The amnesty program of Cross River state governor, Ben Ayade for the the militant people of Bakassi is yielding dividends as some repentant militants are currently surrendering their arms to the government. 

The former militants and cultists are being documented by soldiers after laying down their weapons and renouncing militancy at Bakassi beach ikang. 

The governor had earlier called on militants and holders of small arms in Cross River State to voluntarily surrender them to government. He said his administration was determined to offer them a viable alternative means of livelihood once they embrace the offer.

Ayade admonished the people to maintain the prevailing peace in the state, advising them to seize the opportunity the disarmament project offers.

Some soldiers were dislodged when the Islamic State in West Africa (ISWA), a faction of Boko Haram sect, invaded Gudumbali, Guzamala local government area of Borno state, on Friday.

Channels Television quoted a resident as saying the attackers looted food items and carted away gun trucks belonging to the Nigerian army.

It is the third time in three months that the village will come under attack.

TheCable understands that some of the soldiers affected in the operation are currently taking refuge at a military location in Damasak, a nearby town.

“Our troops have been dislodged in Gudumbali, and even Kukawa,” one of the soldiers in the theatre command told TheCable on Sunday morning.

While the military said it has intensified efforts to end the attacks, Abubakar Elkanemi, shehu of Borno, recently said the people of the state are still under the insurgents’ siege.

“Nobody can dare move out of Maiduguri by 10 kilometres without being confronted, attacked by Boko Haram,” he had said when President Muhammadu Buhari visited last month.

“Quite a number of farmers are being killed and kidnapped on a daily basis around Molai General Area, which is just 10 kilometres away from the metropolis, along Maiduguri -Damboa -Biu road.”

Sani Usman, spokesman of the Nigerian army, did not respond to TheCable’s inquiries on the latest attack.

Gallant men of the Bayelsa State Vigilante Service apprehended a cultist who claims to be a member of Greenland cult in Swali area.

The suspect was nabbed while he and his gang were robbing around 4:45 a.m on Sunday.

The young man who identified himself as Gift School Oben claims to hail from Ologi in Ogbia Local Government area of Bayelsa state.

After he was given the beaten of his life by the security operatives, the young man was given bottles of drink he stole to cool off before he was handed over to the police.

Socio-Economic Rights and Accountability Project (SERAP), Enough is Enough (EiE), and BudgIT have sent a joint Freedom of Information request to Lt. General Tukur Yusuf Buratai, Chief of Army Staff of Nigeria, requesting him to use his good offices and leadership position to “urgently provide information on the 2015, 2016 and 2017 budget implementation reports of the Nigerian Army, including the amounts released (financial implications) and expended in fiscal years 2015, 2016 and 2017 for the various operations the Army carried out.”

The groups also urged Mr Buratai to furnish them with “the amounts released (financial implications) and expended in fiscal years 2015, 2016 and 2017 for: Operation Lafiya Dole, Operation Safe Haven, Operation Python Dance, Operation Ruwan Wuta, Operation Delta Safe, Operation Mesa, Operation Harbin Kunama, Operation Awatse, Operation Tsera Teku and Operation Crocodile Smile.”

In the FOI request sent last week and signed by Bamisope Adeyanju of SERAP, Seun Akinyemi of EiE and Atiku Samuel of BudgIT, the groups said: “Transparency of the budget process and its implementation is an essential condition to achieve good governance. The reports, if provided and published, will shed light on military spending and put to rest once and for all the perceived lack of transparency and accountability in the spending of military budgets, which has been a subject of intense public debate and concern.”

The groups said: “If the requested information is not provided within 14 days of the receipt and/or publication of this letter, our organizations shall take all appropriate legal action under the Freedom of Information Act to compel you to comply with our request.”

According to the groups: “several billions of naira allocated to the military to defend the country and protect its people have neither contributed to improving the ability of Nigerian soldiers to fight Boko Haram and other armed groups nor provided the much-needed security especially for Nigerians in the North-east of the country.”

The FOI request read in part: “The information being requested does not come within the purview of the types of information exempted from disclosure by the provisions of the FOI Act. The information requested for, apart from not being exempted from disclosure under the FOI Act, would serve the national interest, public welfare, public interest and peace, human rights, good governance, transparency and accountability.”

“By virtue of Section 1(1) of the Freedom of Information Act, 2011, we are entitled as of right to request for or gain access to information, including information on 2015, 2016 and 2017 budget implementation reports of the Nigerian Army, and the amounts released (financial implications) and expended in fiscal years 2015, 2016 and 2017 for the various operations listed, which have yielded no tangible result.”

“Also, by virtue of Section 4(a) of the FOI Act, when a person makes a request for information from a public official, institution or agency, the public official, institution or agency to whom the application is directed is under a binding legal obligation to provide the applicant with the information requested for, except as otherwise provided by the Act, within 7 days after the application is received.”

Earlier today, The Nigerian Army has said it is suspending the operations of the United Nations International Children’s Emergency Fund in the North-East theatre until further notice.

It alleges that UNICEF had shifted from “its duty of catering to the wellbeing of children and the vulnerable through humanitarian activities and now engages in training selected persons for clandestine activities.”

Sequel to intervention by well meaning and concerned Nigerians over the recent suspension of UNICEF operations in the North East theatre of operations,Naija Politico got to know that the Theatre Command Operation LAFIYA DOLE convened and held an emergency meeting with representatives of UNICEF this evening.

During the meeting, the Theatre Command admonished the representatives of the organization to desist from activities inimical to Nigeria's national security and capable of undermining ongoing fight against terrorism and insurgency. The Command also urged UNICEF representatives to ensure they share information with relevant authorities whenever induction or training of new staff is being conducted in the theatre.

Consequently, after extensive deliberations on the need to seek modalities to work harmoniously with the security agencies in the theatre of operation, the Theatre Command has henceforth lifted the three months suspension earlier imposed on UNICEF activities in North Eastern Nigeria.

According to a statement released on Friday by Onyema Nwachukwu, a Colonel and Deputy Director of Public Relations, Theatre Command, this was because UNICEF had “abdicated its primary duty of catering for the wellbeing of children and the vulnerable through humanitarian activities and now engaged in training selected persons for clandestine activities to continue sabotaging the counter terrorism and Counter insurgency efforts of troops through spurious and unconfirmed allegations bothering on alleged violations of human rights by the military”.

Mwachukwu said the Theatre command would not tolerate “this kind of sabotage from any individual, group of persons or organization”, and urged all NGOs and members of humanitarian agencies to keep to their legitimate norms in the discharge of their acclaimed humanitarian duties.

“The Theatre Command Operation LAFIYA DOLE has observed with dismay that some of the activities of international humanitarian agencies and non-governmental organisations’ operating in the North East have left so much to be desired,” read the statement.

“There is credible information that some of them are indulging in unwholesome practices that could further jeopardise the fight against terrorism and insurgency, as they train and deploy spies who support the insurgents and their sympathisers.

“It is baffling to note that some of these organizations have been playing the terrorists’ script with the aim to continue demoralizing the troops who are doing so much to protect the lives of victims of Boko Haram Terrorism and safe guard them from wanton destruction of property and means the of livelihood. The Theatre Command considers the actions of these organizations as a direct assault and insult on the sensibilities of Nigerians, as they tend to benefit more from expanding the reign of terror on our people.

“Consequently, the Theatre Command Operation LAFIYA DOLE is suspending the operations of the United Nations International Children’s Emergency Fund (UNICEF) in the North East theatre until further notice.

JUST IN: Troops of Sector 3 Operation SHARAN DAJI in 8 Division Nigerian Army AOR have neutralised a gang of bandits that have been terrorizing residents and burning down houses at Tsafe Local Government Area of Zamfara State.

Based on credible intelligence the criminals were ambushed at Tungar Rakumi on 12 December 2018.At the end of the operation, 2 bandits clad in military camouflage were neutralized and 2 AK 47 rifles loaded with 7 Magazines was recovered.

Similarly, troops of Sector 3 working in conjunction with members of Civilian Joint Task Force arrested a notorious arms gun runner known as Lawali Aliyu along a path leading to Araba village in Illela Local Government Area of Sokoto State. on 13 December 2018.

The suspect was arrested in possession of 1015 rounds of 7.62mm Ammunition concealed in a sack. Suspect and items were subsequently moved to Sokoto State Police Command for further investigation. Pictures below.

The Nigerian Army has issued a statement reacting to a recent accusation of War Crimes levelled against it reportedly by the International Criminal Court, ICC.

Below is a full statement made available to PoliticsNGR signed by the Director of Army Public Relations, Sani Kusheka;

"The attention of the Nigerian Army has been drawn to a front page news story of Daily Independent newspaper of today, Tuesday 11th December 2018, with the headline “NIGERIAN ARMY IS GUILTY OF WAR CRIMES -ICC”, written by one Austin Oboh. According to the paper, “The International Criminal Court (ICC) has ruled that Nigerian army is guilty of war crimes against humanity.”

This is not true. The Nigerian Army has not been accused of any wrong doing let alone being arraigned before any court. It is therefore wrong and sheer mischief for any person, group or newspaper to allege that the Nigerian Army has been found guilty of war crimes.

For the avoidance of doubt, yesterday, Monday 10th December 2018, the Office of the Prosecutor (OTP) of the International Criminal Court (ICC) presented the 2018 Report of her activities. Nowhere in the 78 page report titled “Report of Preliminary Examination Activities 2018” dated 5th December 2018, did she state that the Nigerian Army is guilty of any crime let alone war crimes as the newspaper alleged.Although it is true that the OTP is currently investigating allegations of human rights violations made against the Nigerian Army, that investigation is still at its preliminary stages and does not translate to standing trial, let alone being found guilty.

The Nigerian Army is aware that the office of the OTP has requested for additional information from the Federal Ministry of Justice to enable it determine appropriate steps on how to proceed with the matter. It therefore follows logically that a matter that has not been fully investigated cannot be subject of a final pronouncement by the ICC.

Please note that the Nigerian Army has been consistent in cooperating with the Federal Ministry of Justice, National Human Rights Commission and the several human rights investigative bodies established by the Presidency to review its human rights footprints specifically in the areas of operations including but not limited to the North East Zone.

Yesterday, Monday 10th December 2018 in commemoration of the International Human Rights Day, the Chief of Army Staff issued a statement affirming the commitment of the Nigerian Army to the promotion and protection of Human Rights. In which he said that “the Nigerian Army firmly believes that the promotion and protection of human rights are an essential component of our military operations.

We firmly embrace the idea and the message behind the International Human Rights Day and we are committed to doing our part to spread awareness and support for human rights every day”.

We are dismayed by the recklessness of the said newspaper in publishing such a sensationally false story and giving it undue prominence. A simple research on the website of the International Criminal Court would have provided clarity on the issue.
We urge journalists and editors to consider the national security implications of this type of publications. Our nation’s security should not be jeopardised by the desire to sell publications or cause mischief.

It is our hope that the Daily Independent newspaper will properly inform itself on the inaccuracy of its story by setting the records straight and apologise to the Nigerian Army."

The International Criminal Court (ICC) who released an annual report on preliminary examination activities (2018), stated that the Nigerian army has committed war crimes against humanity. 

According to the ICC, it has received “a total of 169 communications” from Nigeria and its assessment has shown that security forces in Nigeria have committed war crimes varying from murder, torture, and intentionally attacking the civilian population.

“Specifically, the Office found a reasonable basis to believe that the NSF committed the war crimes of murder pursuant to article 8(2)(c)(i); torture, cruel treatment pursuant to article 8(2)(c)(i); outrages upon personal dignity pursuant to article 8(2)(c)(ii); and intentionally directing attacks against the civilian population,” the ICC said.

According to Cableng, Fatou Bensouda, the ICC prosecutor disclosed that they also found reasonable basis to believe that Boko Haram, also committed war crimes against humanity.

"Furthermore, the Office found a reasonable basis to believe that Boko Haram committed the war crimes of murder pursuant to article 8(2)(c)(i); cruel treatment pursuant to article 8(2)(c)(i) and outrages upon personal dignity pursuant to article 8(2)(c)(ii)”.

The ICC added that Boko Haram was “intentionally directing attacks against the civilian population or against individual civilians pursuant to article 8(2)(e)(i); intentionally directing attacks against buildings dedicated to education and to places of worship and similar institutions pursuant to article 8(2)(e)(iv); pillaging a town or place pursuant to article 8(2)(e)(v); rape, sexual slavery and sexual violence pursuant to article 8(2)(e)(vi)”.

The ICC also disclosed that they met with Abubakar Malami, Nigeria’s minister of justice and attorney general of the federation (AGF), to further investigate eight potential cases of Nigerian army war crimes against humanity.

ICC says several “files pertaining to alleged violations by members of the army were submitted to the Office (of the prosecutor). These files relate to a limited extent to the two potential cases identified by the Office”.

“Of the 27 files provided to the Office, 24 either lacked information to determine their relevance for the admissibility assessment or did not appear relevant.

The ICC complained that “other information specifically requested by the Office which was assessed to be potentially relevant to the admissibility assessment has yet to be provided by the Nigerian authorities”.

The ICC who also said it is examining the farmers-herders crisis in Nigeria, added since 2017, the Nigerian authorities appear to have “taken concrete steps toward fulfilling their primary responsibility to investigate and prosecute ICC crimes”. 

However the prosecutor noted that the Nigerian government always denies any allegations against the Nigerian army. 

“While there seems to be a tangible prospect of further proceedings against members of Boko Haram, including high-level commanders, at this stage the same cannot be said of the NSF, in particular since the Nigerian authorities tend to deny any allegation against the latter.

“While acknowledging the cooperation of the Nigerian authorities in the course of the preliminary examination, the Office will require, for the purpose of expediting its complementarity assessment, further information and evidence
demonstrating that relevant national proceedings are being or intended to be conducted without delay”.

1. The Nigerian Army (NA) has noted with dismay, the rantings of one Timi Frank on Daily Post online publication of 4 December 2018, where he alleged that the Vice President, Professor Yemi Osinbajo and the COAS Lt Gen TY Buratai were responsible for Deji Adeyanju’s re-arrest by the Nigerian Police Force(NPF). This is obviously one of the series of smear campaigns that have been directed at the NA and particularly the person of the COAS by misinformed and ill meaning Nigerians.

2. An audacious fib of this magnitude must have either been borne out of willful intent to forment trouble or of a malicious intent to malign the person of the COAS. Otherwise, any reasonably informed Nigerian need not dig too deep to ascertain the true reasons for Deji Adeyanju’s arrest by the NPF. Besides, the NPF has the rights and powers to take up such responsibilities of fighting cyber related offences and issues relating to inciting disturburances in the country.

3. Having noted the foregoing, it would suffice to add that the NA is not ignorant of all the recent false information concerning NA Operations been peddled by @adeyanjudeji on twitter as well as abusive and libelous outbursts of the same handle on the person of the COAS. To this end, the NA is already in consultation with its advocates for appropriate legal actions to be taken in accordance to the rule of law.

4. Furthermore, the NA wishes to dissociate itself from the current self-induced predicament of Deji Adeyanju in the hands of the NPF, which is being sensationalized by his promoters. Such sponsors of Deji Adeyanju are advised to keep the NA and its leadership out of their self-seeking, cheap popularity on social media.

5. Finally, the NA wishes to once again utilize this opportunity to appreciate the goodwill and support of well-meaning Nigerians. The NA will continue to remain dedicated in carrying out its constitutional roles, despite any form of smear campaign by detractors. You are to please note and disseminate same through your various media channels."

Dan-Ali said the changes were to enable them meet up with the current threats and security challenges in their areas of responsibility.

The directives came as a pro-democracy organisation, Human Rights Writers Association of Nigeria (HURIWA) said the special forces of the army fighting in the ongoing counter insurgency in the northeast needed special weapons to fight the Boko Haram terrorists.To this end, the group urged the National Assembly to pass a legislative framework which will make funding of the defence sector as a first line charge to ensure efficient and effective roles by the military to stabilize national security.

HURIWA lamented that the $1billion said to have been taken from the escrow account was yet to drop at the Defence Ministry, wondering why the government could allow bureaucratic bottlenecks to slow down the process of releases and utilization of fund for the prosecution of the ongoing war against terrorists.

The group also canvassed the creation of what it calls ‘War budgets’ and the time line for national security objectives that must be achieved by a particular set of service chiefs, and a specified tenure so that other competent professional and combat-tested and trusted military generals are appointed to replace the serving military chiefs so the counter terror war does not become a commercially viable sector to be used by them for personal aggrandizement.

These were contained in a statement signed by the National Coordinator Comrade Emmanuel Onwubiko and National Media Director Miss Zainab Yusuf.
