jay bee: First of all, i'd like to congratulate you guys on your win albeit by default due to no show by the other candidates.

I felt the first contestant did a very good job. You appeared to have spent time to do your research and of course backed it up with adequate references. Your presentation was quite easy to follow and delivery was sometimes flawless.

However, i would have loved to see more examples of why total freedom of speech isn't necessarily a bad thing. You also appeared to contradict your position with your subsequent rebuttal by accepting that the state does need to monitor and even go as far as censoring people on social media.


Furthermore, i'm not sure the second contestant was of any help because most of his presentation was centred around freedom of information when he could have helped the other candidate solidify their position.
I also think he needs to work harder on how he structures his presentation going forward. You need to be able to wow the audience and am afraid you were neither here or there with your submission.

You should also make sure any copied texts are properly referenced at all times.

How will you address the gross misuse of the liberty that Freedom of speech brings, with reference to how GEJ is constantly being ridiculed on social media and a forum like Nairaland?

The second debater can also do justice to this question.
As much as I do not vote for the ridicule of the President of the country,however, lets bear in mind the need for open criticism of government and public authorities - it makes for a healthy democratic environment. Not also forgetting that public authorities have full rights to defend themselves in the face of such criticism.

Recently, an American diplomat, while trying to spite Obama's administration, generally labelled Nigerians as fraudsters(419) working in the US government, an action which strained the relationship of both countries. Had their government censored this broadcast, it's a violation of the diplomat's right to opinion. And as they let it out, it's a defamation of the Nigerian identity. What's your take on this? Should freedom still be unhampered even when it infringes on another human's right?
How about putting the question this way: "Had their Government censored the broadcast, how would we have gotten to know about such comment in the first place?"
Do you not think that there could be some positive sides to the story? Maybe not now, but in future dealings.

Just like Emzybrown noted....We are definitely in the jet age, with the presence of Biometric registration of the populace surely there will soon, no longer be an escape route for offenders. We have the intelligence bureau that are involved in handling issues related with national security, they should employ all means 'positively' available including free flow of information online. Intelligence gathering can also be done on the internet, social medias etc. If these media are restricted, how can this method of approach be possible?

My ignorance lies in the later part of the third paragraph of Chynazom's write-up. You seems to agree with the fact that the government has the right to limit the discussed right.



Later on, you vehemently argue that the government is not supposed in any way to restrict the freedom of speech. My question now is this, what is the essence of you having a cutlass as a man living in a bushy environment and your not able to use it to cut those weeds around you? I mean, does it mean that the right invested in the government to restrict the freedom of expression sometimes amount to a joke?

Let's not dwell ONLY on the negative aspect of freedom of speech. It is part of a very positive medium for practice of true democracy when used appropriately.

In the third paragraph, I mentioned that as much as we have our freedom of speech, we will also be responsible for abuse of this freedom.


So, in my opinion , the Government can curb such menace of by having some sort of social media surveillance agency that can monitor such activity online, this can even help in a way. How? The agency can track and even halt some terrorist activities when they are being incited.

Someone who decides to use the 'freedom' of the internet wrongly should be apprehended.

My esteemed Judges, illustrious coordinators, hardworking moderators, fellow contestants, informed audience, and all other protocols duly observed.
It’s quite delightful being part of this live and online debate, my user name is Chynazom, representing the University of Nigeria and I am speaking against the motion that Government should sometimes restrict freedom of speech.

I’d begin by telling us that freedom is easily defined as the ability to act freely, or a state in which somebody is free to act and live as he/she chooses without being subject to any undue restraints or restriction. (Encarta dictionary, 2009).
Freedom of speech and expression is unarguably one of the fundamental rights of a person and it is closely linked with the freedom of information.

Concepts of freedom of speech can be found in early human rights documents, the ‘Declaration of the Rights of Man and of the Citizen’ adopted during the French revolution in 1789 specifically affirmed that freedom of speech is an inalienable right. The Declaration in Article 11 states that: “The free communication of ideas and opinions is one of the most precious rights of man. Every citizen may, accordingly, speak, write and print with freedom, but shall be responsible for such abuses of this freedom as shall be defined by law.” There are other human rights documents that speak volumes on the rights of a person as regard freedom of speech, but let me dwell on the above quoted. Granted, the government has the right to restrict this freedom but the ‘Declaration’ does not forget to remind us that a citizen shall be responsible for abuse of this freedom.

Freedom of speech should not at any time be restricted by the Government because restriction totally defeats the real essence of Democracy. Democracy is characterized by free and equal participation in Government; how can we fully participate in decision making process when we don’t have 100% freedom of speech or when there are limitations to what we can and can’t say? A true Democratic society should have free flow of information at all times, including free and open debates regarding matters of public interest even when this involves criticism of individuals.

Freedom of speech is not only limited to expression alone, but also involves right to seek, receive and impart information and ideas. (According to John Milton’s argument). This implies that if the Government ‘sometimes’ restrict freedom of speech, it also indirectly restricting the freedom to seek and receive information. Before one can have information to dish out, he/she must have sought them out. How is that possible when there are certain restrictions?
Governmental actions to deny differing points of view, even distasteful or
unpopular opinions, rob us of the range of ideas that might serve the interests
of society more effectively. The right to speak freely, without restraint, is essential to a democratic government because it helps us develop better laws and policies through challenge, rebuttal, and debate.
The ability to speak freely allows us to pursue truth, to challenge falsehoods, to correct mistakes—all are necessary for a healthy society.

I’ll not forget that the main argument here is whether to restrict this freedom ‘sometimes’ or not; but have you ever imagined that if some of these restrictions are not contested, we might gradually and unconsciously lose the freedom to express ourselves in some political matters. How is that possible?
Let me quote part of Principle 2 of the Principle of Freedom of Expression and Protection of Reputation (found in Article 19). It says: “Defamation laws cannot be justified if their purpose or effect is to protect individuals against harm to a reputation which they do not have or do not merit, or to protect the ‘reputations’ of entities other than those which have the right to sue and to be sued.
In particular, defamation laws cannot be justified if their purpose or effect is to:
i. prevent legitimate criticism of officials or the exposure of official wrongdoings or corruption.
ii. protect the ‘reputation’ of objects, such as State symbols, flags or national insignia
iii. protect the ‘reputation’ of the State or nation.
iv. enable individuals to sue on behalf of a persons who are deceased
Most times when Defamation laws are abused, the resultant effect cannot be overemphasised. We would have cases of public open debates and legitimate criticism of wrongdoings being prevented. The rest of the scenario can be imagined.

I imagine what life would have been like if there was no freedom of speech at all; we would have been in an age of modern day slavery . Forums like Nairaland where issues concerning the populace are discussed daily wouldn’t have been in existence. I am of the opinion that this freedom we enjoy should be full and complete, not altered at any time. An informed society should be totally knowledgeable, having no constraints on free flow of information. So, audience lets crave for a society where we are all free to express ourselves and free to know things we should know. Thank you!
