Lied about his failure in governance until Governor Soludo exposed him for the thief and fraud that he is. This is an audio conversation that Bishop Oyedepo has not denied. I am sure that if it was fake, Oyedepo in his usual character, would have rained curses on whoever tried to portray him in bad light. Those arguing that 25% is compulsory for FCT are very mischievous. Because the Supreme Court ruled so in 2008 or whenever in a previous case is inconsequential today because Supreme court judgements are not laws in themselves but simply interpretation of laws. That interpretation can change in another case depending on the arguments that the lawyers put forward. There are many instances of such in the history of the supreme court. Now to the case. The electoral act states that a candidate vying for President must get 25% of the votes in two-thirds of the states and the FCT. The argument is focused on the interpretation of the word and. Keep in mind that Nigeria as a whole is the President's constituency and the FCT is just the seat of office. But regardless of how "and" is interpreted, both parties on either side agree that the constitution of Nigeria is superior to any other law that is at variance with it, including that contentious electoral act. So, what did the constitution say regarding the FCT? The constitution says that the FCT should be regarded as a state. It is in plain black and white. In simple terms, it means that the FCT should be treated same way as Lagos state, Borno state, Bayelsa state and the other 33 states. That means the FCT is considered equal and not inferior or superior to each and every one of the 36 states. In practice, is it so. Yes. But in unique circumstances. The FCT has a minister appointed by the President overseeing its affairs but the states have elected governors doing same. Therefore the President can be considered the defacto governor of the FCT. The same way state governors are required to win 25% in two-thirds of the local government areas in their states to be elected governor but there is no compulsion to win 25% in the local government area where each state capital city is situate, is same way the President is not under compulsion to win the FCT given the constitutional equality of the states and the FCT. It is simple and straightforward. Those mentioning 2008 must know that the judgement then is not cast in stone and judges can deviate from precedent if a valid argument persuade them. Judges are not immune from mistakes. So let that be clear. In the USA for example, the Supreme Court there recently overturned the Roe vs Wade precedent that had stood for decades. APC has solid lawyers who will argue beautifully along this line and the accepted superiority of the Constitution over the Electoral act gives them the advantage.
