I know what I am saying. You only read half of the whole story. Festus Keyamo brought the final court paper detailing exactly what happened. Part of it is what I stated to you. David Hindeyin will not show you that because it punctures his smear campaign. Keyamo brought this to TVC live and showed every aspect of the judgement. That’s why Tinubu is keeping quiet with agitators, because they will come to court to waste their money.
oga leave all these long story o....
I already explained it for you unbiasedly and you can even check the petition with tinubu's name as defendant

Drug related cases in Chicago are " accompanied" by forfeiture, fines or drug assessment ( this would further indict you even more if the grams are in high volumes)

According to the petition " the forfeiture" stood and was confirmed valid because of a "criminal case" otherwise any seasoned lawyer could recover those funds on the grounds of unlawful seizure

If you don't understand this simple thing i just said then forget it you are irredeemable

P.S everything Kenyamo said on Channels and TVC are all rubbish and white lies. I watched them which further led me to hear from the horse's mouth " Laws of Chicago"

Shalom

Yes you read it well. The final court judgement shows that he was discharged and some money taken from his account because he had not paid tax on his interest generated in the account. That was not his fault. The bank normally does that but they did not remove the interest.
oga rest. If you read the case against tinubu you would not be saying this...its very obvious you are being biased and blinded by sheeplike support for APC

See the condition for forfeiture. The accused must be caught with cocaine in his car or apartment. Tinubu was never caught with any. The judge discovered that he has neighbors that have been convicted and has money in his account much more than his salary and therefore, thought it to be proceeds of drugs. Tinubu's case was different.
lol how does this sound to you?

Are you serious? Okay i have heard let the court decide

Again, any drug found on any person is accompanied by prison sentence or probation at least. Thats apart from forfeiture of property etc. This is evidence that Tinubu was never convicted for drugs. The forfeiture of some money is for tax not paid on his interest in the account.
Lol

PODATTI hit and nailed team tunubu real hard with the drugs matter.
very hard indeed.

Because according to the laws of Chicago, forfeitures related to drug crimes can be fought and those funds recovered by a very seasoned lawyer , although very hard , if the defendant can prove that the arrest and trial were unjust.

But once found guilty its game over. Forfeiture, fines, or even imprisonment will take place

Politics / Tinubu: Fact Check On " Forfeiture" According To Chicago laws by Creeza(m): 1:50pm On Mar 24, 2023
I am not being biased on this but i've seen news flying on Nairaland where the current CJN described "forfeiture" in a case against ABACHA in 2014

Also this is good because some irredeemable persons are saying according to him Tinubu's case is simple because it was a forfeiture based on "civil neglect" which according to them isn't a crime...

The laws of the state of llinois specifically stipulated otherwise....

2. The tinubu camp says the forfeiture happened more than 30 years ago but fail to realise that a plea bargain and eventual forfeiture of property is simply an alternative after being found guilty and in events of huge amounts of grams the law of Illinois states that the imprisonment or jail term is as long as 15 to 60 years....

Correct me if i am wrong, but a drug case involving money laundering upto the tune of 1.2 million dollars as found in Tinubu's account ( allegedly) isnt proceeds ( allegedly) from little grams of drug or cocaine...

This is no child's joke
Believe me or not, Tinubu's drug case is really a pain in the ass

Verdict: Forfeiture is an alternative punishment for drug crimes involving proceeds or properties from such crimes according to the laws of Chicago.

Wonderful619:

My problem with people like you and your lawpadi is that you on read the section of the law that favours wicked mindset
Take a look the section limb (d) of that section

(d) he is under a sentence of death imposed by any competent court of law or tribunal in Nigeria or a sentence of imprisonment or fine for any offence involving dishonesty or fraud (by whatever name called) or for any other offence, imposed on him by any court or tribunal or substituted by a competent authority for any other sentence imposed on him by such a court or tribunal; or
More: https://jurist.ng/constitution/sec-137

I hope say you understand this one. This is the preceding section before section e
You they mind am? Many sub-sections working against Tinubu but its the one that has 10 years clause attached to it that they rushed to see... Forgetting that if Tinubu had indeed been convicted there is no way of knowing how long he would have been locked up for?

Edited : Similarly, a delivery of less than one gram of cocaine or heroin results in a Class 2 felony, with a sentencing range of 4 to 15 years in prison, with probation being a possibility. If the amount of drugs is 900 grams, the range is 15 to 60 years.

source : https://www.srhunterlaw.com/Drug-Crime-Penalties-in-Illinois
And to evade this, Tinubu agreed to plea bargain!?

My guess is as good as yours, a fee up to $460,000 can not just be proceeds from cocaine or drugs less than 900 grams

Is that not a fine and evidence of forfeiture was recorded on paper.
Even a primary school student knows that a case in which the defendant agrees to plea bargain is as equivalent to being punished for such crime

Mumu!

b. The second argument is that BAT was charged and fined $460,000 for an offence committed in the USA involving dishonesty – narcotics trafficking in 1993, and a decree of forfeiture was ordered against him, and based on this was ineligible to run for the office of President.

What does the law say on this point?

Section 137 of the 1999 Constitution deals with what grounds make an individual ineligible to run for the office of President. Specifically, 137(1)(e) of the 1999 Constitution provides that a person would be ineligible to contest if within a period of less than 10 years before the date of the election to the office of President he has been convicted and sentenced for an offence involving dishonesty or he has been found guilty of the contravention of the Code of Conduct.

Lawpadi Verdict - This does not seem to be a very strong argument, and we think it is unlikely to be upheld by the tribunal. This is because the case in the USA was decided in 1993 (30 years ago). The Constitution states it has to be a conviction within the last 10 years.
you didn't read further below on other sections, just pick the one that suits you abi?

e) within a period of less than ten years before the date of the election to the office of President he has been convicted and sentenced for an offence involving dishonesty or he has been found guilty of the contravention of the Code of Conduct; or

(f) he is an undischarged bankrupt, having been adjudged or otherwise declared bankrupt under any law in force in Nigeria or any other country; or

(g) being a person employed in the civil or public service of the Federation or of any State, he has not resigned, withdrawn or retired from the employment at least thirty days before the date of the election; or

(h) he is a member of any secret society; or

(i) he has been indicted for embezzlement or fraud by a Judicial Commission of Inquiry or an Administrative Panel of Inquiry or a Tribunal set up under the Tribunals of Inquiry Act, a Tribunals of Inquiry Law or any other law by the Federal or State Government which indictment has been accepted by the Federal or State Government, respectively; or

Fixed!!!

dishonesty is as good as a case of fraudulent activities or proceeds from a drug cartel which was forfeited as a dishonest earning

I stan to be corrected by SANs but please if you are a Senior Agbado of nonsense, dont mention me

Even section182 explains further and amplifies on the case of fraud and dishonesty

(Sic) refer to what code of conduct means
and check the substitution of a plea bargain instead of a jail term

Results on IReV portal is not mandatory for collation, it was meant to enhance accountability and transparency by allowing the public to compare and contrast results.

INEC claimed they have technical issues, which I understand has been resolved, as over 140k PU result is on the portal now, besides all party agent have the pink copy of the result, they can check the IRev for comparison.

This election is one of the best conducted in Nigeria's history.
