up and until the supreme court. Malami sneakign a kangaroo judgement on friday isn't going to help him.

I maintain that nobody's rights were violated by that law. It is simply an appendix to the terms of appointment of political appointees.

If this thing scales through, then be prepared for employees in the private sectors, militray and police to go ahead and contest for political officer because of the constitution.

Simple.

Oga small sense for this thing no for bad.. There are 3 arms of government..
1 Legislators - makes the law
2 Judiciary - interpreters of the law
3 executive - executes the law...
Small social studies bro, this 1 no need university degree to understand na.
The legislative has made a law which has been interpreted by the judiciary to have infringed on the constitution with a recommendation to excuteive to delete, which has been carried out.. Again abeg how e take confuse u abeg.. Or u just want to wail. The law is law of d politicians by d politicians for d politicians.. Abeg u dey contest...
The constitution is clear on how a law shall be amended..

I expect that the NJC effectively retires that Judge.
